RESOLUTION NO. 2005 -
APPROVAL OF THE P ALMEROSA RANCH SUBDIVISION SKETCH PLAN
FILE NO. SUS-00015
WHEREAS, on or about February 4,2005, the County of Eagle, State of Colorado,
accepted for filing an application submitted by Palmerosa Development Company, LLC - Jim
Comerford (hereinafter "Applicant") for approval of a Subdivision Sketch Plan for Palmerosa
Ranch, File No. SUS-00015; and,
WHEREAS, the Applicant requested the approval of a Subdivision Sketch Plan which
would allow for the development as follows:
Originally the proposal entailed the creation of eight (8) single family residential lots on
the 43.689 acre subject property. Subsequent to two Planning Commission hearings, the
Subdivision Sketch Plan proposal was revised down to seven (7) single family residential lots on
the 43.689 acre property. Following the first of two Board of County Commissioner hearings,
the Subdivision Sketch Plan request was further revised downward to six (6) single family
residential lots on the 43.689 acre property. As delineated herein, as a condition of approval of
the Subdivision Sketch Plan, the Board of County Commissioner's placed a condition upon their
approval to eliminate Lot 6. As such, the final Subdivision Sketch Plan approval is for five (5)
single family residential building sites.
WHEREAS, notice of the Sketch Plan was given to all proper agencies and departments
as required by the Eagle County Land Use Regulations, Section 5-210.E; and,
WHEREAS, at its public hearing(s) held April 20, 2005 and May 18,2005, the Eagle
County Planning Commission, based upon its findings, recommended approval, with conditions,
of the proposed Subdivision Sketch Plan; and
WHEREAS, public hearings were held by the Board of County Commissioners
(hereinafter the "Board") of the County of Eagle, State of Colorado, on June 13,2005 and July
18, 2005 to consider this Sketch Plan application; and
WHEREAS, based on the evidence, testimony, exhibits, study of the Master Plan for the
unincorporated areas of Eagle County, comments of the Eagle County Department of
Community Development, comments of public officials and agencies, the recommendation of
the Planning Commission, and comments from all interested parties, the Board of County
Commissioners ofthe County of Eagle, State of Colorado, finds as follows:
That proper publication and public notice was provided as required by law for the hearings
before the Planning Commission and the Board.
Pursuant to Eagle County Land Use Regulations Section 5-280.B.3.e. Standards for
the review of a Sketch and Preliminary Plan for Subdivision:
(1) Consistency with Master Plan. The proposed subdivision is consistent with the
Eagle County Master Plan and the Future Land Use Map (FLUM) ofthe Master
Plan.
(2) Consistent with Land Use Regulations. The proposed subdivision does comply
with all ofthe standards ofthis Section and all other provisions ofthese Land Use
Regulations, including, but not limited to, the applicable standards of Article 3,
Zone Districts, and Article 4, Site Development Standards.
(3) Spatial Pattern Shall Be Efficient. The proposed subdivision is located and
designed to avoid creating spatial patterns that cause inefficiencies in the delivery
of public services, or require duplication or premature extension of public
facilities, or result in a "leapfrog" pattern of development.
(4) Suitability for Development. The property proposed to be subdivided is suitable
for development, considering its topography, environmental resources and natural
or man-made hazards that may affect the potential development of the property,
and existing and probable future public improvements to the area.
(5) Compatibility with Surrounding Uses. The proposed subdivision shall be
compatible with the character of existing land uses in the area, and shall not
adversely affect the future development ofthe surrounding area.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
the County of Eagle, State of Colorado:
THAT, the application for approval of the Subdivision Sketch Plan for the Palmero sa
Ranch be and is hereby approved, subiect to compliance with the following conditions:
1) That all material representations made by the Applicant in submitted materials and in public
meetings shall be adhered to and considered conditions of approval, unless otherwise
amended by other conditions.
2) At the time of Preliminary Plan application, all comments of the Engineering Department as
delineated in its memorandum dated March 29,2005 and July 13,2005 must be addressed to
the County Engineer's satisfaction.
3) At the time of Preliminary Plan application, all comments of the Environmental Health
Department as delineated in its memorandum dated April 6, 2005 must be addressed to the
satisfaction of the Director of Environmental Health.
4) At the time of Preliminary Plan application, all recommendations of the Northwest Colorado
Council ofGovemments letter dated March 25,2005 must be fully addressed.
5) At the time of Preliminary Plan application, the subdivision plat should include notations that
reflect the recommendations of the Colorado State Forest Service in its letter dated March 16,
2005.
6) At the time of Preliminary Plan application, all recommendations of the Colorado Geological
Survey in its letter dated March 17, 2005 must be fully addressed.
7) At the time of Preliminary Plan application, a housing plan that meets the intent of the Eagle
County Housing Guidelines must be submitted as described in the Eagle County Housing
Department memorandum dated March 29,2005.
8) At the time of Preliminary Plan application, an irrigation plan must be provided.
9) At Preliminary Plan application, detailed drainage plans must be provided.
10) At Preliminary Plan application, the applicant must provide either an agreement from a public
water provider to serve each of the proposed residential lots.
11) At Preliminary Plan, all recommendations of the Eagle County Weed & Pest Coordinator in
their memorandum of April 4, 2005 must be adequately addressed.
12) At Preliminary Plan, remove lot 6 from the Subdivision Sketch Plan application.
13) Work with Department of Wildlife to develop an appropriate mitigation plan prior to
Preliminary Plan application.
14) At Preliminary Plan, move Lot 2 to the south.
15) At Preliminary Plan, a detailed landscape plan and a preliminary housing elevation plan shall
be provided.
THAT, the Sketch Plan submitted under this application and hereby approved does not
constitute a "site specific development plan" as that phrase is defined and used in C.RS. Section
24-68-101, et seq.
THAT the Board further finds, determines and declares that this Resolution is necessary
for the health, safety and welfare of the inhabitants of the County of Eagle, State of Colorado.
MOVED, READ AND ADOPTED by the Board of County Commissioners of the
County of Eagle, State of Colorado, at its regular meeting held this~h day of
August, 2005, nunc pro tunc to the 18th day of July, 2005.
