HomeMy WebLinkAboutR1979-24 Guidelines for the Suspension or Revocation of a Liquor License •• 11 41 RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO Resolution setting forth guidelines for the suspension or revocation of a liquor license. WHEREAS, the Colorado Liquor Code provides that the local licensing authority may suspend or revoke any license issued by it for any violation by the licensee or by any agents, servants, or employees of such license of the provisions of the Colorado Liquor Code or any of the rules or regulations authorized pursuant to the Colorado Liquor Code or of any of the terms, conditions or provisions under which the license was issued; and WHEREAS, the Colorado Liquor Code does not provide any guide- lines for the determination of the imposition of the sanctions of revo- cation or suspension; and WHEREAS, the Board of County Commissioners, County of Eagle, State of Colorado, acting in its capacity as the local licensing authority desires to establish guidelines concerning any aggravating or mitigating factors relevant to a decision by such local licensing authority concerning suspension or revocation of a liquor license. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners, County of Eagle, State of Colorado, acting in its capacity as the local licensing authority pursuant to the Colorado Liquor Code; THAT the local licensing authority hereby finds, determines and declares that the following guidelines shall be used concerning any aggravating or mitigating factors relevant in the determination of any sanction to be imposed in the suspension or revocation of a liquor li- cense pursuant to the Colorado Liquor Code: 1. Seriousness of the violation(s) (affront to the public). 2. Corrective action(s) taken (if any). 3. Prior violations and offenses at the licensed premises and effectiveness of prior corrective action. 4. Prior violations and offenses by the licensee. 5. Violation of a repeated course of conduct or as a single event. 41140 6. Likelihood of recurrence. 7. All circumstances surrounding the violation. 3. Willfulness of the violation(s). 9. Hardship on this licensee for the sanction imposed. 10. Length of time the license has been held by this licensee. 11. Previous sanctions imposed against the licensee. 12. Other factors making the situation with respect to licensee or premises unique. authority hereby finds THAT the local licensing y y , determines and declares that this Resolution is necessary for the health, safety and welfare of the citizens of Eagle County, Colorado.
