Development Combined Sketch /Preliminary Plait for the Berry Creek / Mill er Ranch Planned Unit Development; File:No. PDSP- 00014;: and VVHIREAS, at its regular meeting on 5 February 2002, the Eagle County Board of Commissioners (hereinafter "Board'), approved the Combined.PUD Sketch/Preiiminary plan for the Berry Creek./ Miller Ranch PUD; and WHEREAS, a provision of the PUD Guide and Land Use Restrictions for the. Combined PUD Sketch/Preliminary Plan for the Berry Creek / Miller Ranch PUD is that an oven space management plan shall be prepared and approved by the Eagle County Board' oard of County � Commissioners prior to or concurrent with approval of the final plat for the Berry Creek /Miller Ranch PUD and WHEREAS, an Open Space Management Plan for Tracts I.and J, dated 29 April 2002, has been prepared pursuant to the requirement of the PUD Guide and Land Use Restrictions to ensure proper management and maintenance of Tracts I and J of the Berry Creek/ Miller Ranch PUD. 7999448 ; Page: 1 of 6 ; Sara J Fisher Eagle, CO 370 R @ @0 @6/25D20 @0� 4 : 07p 1 t C (" BASED ON THE EVIDENCE BEFORE IT THE BOARD FINDS AS FOLLOWS: Pursuant to the Berry Creek /Miller Ranch PUD Guide and Land Use Restrictions dated 13 February 2002, Paragraph G, Open Space Management The Open Space Management Plan for Tracts I and J, dated 29 April 2002, does satisfy the requirement of the PUD Guide and Land Use Restrictions and does ensure proper management and maintenance of Tracts I and J of the Berry Creek / Miller Ranch PUD. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, the Open Space Management Plan for Tracts I and J, dated 29 April 2002, for the Berry Creek / Miller Ranch PUD, attached hereto as Exhibit "A ", be and is hereby approved. THE BOARD further finds, determines and declares that this Resolution is necessary for the health, safety and welfare of the inhabitants of the County of Eagle, State of Colorado. Stone This Resolution passed by y - 0 vote of the Board of County Commissioner of the County of Eagle, State of Colorado. 3 � r Open Space Management Plan For Tracts I and J Berry Creek /Miller Ranch PUD Open Space Management Tracts I and J have been designated Open Space due in part to the visual quality and environmental sensitivity of this portion of the Berry Creek /Miller Ranch PUD. The purpose of this land use designation is to protect and preserve the environmental characteristics of this portion of the PUD while allowing for limited passive recreation use. This open space management plan has been prepared in order to ensure proper management and maintenance of these tracts. Allowable Uses: The uses permitted shall be those uses established by the Berry Creek /Miller Ranch PUD Guide. Trails: When constructed, trails will be located and designed to allow access to the tracts while at the same time serving to concentrate activity in the least sensitive areas of the site. When feasible, trails will avoid wetland and riparian areas. Spur trails will be established to the Eagle River in order to prevent degradation of stream banks and vegetation. Trails should generally be constructed of gravel or other "soft" (i.e. impervious) surfaces. Pedestrians and bicyclists shall only be allowed access in the sensitive areas of the site on designated trails. All trails will be signed to prevent motor vehicle access. Parking: Paved or gravel parking areas, if any, will be limited to the far west end of the open space parcels along Miller Ranch Road /Cemetery Bridge Road (road to be renamed). No overnight parking shall be allowed. Fishing Access and Control: Fishing access shall be limited to officially established trails. Eagle County will work with the Colorado Division of Wildlife to establish fishing regulations as may be necessary to maintain an environmentally sensitive eco- system. As necessary, Page -1- C C the County shall erect signs at trailheads notifying the public of fishing regulations for the property. Animal Control: Dogs and other domestic animals shall be on -leash at all times when on the tracts. Animals shall only be allowed on improved trails. Animal owners shall be required to remove any fecal matter generated by their animal from the tracts. Horse and Livestock Control: Horses shall be allowed on designated trails only and horses shall be under the control of the rider at all times. Grazing of the tracts by horses or other livestock shall be prohibited unless deemed appropriate for vegetation or weed control by Eagle County. Vegetation Control: The County, with the assistance of other agencies, shall take measures to ensure invasive plant species are controlled or removed from the tracts. Disturbed areas on the tracts shall be restored with native vegetation and measures shall be taken to ensure further degradation is discouraged (i.e., posting of signs, erection of physical barriers, etc.). The County shall establish a schedule for periodic inspections of the site to ensure proper vegetation management. Property Oversight and Control: Property oversight and control shall be the responsibility of Eagle County. The County may work with other agencies and organizations to oversee the property. At the discretion of the County, a volunteer group of interested citizens may be established to help monitor the activities on the property and suggest ways to improve the management of the property. Wildlife Protection: It is prohibited to disturb any wildlife on the property. Hunting, trapping, chasing, harassing, or removal of wildlife is specifically prohibited. Permit for Organized Groups: Groups wishing to use the property for environmental education and similar events shall first obtain permission from Eagle County. In such cases, group may Page -2- 0 G receive special permission for access during restricted months. Seasonal Closures: Eagle County shall work with the Colorado Division of Wildlife regarding seasonal closures of the property. As necessary, the County shall erect signs at trailheads notifying the public of such closures. Violations: This management plan and PUD restrictions for this open space will be enforced by Eagle County with the assistance of the Colorado Division of Wildlife. It shall be a prohibition to remove or damage any vegetation, soil, or other items found on the property by anyone other than an authorized Eagle County official or with the permission of Eagle County. Trespassing on the property during closed hours and restricted months is prohibited. Enforcement of this Open Space Management Plan shall be pursuant to Title 18, Part 5 of the Colorado Revised Statutes which includes criminal mischief and criminal trespass; Title 33, Wildlife and Parks and Outdoor Recreation; and any other local, state, or federal regulations that apply.
