BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 80- � /
DELETION OF PLAT RESTRICTION - SUBSTITUTION OF COLLATERAL - FINAL PLAT OF
SOUTH SCOTTSVILLE SUBDIVISION
WHEREAS, the Board of County Commissioners, County of Eagle,
Colorado, hereinafter referred to as the "Board ", at a regular meeting held on
the 30th day of July, 1980, approved the final plat of South Scottsville
Subdivision; said final plat being recorded in Book 306 at Page 421 of
the property records of the County of Eagle, Colorado; and
WHEREAS, as a condition of final plat approval, the subdividers
of South Scottsville Subdivision entered into a Subdivision Improvements
Agreement dated July 30, 1980, and recorded in Book 311 at Page 876 of the
property records of the County of Eagle, Colorado; and
WHEREAS, as a condition of final plat approval of South Scottsville
Subdivision, a plat restriction was placed on said final plat which stated:
"No lots within said subdivision shall be sold and /or conveyed
until all public improvements referred to in the Subdivision
Improvements Agreement dated 7/30/80 are approved and accepted
by the Board of County Commissioners "; and
WHEREAS, the subdividers have requested that said plat restriction
be deleted and lifted from the final plat of South Scottsville Subdivision
conditional upon the submittal by the Subdividers of a cash deposit in the
name of the County of Eagle, Colorado, in the amount of eight thousand,
dollars ($ 8,000.00) to guarantee the satisfactory completion of those'
certain public improvements set forth in the Subdivision Improvements Agree-
ment referred to herein.
NOW, THEREFORE, be it resolved by the Board of County Commissioners,
County of Eagle, Colorado:
THAT, the plat restriction placed upon the final plat of South
Scottsville Subdivision which states:
"No lots within said subdivision shall be sold and /or conveyed
until all public improvements referred to in the Subdivision
Improvements Agreement dated 7/30/80 are approved and accepted
by the Board of County Commissioners"
is hereby deleted and lifted from said final plat and shall have no further
force or effect with respect to the sale of such lots.
THAT, the deletion of the plat restriction referred to in the
paragraph next above is conditional upon the subdividers providing the
County sufficient collateral in the form of a cash deposit in the amount
of eight thousand dollars ($ 8,000.00) to guarantee the satisfactory
completion of those certain public improvements as per that certain
Subdivision Improvements Agreement dated July 30, 1980, between the County
of Eagle and the Subdividers of the South Scottsville Subdivision.
THAT, the Board hereby extends the completion date of those
certain public improvements referred to in said Subdivision Improvements
Agreement from November 15, 1980, to November 15, 1981.
THAT, the substitution of collateral does not in any way release
the Subdividers from the obligations and covenants within that certain
Subdivision Improvements Agreement dated July 30, 1980.
THAT, the Board hereby finds, determines and declares that this
Resolution is necessary for the public health, welfare and safety in the
County of Eagle, State of Colorado.
MOVED, READ AND UNANIMOUSLY ADOPTED at a regular meeting of the
Board of County Commissioners, County of Eagle, Colorado, held this
7th day of November, 1980.
