HomeMy WebLinkAboutR02-013 sketch plan for Castle Ridge SubdivisionC ; Commissioner moved adoption of the,/following Resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 2002—_ '3 EXTENSION OF APPROVAL OF THE SUBDIVISION SKETCH PLAN FOR CASTLE RIDGE SUBDIVISION EAGLE COUNTY FILE NO. SUS -00006 WHEREAS, on or about October 19, 1999, the County of Eagle, State of Colorado, accepted for filing an application submitted by Peter Fodor and Barbara Lowe (hereinafter "Applicant ") for approval of the Subdivision Sketch Plan for Castle'Ridge, Eagle County File No. SUS - 00006; and, WHEREAS, the Applicant requested the approval of said Subdivision Sketch Plan which would allow for the development of four residential lots ranging from 2.56 to 2.89 acres each, and two open space tracts on 18.22 acres; and, WHEREAS, at its regular meeting of 22 February 2000, the Eagle County Board of Commissioners (hereinafter "Board "), approved a Resolution nunc pro tunc to 18 January 2000 which approved said Subdivision Sketch Plan, subject to several conditions; and WHEREAS, on or about 14 November, 2001, the County of Eagle, State of Colorado, received a request for a two year extension of the approval of said Subdivision Sketch Plan pursuant to Section 5- 280.B.3.f(4) of the Eagle County Land Use Regulations; and WHEREAS, at its regular meeting of 18 December 2001, the Board considered the request for a two year extension of said Subdivision Sketch Plan, the statements and concerns of the Applicant, the Eagle County Community Development, and other interested persons. BASED ON THE EVIDENCE BEFORE IT, THE BOARD FINDS AS FOLLOWS: 1. Applicant has timely submitted a written extension request to the Community Development Director. 2. The Sketch Plan is not speculative in nature. 4. The Sketch Plan still complies with the Land Use Regulations and the Master Plan. 5. There is a reasonable likelihood the Preliminary Plan for Subdivision will be developed in the next two (2) years. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, extension of the approval of the Subdivision Sketch Plan for Castle Ridge for two years until 18 January 2004 be and is hereby granted. THE BOARD further finds, determines and declares that this Resolution is necessary for the health, safety and welfare of the inhabitants of the County of Eagle, State of Colorado. MOVED, READ AND ADOPTED by the Board of County Commissioners of the County of Eagle, State of Colorado, at its regular meeting held thq 2002, nunc pro tunc to the 18th day of December, 2001.
