PDF -00064 ro WHEREAS, on or about January 17,200 1, the County of Eagle, State of Colorado, accepted for filing an application submitted by William A. and Annalies B. Stephens (hereinafter "Applicant ") to final plat the herein described property in Eagle County; and, WHEREAS, the Applicant requested the approval of a Planned Unit Development (PUD) Final Plat which would allow for the development as follows: • Five single - family detached lots; • A 4.5 acre school site; • A 0.682 acre storage site; Two Lots and one Parcel for single - family residences and commercial uses; • Two Open Space Parcels totaling 43.698 acres; • A 1.1 acre Fire District site; • A .736 acre Metropolitan District site; • Road Rights -Of -Way and Easements. WHEREAS, a public hearing was held by the Board of County Commissioners (hereinafter the 'Board ") of the County of Eagle, State of Colorado, on April 23, 2002; and, WHEREAS, based on the evidence, testimony, exhibits, and study of the Master Plan for the unincorporated areas of Eagle County, comments of the Eagle County Department of Community Development, comments of public officials and agencies, and comments from all interested parties, the Board of County Commissioners of the County of Eagle, State of Colorado, finds as follows: That proper public notice was provided as required by law for the hearings q I r)c- Page 1 of 3. before the Planning Commission and the Board; and, Pursuant to Eagle County Land Use Regulations, Section 5- 280.B.5.b (3) Final Plat for Subdivision: 1. This final plat DOES conform with all conditions of the approved Preliminary Plan. 2. This final plat DOES conform with standards set forth in Section 5- 280.B.3.e (Standards for Subdivision) of the Eagle County Land Use Regulations. 3. A Subdivision Improvements Agreement IS required by the Board of County Commissioners. Said Agreement has been executed by the applicant for this file. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of the County of Eagle, State of Colorado: THAT, Pursuant to Eagle County Land Use Regulations, Section 4 -700.A School Land Dedication Standards: The Board of County Commissioners finds that Eagle County's RE -50J School District has adequately demonstrated reasonable necessity for the applicant to dedicate and convey land area for a school site to serve the proposed residential subdivision THAT, Pursuant to Eagle County Land Use Regulations, Section 4- 710.E.c Road Impact Fees: The Board of County Commissioners find that the previously calculated Road Impact Fees of $1000 per residential unit as established in the PUD approval of September 18, 2000 shall, because of the newly adopted Section 29 -20 -102, et seq., C.R.S., continue to be applied to this project. The newly adopted Road Impact Fee schedule is inappropriate to be applied herein as a complete application for the Final Plat was filed prior to the adoption of the schedule of Road Impact Fees. THAT, the application for the Two Rivers Estates Final Plat be and is hereby APPROVED for the following described property located in the unincorporated area of Eagle County: See Exhibit A attached hereto and thereby incorporated herein by reference Page 2 of 3 THAT the Board hereby finds, determines and declares that this Resolution is necessary for the health, safety and welfare of the inhabitants of the County of Eagle, State of Colorado.
