RESOLUTION NO. 2006-
APPROVAL OF THE POINTE AT EDWARDS MINOR TYPE 'A' SUBDIVISION
Formerly known as The Bluffs at Edwards Minor Type 'A' Subdivision
FILE NO. SMA-00025
WHEREAS, on or about September 21,2005, the County of Eagle, State of Colorado,
accepted for filing an application submitted by the Thomas M. Wheeler Revocable Living Trust
(hereinafter "Applicant") for approval of a Minor Type 'A' Subdivision, File No. SMA-00025;
and,
WHEREAS, the Applicant requested the approval of the Minor Type 'A' Subdivision
which would allow for the development as follows:
To allow an infill residential development consisting of eleven (11) clustered, single-
family homes situated on 7.584 acres in central Edwards. This Minor Type 'A' Subdivision
defines the 7.584 acre parcel as one lot with eleven separate building envelopes. Following
construction of the residences, they will be further subdivided for individual sale via one or more
Minor Type 'B' subdivisions. Each lot will be sized slightly larger than the footprint of each
residence; all other areas with the development will be owned in common by the residents.
WHEREAS, notice of the Minor Type 'A' Subdivision was given to all proper agencies
and departments as required by the Eagle County Land Use Regulations, Section 5-21O.E; and,
WHEREAS, a public hearing was held by the Board of County Commissioners
(hereinafter the "Board") of the County of Eagle, State of Colorado, on January 3,2006 to
consider this Minor Type 'A' Subdivision application; and
WHEREAS, based on the evidence, testimony, exhibits, study of the Master Plan for the
unincorporated areas of Eagle County, comments of the Eagle County Department of
Community Development, comments of public officials and agencies, and comments from all
interested parties, the Board of County Commissioners of the County of Eagle, State of
Colorado, finds as follows:
That proper publication and public notice was provided as required by law for the hearings
before the Board.

Pursuant to Eagle County Land Use Regulations Section 5-290.G.1. Standards for
the review of a Minor Type' A' Subdivision:
(1) Consistency with Master Plan. The proposed subdivision is consistent with the
Eagle County Master Plan and the Future Land Use Map (FLUM) of the Master Plan.
(2) Consistent with Land Use Regulations. The proposed subdivision does comply with
all of the applicable standards of this Section and all other provisions of these Land
Use Regulations, including, but not limited to, the applicable standards of Article 3,
Zone Districts, and Article 4, Site Development Standards.
(3) Spatial Pattern Shall Be Efficient. The proposed subdivision is located and
designed to avoid creating spatial pattems that cause inefficiencies in the delivery of
public services, or require duplication or premature extension of public facilities, or
result in a "leapfrog" pattem of development.
(4) Suitability for Development. The property proposed to be subdivided is suitable for
development, considering its topography, environmental resources and natural or
man-made hazards that may affect the potential development of the property, and
existing and probable future public improvements to the area.
(5) Compatible with Surrounding Uses. The proposed subdivision is compatible with the
character of existing land uses in the area and shall not adversely affect the future
development of the surrounding area.
(6) Improvements Agreements. A subdivision improvements agreement has been
prepared by the County Attomey's Office and executed by the applicant. A
performance guarantee to cover costs associated with off-site and on-site public
infrastructure improvements, as well as landscaping of common areas within the
development is required.
(7) Conformance with Final Plat Requirements. The Minor Type 'A' Subdivision plat
is a Final Plat and it does conform to the Final Plat requirements and other applicable
regulations, policies, standards and guidelines.
WHEREAS, subsequent to the Board of County Commissioners approval of the Minor
Type 'A' Subdivision application on January 3,2006, ownership of the subject property was
conveyed to The Pointe at Edwards LLC, a Colorado Limited Liability Company.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
the County of Eagle, State of Colorado:
THAT, the application for approval of the Minor Type 'A' Subdivision plat for
The Bluffs at Edwards be and is hereby approved, subiect to compliance with the
following conditions:

1. Prior to issuance of the first building permit, a CDOT Access Permit that includes
traffic generated by this development must be received by Eagle County for the
Bull Run Road / U.S. Highway 6 intersection.
2. Prior to the issuance of the first building permit, the applicant must provide
verification through recorded documents that the existing sanitary sewer easement
through building envelopes 5, 6, 8, 9, and 11 has been vacated.
3. Prior to any site disturbance, the applicant's contractor must submit a Dust
Suppression Plan for both on-site and off-site grading activities that will be
reviewed for approval by the Department of Environmental Health. Also, the
applicant will maintain the gravel road in good condition prior to paving.
4. A site-specific geotechnical report will be required for each foundation at the time
of building permit application.
5. Prior to the issuance of the first building permit, the Affordable Housing fee of
$82,272.40 must be submitted to the Eagle County Housing Department.
6. A Geotechnical Engineer must verify that underground water be diverted or
accommodated in such a manner as to not adversely impact the road prism. Also,
no further degradation of the drainage conditions at the Bull Run Road and U.S.
Highway 6 intersection shall result from any work performed by the applicant.
7. Except as otherwise modified by these conditions, all material representations of
the Applicant in this application and all public meetings shall be adhered to and
be considered conditions of approval.
THAT the Board further finds, determines and declares that this Resolution is necessary
for the health, safety and welfare of the inhabitants of the County of Eagle, State of Colorado.
MOVED, READ AND ADOPTED by the Board of County Commissioners of the
County of Eagle, State of Colorado, at its regular meeting held this 27th day of June, 2006,
nunc pro tunc to the 3rd day of January, 2006.
