THE BO OF COUNTY COMNICSSIONERS COUNTY OF .'-s 1,E, STATE OF COLORADO A RESOLUTION FOR THE CON= Q LICENSING OF EMERGENCY MEDICAL SEWICES WHEREAS, the General 7�-- am:bly, at the First Regular Session of the Fifty -First General Asse b1:, enacted the Colorado Errergency Medical Services Act; being Sections 25- 3.5 -_O1 to 25- 3. 5-5 02, inclusive, C.R.S. 1973; and WHEREAS, the legislat-'-a intent expressed in the act is that the Board of County Commissioners of sacra county shall adopt those standards, require- ments and procedures for p-rc emergency medical services within the county which will best meet local needs; and WHEREAS, each board ;ter request assistance from the Department of Health in planning and iirplerrentinc suc�h standards, requirements and procedures; and WHEREAS, the depart - is also required under the provisions of the act to coordinate all local eff=,- so that maximum state -wide effectiveness can be assured; and WHEREAS, the Board is a"vised that it may adopt more stringent standards than those provided in the act; NOW, THEREFORE, BE IT-SC7LVED by the Board of County Commissioners of Eagle County, at the specie= Ming of the Board held on the 28th day of Deer, 1977, that the io 1:owing emergency nedical service standards, re- quire-rnnts and procedures a_= hereby adopted, by virtue of the authority vested in the Board by the Coloracc �_rergency Medical Service Act and by Section 30 -11- 107 (1) (q), C.R.S. 1973 (S.B. 454 enacted in 1977): 1. Commencing J-r_aa y 1, 1978, no person shall provide ambulance services publicly or `Y vately in Eagle County, unless, subject to the exception provided in Paragraph 7 herein, that person holds a valid license to do so issi d by: a. The Boar of County CCmassioners of Eagle County for an ambulance se= ce based in Eagle County; or b. The Boar of County Commissioners of the county in which such ambularw service is based, if other than Eagle County. 2. This Pesolu`-n shall not apply to: a. The exco =ona1 emrergency use of search and rescue unit vehicles and —ter vehicles not ordinarily used to transport patients; b. The use cf ;.-_hicles in a major catastrophe or emergency when there are a, '*sufficient number of local ambulances; c. The trasoor`ation of patients in Colorado by ambulances based outside_ thee state; d. The sc^ -pied transportation of convalescent patients, handi- capped indir::5,;a1s or persons who would not be expected to require skilled trey-�__t or care enroute, or to the vehicles designed for such puzpose; or e. The trartation of intoxicated persons or persons in- capacitated alcohol, not otherwise disabled or seriously injured, who would not be expected to require skilled treatment t' t or care ens_ in vehicles used solely for such purpose. 3. Licensing uT er tt-- provisions of this Resolution shall be granted to the applies t and renewed, by application, upon a finding by the Board that the applicant or licensee has conplied with the staff, vehicle and standards, requirements and procedures of parts 2 and 3 of =-.e Colorado Emergency Medical Services Act (as implemented by suet: and reulations as may be adopted pursuant to the provisions of State Administrative Procedure Act) and such other standards, reg. -rents and procedures as may be required by law and as the Board, 1 :y resolution herein establishes and as it may hereafter establish f= time to time. Application shall be made according to the fo= and in the manner prescribed in the Ambulance Service Application Pre Instructions attached hereto. 4. Each applicatc-n shall be accompanied by a fee of $25.00. 5. As used in t:s elution, unless the context otherwise requires: a. "Ambuulanc--e" means any privately or publicly owned land vehicle especially constructed or modified and equipped, intended to be u ead, and maintained or operated for the trans- portation, uDoa the streets and highways in this state, of individuals Vzo are sick, injured, or otherwise incapacitated or helpless. b. "Ambulance driver" mans any person authorized to drive an ambulance. C. "Ambulance service" means the furnishing, operating, con- ducting, maintaining, advertising, or otherwise engaging in or professing to be engaged in the transportation of patients by ambulance. S_=n in context, it also means the person so en- gaged or professing to be so engaged. d. "Board of C,oun-ty Commissioners" includes the governing body of any city as county. e. 'Tepart -e=_' means the Department of Health. f. "EmergenT mans any actual or self - perceived event which threatens life, lip, or well -being of an individual in such manner that a :a--� for immediate medical care is created. g. "Emergent- -eii_ca]_ technician" means an individual who holds a valid medical technician certificate issued by the Department as prided in the Colorado Emergency Medical Services Act h. "Patient" moans any individual who is sick, injured, or other- wise incapa_ =;.� or helpless. i. "Permit" 5 the authorization issued for the operation of a particu'_= a—r bulance. j. "Rescue z_-it" mans any organized group chartered by this state as a corpora_ not for profit or otherwise existing as a nonprofit organization, -#�-hnse purpose is the search for and the rescue of lost or injured _ersons and includes, but is not limited to, such groups as sea_ ` and rescue, mountain rescue, ski patrols (either volunteer or - rofessional), law enforcement posses, civil defense units, or ot_: organizations of governmental designation res- -'- twuu[J� '4v✓3: •'ponsible for search and rescue. 6. The County Public Health Officer and County Public Health Nurse shall constitute the Eagle County Ambulance Service Licensing Agents and are appointed hereby. They shall administer the licensing and Permit program, under the direction of the Hoard, and shall serve the Board as liaisons with the Department of Health, the State Board of Medical Examiners and the Division of Communications of the Department of Administration. 