RESOLUTION
OF
THE BOARD OF COUNTY COM1ISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION No. 80 - Q I

VACATION OF COUNTY OF EAGLE FIGHT -OF -WAY IN AND /OR ABUTTING LAKE CREEK ROAD
WHEREAS, Pursuant to that certain right -of -way dead recorddd in Bobk
106 at Page 597 of the property records of the County of Eagle, State of Colorado,
the County received a right-of-way as described in Exhibit "A" attached hereto and
incorporated herein by this reference: and
WHEREAS, said right -of -way has never been used by the County; the reason
being that the present right -of -way commonly known as the Lake Creek Road is not within
the right -of -way described in Exhibit "A "; and
WHEREAS, the Board of County Commissioners, County of Eagle, State of
Colorado, has determined that said right -of -way, as described in Exhibit "A ", is
entirely within the County of Eagle and not within the limits of any city or town and
that the vacation of said right -of -way would not leave any land adjoining said right -
of-way without an established public road connecting said land with another established
road, i.e. the Lake Creek Road.
NOW, THEREFORE, be it resolved by the Board of County Commissioners,
County of Eagle, State of Colorado:
THAT, upon the recording of this Resolution and a quit claim deed in
connection herewith, the right -of -way as described in Exhibit "A" is hereby vacated,
declared and decreed hereby to no longer be any part of the County of Eagle public
road system pursuant to Section 43 -2 -303 C.R.S. 1973, as amended.
THAT upon the vacation of said right -of -way, and pursuant to Section
43 -2 -302 C.R.S. 1973, as amended, title to said right -of -way shall vest in the owner
of the land abutting such right -of -way, i.e. A. A. Calhoun & Company, a partnership.

A strip or parcel of land Forty (40) feet in width and extending
Twenty (20) feet right angle measure on each side of a center line hereinafter
described, situate, lying and being in the Southwest quarter of the Northwest
quarter (SW', of NW',) and the Northwest quarter of the Southwest quarter
(NW-'4 of SW-1, of Section Five (5) in Township Five (5) South, (— Range Eighty -two
(82) West of the Sixth (6th) Principal Meridian; said center line hereinabove
referred to being particularly described.as follows, to wit: Beginning at a
point on the South boundary of right of way of State Highway No. 4, in the
Southwest quarter of the Northwest quarter (SW; of NW;) of said Section Five
(5) from which point the quarter corner on the West boundary of said Section
Five (5) lies South 570 22' West 677.2 feet; thence South 190 20' West 191.637
feet; thence South 020 40' East 297.657 feet; thence South 050 40' East 257.05
feet; thence South 000 40' West 220.21 feet; thence South 040 30' West 196.97
feet; thence South 100 45' West 217.32 feet; thence South 120 45' West 405.7
feet to the South boundary of the Northwest quarter of the Southwest quarter
(NW', of SW',) of said Section Five (5). Said strip or parcel of land hereby
conveyed contains an area of 1.696 acres. Together with all and singular the
appurtenances and privileges thereunto belonging or in anywise appertaining.
