AUTHORIZING TERMINATION OF WARRANTY PERIOD
FOR
AREA A (OFF -SITE)
AND
AREA (D) ON -SITE)
AND
AREA D (CDOT RIGHT OF WAY)
AND
ACCEPTANCE OF BRETT TRAIL SOUTH ROAD

WHEREAS, pursuant to C.R.S. §30 -28 -137, the Board of County Commissioners of the
County of Eagle, State of Colorado ( "County") entered into a Subdivision Improvements
Agreement dated May 18, 1998 ( "Agreement ") with Brett Ranch Holdings LLC, a Colorado
Limited Liability Company ( "Subdivider ") as a condition of final plat approval for Brett Ranch
PUD; and
WHEREAS, both the Subdivider and the Engineering Department state that the work
required under the Agreement for AREA A (Off -Site) and AREA D (On -Site) and AREA D
(CDOT Right of Way) are complete and acceptable and the Engineering Department
recommends termination of the warranty periods for AREA A(Off -Site) and AREA D (On -Site)
and AREA D (CDOT Right of Way), see Exhibit "A," attached hereto and incorporated herein by
this reference.
WHEREAS, based upon the oral and written recommendations of the County Staff, the
Board wishes to accept the following roadway for maintenance and inclusion in the Eagle County
Road Inventory: A new road called Brett Trail South, extending from the south side of US 6
approximately 200 Feet west of milepost # 165, in the southerly direction for approximately
1,668 feet (0.316 miles) to the end.
WHEREAS, AREA A Lake Creek Village Drive and AREA A (On -Site) will continue
with the two -year warranty periods as specified in Eagle County Consent No. 2001 -20 and
Consent No. 2001 -27.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, based upon the oral and written recommendations of the County staff, THE
BOARD FINDS that the Subdivider's obligations under the Agreement for Area A (Off - Site),
Area D (On -Site) and AREA D (CDOT Right of way) have been satisfied.
WHEREAS, upon the recommendation of the Engineering Department and the
dedication by Subdivider, Eagle County accepts the following roadways for maintenance and
inclusion in the Eagle County Road Inventory:
A new road called Brett Trail South, extending from the south side of US 6,
approximately 200 feet west of milepost # 165, in the southerly direction for approximately 1,668
(0.316 miles) to the end.
THAT, this document shall be recorded in the Records of the Eagle County Clerk and
Recorder, which shall be evidence that the warranty periods for AREA A (Off -SITE) and AREA
D (On- Site), and AREA D (CDOT Right of Way) have been successfully completed and that the
Subdivider's obligations under the Agreement for AREA A(Off - Site), AREA D (On -Site) and
AREA D (CDOT Right of Way) are complete.
THAT, Area A, Lake Creek Village Drive and AREA A (On -Site) are not released and
will continue with their two -year warranty periods.
MOVED, READ AND ADOPTED by the Board of County Commissioners of the
County of Eagle, State of Colorado, at its regular meeting held the 096(..,, day of October,
2002.

Seventh Release of Collateral and Termination of Warranty Period for Area D and Area A, Off -
Site of the Brett Ranch P.U.D. (PDF- 00015), Subdivision Improvements Agreement, dated May
18, 1998. As part of this collateral release and partial termination of the warranty period, Brett
Trail South should be accepted for maintenance by Eagle County.
