HomeMy WebLinkAboutR02-059 final release of collateral for Dotsero Ranch PUDC) G Commissioner moved adoption of the ollowing Resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 2002 -� FINAL RELEASE OF COLLATERAL AND TERMINATION OF THE WARRANTY PERIOD FOR DOTSERO RANCH PUD PDF -00040 WHEREAS, on January 3, 2000, Dotsero Ranch LLC ( "Subdivider ") and the Board of County Commissioners of Eagle County, Colorado (hereinafter `Board ") entered into a . Subdivision Improvements Agreement (hereinafter "Agreement ") concerning the development of Dotsero Ranch PUD; and WHEREAS, both the Subdivider and the Engineering Department state that the work required under the Agreement is complete and acceptable and the Engineering Department recommends full release of the remaining collateral and the termination of the Subdivision Improvements Agreement, see Exhibit "A" attached hereto and incorporated herein by this reference. Based upon the oral and written recommendations of the County staff, THE BOARD FINDS that the Subdivider's obligations under the Agreement have been satisfied. WHEREAS, the warranty period established in Consent No. 2001 -30 has ended. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, the Board hereby authorizes the full and final release of the remaining collateral and the termination of the Subdivision Improvements Agreement for Dotsero Ranch PUD; THAT, this document shall be recorded in the Records of the Eagle County Clerk and Recorder, which shall be evidence that the warranty period for Dotsero Ranch PUD has been successfully completed and that the Subdivider's obligations under the Agreement are complete. THAT, the Letter of Credit No. 8178801 issued by 1 stBank of Avon be returned. Vengrin :A Y Engineering Department DATE: April 2, 2002 RE: "Subdivision and Off -Site Improvements Agreement ", Dotsero Ranch PUD Final Plat, PDF- 00040, Dated January 3, 2000, Reception No. 722260,1 Bank Letter of Credit No. 8178801 Today I conducted an inspection of the public improvements for the above referenced subdivision. I found everything has successfully survived the warranty period that was established in Consent No. 2001 -30. The warranty period is to expire on April 3, 2002. It is my recommendation that the Subdivision and Offsite Improvements Agreement (SIA) referenced above be terminated, and that the remaining collateral in the amount of $35,444.70 be returned to the Subdivider. None of the public improvements in the SIA are intended for ownership or maintenance by Eagle County.
