Ea le Count \1w ` g Y Page 757 RESOLUTIOI4 OF THE BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 80 - 40 EXEMPTION OF SUBDIVISION OF PART OF PARCEL A, LION'S RIDGE SUBDIVISION, FILING NO. 2, AND PART OF LOT 21, SECTION 1, T5S, R81W OF THE 6TH P.M. FROM ARTICLE 28, TITLE 30, PART 1 OF COLORADO REVISED STATUTES (1973). WHEREAS, Parcel A, Lion's Ridge Subdivision, Filing No. 2, is designated and zoned as a PD area under the Zoning Resolution of Eagle County, Colorado (the "Zoning Resolution ") and WHEREAS, a certain part of Lot 21, Section 1, T5S, R81W of the 6th P.M., as contained in the legal description of The Ridge At Vail attached to the Planned Unit Development Plan and Declaration of Protective Covenants attached hereto, has been previously conveyed and made a part of said Parcel A (all such property collectively referred to herein as the "Valley "); and WHEREAS, the Preliminary Plan (as defined in the Zoning Resolution) for the Valley has been approved with the PD containing certain described parcels, with each parcel having been approved with a limited number of dwelling units and G.R.F.A. (both as defined in the Zoning Resolution); and WHEREAS, the Board of County Commissioners of the County of Eagle, State of Colorado (the "Board "), have been requested to exempt from the Subdivision Regulations of Eagle County, Colorado (the "Subdivision Regulations "), certain of said parcels of the Valley such that each of said parcels may be conveyed and sold separately and such transfer shall not be in violation of the Subdivision Regulations; and WHEREAS, the Board has determined that provided the part of the present Preliminary Plan for the Valley pertaining to number of dwelling units and G.R.F.A. allowed on each phase and the requirements for road improvements on each phase is set forth in writing and recorded with protective covenants for the Valley and that such plan and covenants be referenced on any future plat or condominium map of any phase of the Valley conveyed pursuant to this Resolution, the division of the Valley into the presently approved parcels and the conveyance of each of said parcels separately is not within the purposes of Article 28, Title 30, Part 1, of Colorado Revised Statutes (1973) and the Subdivision Regulations; and WHEREAS, all references herein to Colorado Revised Statutes (1973) are to such statutes as presently amended. NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners, of the County of Eagle, State of Colorado: THAT, provided the Planned Unit Development Plan and Declaration of Protective Covenants, a copy of which is attached hereto and made a part hereof, have first been properly executed and acknowledged by the Board and the record owner of the following listed parcels of the Valley, Valley Associates, Ltd., a Colorado limited partnership, and properly recorded in the records of the Clerk and Recorder of Eagle County, Colorado, the following listed parcels of the Valley, as more fully described in the legal descriptions attached to the Planned Unit Development Plan and Declaration of Protective Covenants attached hereto, are hereby exempted from Article 28, Title 30, Part 1 of Colorado Revised Statutes (1973), as permitted pursuant to Section 30- 28- 101(10)(d), Colorado Revised Statutes (1973), and each such parcel may be conveyed and sold without any further compliance with the Subdivision Regulations.
