COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 84-J I
APPROVAL OF SPECIAL USE PERMIT - R.A. Mining
FILE NO: - ZS- 195 -84
WHEREAS, Howard Tingley and Jerome Gamba did file an
application with the Eagle County Department of Community
Development on or about February 15, 1984, within the
Resource Zone District; and
Whereas, a public hearing was held by the Board of
County Commissioners of the County of Eagle, State of
Colorado, on April 11, 1984 ; and
WHEREAS, based on the evidence, testimony, exhibits,
study of the Master Plan for the unincorporated areas of
Eagle County, comments of the Eagle County Department of
Community Development, comments of public officials and
agencies, -the recommendation of the Eagle County Planning
Commission, and comments from all interested parties, the
Board of County Commissioners of the County of Eagle, State
of Colorado, finds as follows:
1. That proper publication and public notice was
provided as required by law for the hearing before the
Planning Commission and the Board of County Commissioners.
2. That the proposed special use conforms to the
requirements of Section 2.09 of the Eagle County Land Use
Regulations.
3. That the proposed land use will be compatible with
existing uses in the area.
4. That for the above - stated and other reasons, the
proposed zoning is in the best interest of the health, safety,
morals, convenience, order, prosperity and welfare of the
citizens of Eagle County.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners of the County of Eagle, State of Colorado:
That the application of R. A. Mining, File No. ZS- 195 -84,
for approval of a special use of Mineral Mining and Crushing
within the Resource Zone District in the following described un-
incorporated area of Eagle County be approved:

THAT the following conditions shall be placed upon
this approval and that violation of any condition shall be
the basis for revocation of the permit:
1. The capacity of the mining operation is limited to
70,000 tons per day.
2. No more than 5 -10 acres should be mined at any one
time without reclamation. As each area is completed
slopes should be recontoured and seeded before new
areas are opened.
3. The access road from the U.S. Interstate 70 Inter-
change to the mining site shall be a County standard
gravel road with a 24' road prism. And variances to
this standard will be subject of the approval of the
County Engineer and the Bureau of Land Management.
4. It is acceptable for the applicant to begin work
on the mine before the road is complete. However, the
road must be complete before production begins.
5. The staff will contact the Bureau of Land Management to
request their participation in a cost - sharing agree-
ment for the 96" drainage culvert. The applicant may
approach the Board of County Commissioners at some
point in time to request the County's participation in

a similar cost - sharing agreement for the culvert.
6. There shall be an annual review, which would include
an annual submittal of maps showing existing conditions
and plans for the next year.
THAT the Board of County Commissioners directs the
Department of Community Development to provide a copy of this
resolution to the applicant.