7. Pursuant to the provisions of Section 25 -3.5 -301 (4), C.R.S. 1973, the Board may grant a conditional license to an ambulance service if such service is not in compliance with the aforesaid staff, vehicle or equipment standards, requirements or procedures at the time of the initial application. Such conditional licensing shall be based on a finding by the Board that the applicant has, in fact,' been lawfully operating as an ambulance service prior to January 1, 1978. 8. After receipt of the application for a license to provide ambulance service, the Board shall review it and provide for the inspection of each ambulance and its equipment. 9. a. The current state motor vehicle inspection is hereby established as the requirement for each ambulance, incorporating thereby the provisions of Section 25 -3.5 -301 (2) (a), C.R.S. 1973. b. The latest edition of "Essential Equipment for Ambulances," published by the American College of Surgeons' Committee on Trauma, is hereby established as the standard for the ambulance equipment, incorporating thereby the provisions of Section 25- 3.5 -301 (2) (a), C.R.S. 1973. c. Possession of a valid Colorado driver's license and a current American Red Cross advanced first aid card are hereby established as the requirements for each ambulance driver, incorporating thereby the provisions of Section 25 -3.5 -202, C.R.S. 1973. d. Possession of an emergency medical technician's certificate, issued by the departrLent, is hereby established as the requirement for each attendant. e. These equipment features are hereby established as requirements for each ambulance: Sufficient space and capability for the per- formance of cardio- pulmonary resuscitation, airway maintenance, suctioning, hemorrhage control, shock care, dressing of wounds or burns, ix=bilization of fractures and oxygen therapy and suf- ficient coiling height for adequate gravity administration of IV fluids. f. Proof of liability insurance pursuant to Section 25 -3.5 -303, C_R.S. 1973, shall be required. 10. Upon a finding that the applicant, or, in the case of a license renewal, the licensee has complied with the staff, vehicle and equipment requirements established by the Board and has, in all other respects -3- fix $} cognlzahle.,to the Board, oomplied,with applicable,provisions of law, the Board shall issue•a license or,renew the license as the case may be. The Board shall, also, issue a permit for each ambulance, which shall be carried in the ambulance. The license, license renewal and permit shall be valid for twelve months following the date of issue. Applications for renewal shall be filed with the Board no later than sixty days before the date the license or permit expires. 11. The provisions of Section 25 -3.5 -304, C.R.S. 1973, are hereby incorporated in this Resolution to guide the Board in its license or permit suspension or revocation determination: a. Upon a determination by the Board that any person has violated or failed to comply with any provisions of Part 3 of the Colorado Emergency Medical Services Act, any other applicable provision of law or with any provision of this Resolution, the Board may suspend, for a period not to exceed thirty days, any license or permit issued pursuant to this Resolution. The licensee shall receive written notice of such temporary suspension and a hearing shall be held no later than ten days after such temporary suspension. After such hearing the Board may suspend any license or permit for any portion of or for the remainder of its term At the end of such period, the person whose license or permit was suspended may apply for a new license or permit, as in the case of an original application. b. Upon a second violation or failure to comply, the Board may permanently revoke such license or permit. 12. a. Each. licensee shall have a Colorado cext.1 ied urgency medical technician designated as the person in charge of tiainirg and inspection for the respective licensees. The name address and day and night telephone numbers for said designate shall be furnished to the County Ambulance Service Licensing Agent and be maintained with the County Licensing Agent on a current basis. b. Each licensee shall designate a Colorado licensed physician as advisor to the licensee and the licensee shall furnish to the County Licensing Agents the name, address and day and night telephone numbers of said physician/advisor and shall maintain said informa- tion on a current basis. c. There is created hereby the Eagle County Emergency Services (EMS) Advisory Board, to consist of the following members: A representative from each licensee pursuant to the Resolution, a representative of the Eagle County Ambulance Service Licensing Agents, a representative of the medical community within Eagle County (this may include either a Colorado licensed physician or medical personnel such as nurses, emergency medical technicians MIZ i or hospital administrators) and a representative of the general public who shall reside within °Eagle County, Colorado. Said Advisory Board shall be appointed by the Board of County CmTmissioners for a one year term. The purpose of said Advisory Board shall be to advise the Board of County Oamuissioners as to matters relating to this Resolution provided, however, that said Advisory Board shall have no jurisdiction in connection with the administration and enforcement of this Resolution and the Board of County Commissioners shall in no way be bound by any recamLandation of said Advisory Board. That the above and foregoing Resolution is the the public health, welfare and safety of the citizens of the County of Eagle, State of Colorado.
