( "Subdivider ") and the Board of County Commissioners of Eagle County, Colorado (hereinafter "Board ") entered into a Subdivision Improvements Agreement (hereinafter "Agreement ") concerning the development of Blue Lake Subdivision Filing V; and WHEREAS, both the Subdivider and the Engineering Department state that the work required under the Agreement is complete and acceptable and the Engineering Department recommends full release of the remaining collateral and the termination of the Subdivision Improvements Agreement, see Exhibit "A," attached hereto and incorporated herein by this reference. Based upon the oral and written recommendations of the County staff, THE BOARD FINDS that the Subdivider's obligations under the Agreement have been satisfied. WHEREAS, upon the recommendation of the Engineering Department and the dedication by Subdivider, Eagle County accepts the following roadways for maintenance and inclusion in the Eagle County Road Inventory: 1. A new road called Buckhorn Drive, extending from the north side of JW Drive, in the northerly direction for approximately 1,104 feet (0.209 miles) to the end. The south end of Buckhom Drive is approximately 1,150 feet north of the intersection of JW Drive and State Highway 82. 2. A new road called Buckhorn Circle, extending from the south side of Buckhorn Drive in the southerly direction for approximately 100 Feet (0.018 miles) to the end. The beginning of Buckhorn Drive is approximately 215 feet west of the intersection of JW Drive and Buckhom Drive. m; m 0 U m � L N � ro -- L ro 3. An extension of an existing road called Black Bear Trail from the west end in the westerly direction for approximately 2,101 feet (0.398 miles) to the intersection with Goose Lane. A new road called Goose Lane, extending from the western end of Black Bear Trail in the easterly direction for approximately 1,938 fee (0.367 miles) WHEREAS, the correction period required by Consent No. 99 -21 be terminated. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, the Board hereby authorizes the full and final release of the remaining collateral and the termination of the Subdivision Improvements Agreement for Blue Lake Subdivision Filing V. THAT, this document shall be recorded in the Records of the Eagle County Clerk and Recorder, which shall be evidence that the warranty period for Blue Lake Subdivision Filing 5 has been successfully completed and that the Subdivider's obligations under the Agreement are complete. THAT, the remaining collateral held in Bank One Escrow Account No. 1014058610 be returned to the Subdivider. On February 22, 2002, I inspected the public improvements covered by the above referenced Subdivision Improvements Agreement (SIA) in need of correction. I recommend that this SIA be terminated, and that the remaining collateral be returned to the Subdivider, Vantex Enterprises, Inc.
