of the following Resolution:
BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 2006. f 07,./
IN OPPOSITION TO AMENDMENT 38 _
THE PETITION RIGHTS AMENDl\tlENT
WHEREAS, the Board of County Commissioners of the County of Eagle, State of
Colorado (hereinafter the "Board") acknowledges that Colorado has a current and satisfactory
Initiative and Referendum process in place for state and local government; and
WHEREAS, the Board acknowledges Amendment 38 may undermine public confidence
in the initiative and referendum process by continually voting and re-voting issues that have
already been decided at an election; and
WHEREAS, the Board recognizes that Amendment 38, in its two previous iterations, has
already been rejected by voters by wide margins, once in 1994 (30-70%) and again in 1996 (34-
66%); and
WHEREAS, the Board recognizes that Amendment 38 fundamentally relaxes the rules
for placing an issue on the ballot, many of which are necessary for ensuring clear, legal and non-
fradulent petition submittals; and
WHEREAS, the Board recognizes that Amendment 38 removes the "checks and
balances," including removal of the "single subject" clause that ensures ballot issues aren't
hiding multiple subjects, lowering the signature requirement, and eliminating the verification of
petition signatures to prevent fradulent petitions; and
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COl\lMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the Board does hereby declare their opposition to, and urges a NO vote on the
Petition Rights Amendment appearing as Amendment 38 on the November 7,2006 statewide
ballot.
