HomeMy WebLinkAboutR80-29 Vacation of Right of Way by Lake Creek RoadE Book 302 Page 509 Recorded at 9:00 AM Mav -6, 19$0 Recorder: Johnn ;e Phillips, Eagle Count RESOLUTION OF THE BOARD OF COUNTY COM1ISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION No. 80 - Q I Fee $0.00 VACATION OF COUNTY OF EAGLE FIGHT -OF -WAY IN AND /OR ABUTTING LAKE CREEK ROAD WHEREAS, Pursuant to that certain right -of -way dead recorddd in Bobk 106 at Page 597 of the property records of the County of Eagle, State of Colorado, the County received a right-of-way as described in Exhibit "A" attached hereto and incorporated herein by this reference: and WHEREAS, said right -of -way has never been used by the County; the reason being that the present right -of -way commonly known as the Lake Creek Road is not within the right -of -way described in Exhibit "A "; and WHEREAS, the Board of County Commissioners, County of Eagle, State of Colorado, has determined that said right -of -way, as described in Exhibit "A ", is entirely within the County of Eagle and not within the limits of any city or town and that the vacation of said right -of -way would not leave any land adjoining said right - of-way without an established public road connecting said land with another established road, i.e. the Lake Creek Road. NOW, THEREFORE, be it resolved by the Board of County Commissioners, County of Eagle, State of Colorado: THAT, upon the recording of this Resolution and a quit claim deed in connection herewith, the right -of -way as described in Exhibit "A" is hereby vacated, declared and decreed hereby to no longer be any part of the County of Eagle public road system pursuant to Section 43 -2 -303 C.R.S. 1973, as amended. THAT upon the vacation of said right -of -way, and pursuant to Section 43 -2 -302 C.R.S. 1973, as amended, title to said right -of -way shall vest in the owner of the land abutting such right -of -way, i.e. A.
