RESOLUTION NO. 2005 - tl2!/
A RESOLUTION NOTIFYING THE STATE TREASURER TO
DISTRIBUTE FEDERAL MINERAL LEASING FUNDS IN
ACCORDANCE WITH THE PROVISIONS OF ~ 34-63-102, C.R.S.
WHEREAS, Section 34-63-102 of the Colorado Revised Statutes provides for a
distribution of a portion of those moneys received by the State Treasurer pursuant to the
provisions ofthe Federal Mineral Lands Leasing Act of February 25, 1920, for the use of public
schools and political subdivisions of the State of Colorado for the planning, construction, and
maintenance of public facilities and for public services; and
WHEREAS, Section 34-63-102(3)( c), C.R.S., provides that each county shall notify the
State Treasurer to have at least twenty-five percent (25%) ofthe money described in Section 34-
63-102(3)(a) distributed to any school district within the county specified; and
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the State Treasurer is hereby directed to distribute a total of twenty-five percent
(25%) of moneys described in Section 34-63-102(3)(a), c.R.S., to the school districts within
Eagle County.
THAT, the twenty-five percent (25%) allocated to the public school districts within the
county shall be divided in proportion to which the average daily pupil attendance of each district
during the preceding school year bears to the aggregate average daily pupil attendance in all
districts in Eagle County during said school year. The aggregate average daily pupil attendance
in Eagle County for the school year 2004-2005 is 5885 pupils. The average pupil attendance of
each school district within Eagle County, and the resulting percentages, are as follows:

THAT, the Board further requests, in accord with Section 34-63-102 of the Colorado
Revised Statutes, that the State Treasurer disburse the remaining money allocable to Eagle
County to the Treasurer of Eagle County.
IT IS FURTHER RESOLVED that the office of the County Administrator is directed to
mail a copy of this Resolution to the State Treasurer as Eagle County's notification and direction
as to disbursement of said mineral leasing funds.

RE: Mineral Leasing Allocations to School Districts
(C.R.S. 34-63-102)
Dear Board of County Commissioners:
Colorado statute C.R.S. 34-63-1 02( c )(1) provides that at least 25% of the county share of the
federal Mineral Lease distribution be paid to school districts within the county. This statute also
requires that counties report to the State Treasurer's office each calendar year the percentage to be
distributed to each school district within the county boundaries. The law does not allow the State
Treasurer to disburse funds until it receives this notification.
You are requested to submit the required notification $0 that distributions for
calendar year 2005 can be made promptly.
Please note updated quarterly payments are posted on the futemet on or about the 20th working day
of the month following each quarter end. The site is located at www,treasurer.state.co.us, under
the link "futerGov Payments". Also, mineral lease payments may be paid electronically. If

RE: County Public School Fund Allocations
As you know, pursuant to Section 22-54-113, CRS, each school district with property in
your county isentilledto receive a proportionate share of YOUfCOUnty'S PubticScl100l
Fund. A district's share is equal to the proportion that each district's funded pupil count
bears to the aggregate funded pupil count of all districts with property in the county.
I have attached a worksheet illustrating the allocations for each school district that has
property in your county.
