COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 2006-
A RESOLUTION CALLING FOR THE HOME RULE CHARTER
COMMISSION TO BEGIN A SECOND ATTEMPT TO PRESENT A CHARTER
TO THE BOARD OF COUNTY COMMISSIONERS OF EAGLE COUNTY
WHEREAS, pursuant to C.R.S. 30-11-501, et seq., the County has elected a
Home Rule Charter Commission (hereinafter "Commission"); and
WHEREAS, within two hundred forty (240) days, the Commission shall present
to the Board of County Commissioners a proposed charter pursuant to C.RS. 30-11-
501(2); and
WHEREAS, pursuant to C.RS. 30-11-501(3), if the Commission has not
presented a charter to the Board of County Commissioners within said specified time, the
Commission shall recess for a period of not less than thirty days nor more than ninety
days. The Board of County Commissioners shall then call the Commission to begin a
second attempt to present a charter; and
WHEREAS, the Commission was not able to present a charter within the
specified two hundred and forty (240) days and so notified the Board of County
Commissioners on July 21, 2006 (see Notice attached hereto as Exhibit "A" and
incorporated herein by this reference).
WHEREAS, the Commission has now recessed for a period not less than thirty
days and the Board of County Commissioners is now desirous of calling the Commission
to begin a second attempt to present a charter.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
Section 1. Second Attempt Called. Pursuant to C.RS. 31-11-505(3), the Board
of County Commissioners hereby calls the Commission to begin a second attempt to
present a charter which shall be presented within a period of ninety days.
Section 2. Notice of Call. The Chairman of the Board of County Commissioners
is authorized to execute and have delivered to the Commission the Notice of Call
attached hereto as Exhibit "B."
Section 3. Severability. If any part, section, paragraph, clause or provision of
this Resolution shall be adjudged to be invalid or unenforceable, the invalidity or
unenforceability of such section, paragraph, clause, or provision shall not affect the
remaining sections, paragraphs, clauses or provisions of this Resolution, it being the
intention that the various parts hereof are severable.
MOVED, READ AND ADOPTED by the Board of County Commissioners of
the County of Eagle, State of Colorado, at its regular meeting held the 29th day of
August, 2006.

Re: Home Rule Charter Commission
To the Board of County Commissioners:
Please allow this letter to serve as formal notice that the Eagle County Home
Rule Charter Commission will not submit a proposed charter to the Board of
County Commissioners in the requisite two-hundred and forty (240) day period
prescribed by Section 30-11-504 (3), C. R.S. Based on input from its five public
hearings on the charter, the Commission requires additional time to complete its
work. As such, at the close of the two-hundred and forty (240) day period, the
Commission will recess for thirty (30) days and upon a call by the Board, shall
reconvene with the intent to submit a completed charter at that time.
Attached please find a letter sufficient to serve as the Board's call to the
Commission to make a second attempt at completing and submitting a charter.
