HomeMy WebLinkAboutR06-069 rec #200617830 - approval of Big O Subdivision Commissioner ~e.oL-l , moved adoption of the following Resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 2006 - APPROVAL OF THE BIG 0 SUBDIVISION MINOR TYPE A SUBDIVISION FILE NO. SMA-00026 WHEREAS, on or about February 8th, 2006, the County of Eagle, State of Colorado, accepted for filing an application submitted by the Eagle-Vail Mag7 Investors, LLC (hereinafter "Applicant") for approval of a Minor Type A Subdivision for Big 0 (Tires), File No. SMA- 00026; and, WHEREAS, the Applicant requested the approval for the creation of a Minor Type A Subdivision to subdivide an existing, unplatted property in Eagle-Vail in order to create a new lot for a Big 0 Tires operation; and, WHEREAS, the Big 0 Tires is proposed to be situated on one (1) of the two (2) lots created by this subdivision; and, WHEREAS, the property, prior to this subdivision, is commonly referred to as the "Qwest Property", located in the commercial area of Eagle-Vail, (see attached Exhibit 'A'); and, WHEREAS, the property is currently zoned Commercial General; the lot is a 2 acre lot, proposed to be split into two (2), 1 acre lots; and, WHEREAS, File ZS-00137 is an accompanying file to the Minor Type A Subdivision; and, WHEREAS, the Big 0 Tires property/site is designed to accommodate access to the westem property as shown on the provided plat (see attached Exhibit 'B'); and, Page 1 of 4 WHEREAS, notice of the Minor Type A Subdivision was given to all proper agencies and departments as required by the Eagle County Land Use Regulations, Section 5-21O.E; and, WHEREAS, a public hearing was held by the Board of County Commissioners (hereinafter "the Board") of the County of Eagle, State of Colorado, on June 20th, 2006 to consider this Minor Type A Subdivision application; and, WHEREAS, based on the evidence, testimony, exhibits, and study of the Master Plan for the unincorporated areas of Eagle County, comments of the Eagle County Department of Community Development, comments of public officials and agencies, the recommendation of the Planning Commission, and comments from all interested parties, the Board of County Commissioners of the County of Eagle, State of Colorado, finds as follows: 1. That proper publication and public notice was provided as required by law for the hearings before the Board. 2. Pursuant to Eagle County Land Use Regulations Section 5-290.G.1. Standards for the review of a Minor Type 'A' Subdivision: (1) Consistent with Comprehensive Plan. The proposed Special Use Permit CAN be shown to be appropriate for its proposed location and be consistent with the purposes, goals, objectives and policies of the Comprehensive Plan and FLUM, including standards for building and structural intensities and densities, and intensities of use. (2) Consistent with Land Use Regulations. The proposed subdivision IS consistent with all of the standards of this Section and all other provisions of these Land Use Regulations, including, but not limited to the applicable standards of Article 3, Zone Districts and Article 4, Site Development Standards. (3) Spatial Pattern Shall Be Efficient. The proposed Subdivision WILL result in an efficient spatial pattem. (4) Suitability for Development. The property proposed to be subdivided IS suitable for development, considering topography, environmental resources and natural or man-made hazards that may affect the potential development of the property and existing and probable future improvements to the properties. (5) Compatible With Surrounding Uses. The proposed Subdivision IS compatible with existing land uses in the area and WILL NOT adversely affect the future development of the surrounding area. Page 2 of 4 (6) Improvements Agreement. A Subdivision Improvements Agreement IS necessary for this proposal. (7) Conformance with Final Plat Requirements. The proposed Subdivision DOES conform to all Final Plat requirements and all other applicable regulations, policies, standards and guidelines. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of the County of Eagle, State of Colorado: THAT, the Minor Type A Subdivision for Big 0 Tires, File No. SMA-00026, be, and is hereby approved with the following conditions: 1. Except as otherwise modified by this permit, all material representations made by the Applicant in this application and in public meeting shall be adhered to and considered conditions of approval; 2. The necessary US Highway 6 Access Permit must be approved prior to actual signature of the plat by the Board of County Commissioners. 3. The Subdivision Improvements Agreement must be first approved by the Engineering Department and Attomey's Office prior to signature by the Board of County Commissioners. 4. Road Impact Fees will be collected prior to building permit issuance. 5. As a condition of sale or lease of the parcel of land on which the present Qwest building is located, the Applicant agrees to require that the successor owner or lessee commit in writing, in a form acceptable to the Eagle County Attomey, to obtain a Certificate of Zoning Compliance for each and every proposed use of such parcel from the Eagle County Community Development Department confirming that such prospective use complies with the Eagle County Land Use Regulations and site development standards. THAT, the Board of County Commissioners directs the Department of Community Development to provide a copy of this Resolution to the Applicant. THAT the Board further finds, determines and declares that this Resolution is necessary for the health, safety and welfare of the inhabitants of the County of Eagle, State of Colorado. 3 MOVED, READ AND ADOPTED by the Board of County Commissioners of the County of Eagle, State of Colorado, at its regular meeting held this ~., day 2006, nunc pro tunc to the 20th day of June, 2006.
