RESOLUTION NO. 2006 - OJ/
APPROVAL OF TilE INTERVAL OWNERSHIP ESTATES
BEA VER CREEK PARK HYA TT, BEAVER CREEK SUBDIVISION
FILE NO. PR-00031
WHEREAS, the Board of County Commissioners of the County of Eagle, State of
Colorado (herinafter the"Board") is authorized to pennit Interval Ownership Estates within the
Beaver Creek Planned Unit Development pursnant to Section VIIl of the Amended and Restated
Guide to the Beaver Creek Planned Unit Development (PUD Guide) recorded in Book 638, Page
584 as filed in the office of the Eagle County Clerk and Recorder; and
WHEREAS, the Residences at Park Hyatt Beaver Creek (hereinafter the
"Applicant"). applied to the Eagle County Department of COmmunity
Development for a review of the Disclosure Statement and Marketing Plan for
Interval Ownership Estates as required by the PUD Guide on or about March 6lh,
2006; and
WIIEREAS, based on the evidence, testimony, exhibits, study of the requirement of the
PUD Guide, comments of the Eagle Cuunty Department of COmmunity Development, COmments
of public officials and agencies, and comments from all interested Parties, the Board of County
Commissioners of the County of Eagle, State of Co lorado (the "Board") finds as follows:
1. That proper publication Was provided as required by law for the hearings before the
Board.
2. That the Disclosure Statement provides sufficient infonnation to make a determination
that the plan is not inconsistent with the general health safety and welfare of persons
within Eagle County.
3. That the Marketing Plan provides sufficient infonnation to make a detennination that the
plan is not inconsistent with the general health, safety and welfare of persons within
Eagle County.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THA T, the board hereby approves tbe allowance for Interval Ownership Estates at the
Beaver Creek Park Hyatt.
THAT, shonld the Applicant not Comply with Disclosure Statement and Marketing Plan
as submitted, the aUowance for tnterval Ownership Estates shaJI be revoked.
THA T, the Board directs the Department of Community Development to provide a copy
of this Resolution to the Applicant.
THE BOARD further finds, detennines and declares that this Resolution is necessary for
the health, safety and welfare of the inhabitants of the County of Eagle, State of Colorado.
MOVED, READ AND ADOPTED by the Board of County COmmissioners of the
