DETERMINATION AND ORDER BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY
OF EAGLE IN THE STATE OF COLORADO RELATIVE TO CERTAIN TAX SALE CERTIFICATES
WHEREAS, pursuant to Section 39- 11- 142(6)(a), C.R.S. 1973,
as amended, in all cases where real proprerty has been struck off to the
county at a tax sale and the county has held the certificate of sale for
thirty (30) years or more without obtaining a tax deed, then such certificate
may be declared void and of no effect; and
WHEREAS, the County Treasurer of the County of Eagle, Colorado,
Mr. Hubert N. Peterson, prepared and presented to the Board of County
Commissioners, County of Eagle, Colorado, hereinafter referred to as the
"Board ", at its regular meeting held August 11, 1980, a list of all
real property and all Certificates of Sale struck off at tax sales to, and held
by, the County of Eagle, Colorado, for thirty (30) years or more without
obtaining a deed or being otherwise disposed of pursuant to Article
11 of Chapter 39 of the Colorado Revised Statutes, 1973, as amended; said
real property and said Certificates of Sale so listed by the County
Treasurer in said list so prepared and presented by him to the Board
as aforesaid, is set forth in Exhibit "A ", attached hereto and incorporated
herein by this reference; and
WHEREAS, the Board has determined, and hereby does determine,
that said Certificates of Sale hereinbefore mentioned, were struck off to
said County of Eagle, Colorado, at tax sale, that such Certificates have
been held by said County for thirty (30) or more years, and that no
tax deed has been obtained or applied for as provided in Section 39 -11 -142,
C.R.S. 1973, as amended.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners,
County of Eagle, State of Colorado:
THAT, the aforementioned Certificates of Sale are void and the
County Treasurer be, and he hereby is, directed to cancel such Certificates;
that this Order shall be duly entered in the recorded proceedings of this
Board; and that a certified copy of this determination and order shall
be recorded by said County Treasurer in his records and such Certificates
cancelled by him as specified in this Order.
MOVED, READ AND UNANIMOUSLY ADOPTED by the Board of County
Commissioners, County of Eagle, State of Colorado, at its regular meeting
held this 11th day of August, 1980.
