HomeMy WebLinkAboutR1977-04 Amendment to Eagle County Zoning ResolutionRESOLUTION OF THE BOARD OF COUNTY C,SUSSIONERS COUNTY OF EAGLE, STATE OF COLORADO Amendment to Eagle County Zoning Resolution of 19 October 1974 as amended - GROUP HOME / WHEREAS, the Board of County Commissioners deems it necessary and for the public health, welfare, and safety of the citizens of Eagle County, and the State of Colorado, that an additional special use be added to the Eagle County Zoning Resolution to provide for Group Homes; and WHEREAS, pursuant to Section 4.07, of said Zoning Resolution, the Board of County Commissioners on its cyan initiative may, by resolution, add uses for a zoning district; and WHEREAS, the Board of County Commissioners has at several public meetings, reviewed the proposed additional use and has heard testimony in regard thereto; and 'WHEREAS, the Board of County Commissioners has determined that a use for Group Home conforms to the conditions setforth in Section 4.07 of said Zoning Resolution and the Board has made special findings thereof; �•ro Be It Resolved by the Board of County Commissioners of the County of Eagle, State of Colorado, THAT Section 2.02 of the Eagle County Zoning Resolution, 19. October 1974, as amended, is hereby further amended by the addition of the term GROUP HOME, said term to be defined as follows: "2.02.36A Group Home: A facility occupied by a sponsor, licensed by the County Department of Social Services, and a group of persons (not to exceed twelve (12) in number) for the purpose of providing housing, and specifically related facili- ties. In no event shall the total nuccber of persons (including sponsor and sponsor's family) occupying such facility exceed sixteen (16) persons. Group home may include homes for youth, elderly, and mentally or physically handicapped provided it shall also be licensed by the County Department of Social Services." THAT Section 3.01.04 (4) of said Zoning Resolution is further amended by the addition of sub - paragraph "(g)" to read: " (g) Group Home" THAT Section 3.02.04 of said Zoning Resolution is further amended by the addition of sub - paragraph "(17)" to read as follows: " (17) Group Hone" THAT Section 3.03.04 of said Zoning Resolution is further amended by the addition of sub - paragraph "(17)" to read as follows: " (17) Group Home" i THAT Section 3.04.04 of said Zoning Resolution is further amended by the addition of sub - paragraph "(7)" to read as follows: " (7) Group Home" THAT Section 3.05.04 of said Zoning Resolution is further amended by the addition of sub - paragraph "(8)" to read as follows: " (8) Group Home" THAT Section 6.00.02 of said Zoning Resolution is further amended by the addition of sub - paragraph "h ". to read as follows: h. Group Home shall comply with the following additional requirements: (1) Child care facilities shall comply with all requirements for licensing as either a Foster Care Home or Specialized Group Hom as such are defined by the Colorado Department of Social Services. (2) M group home shall be located with one (1) mile of any other group hone. (3) A report designating existing and potential negative impacts and mitigating measures for those impacts must be submitted by applicant and must be approved by the County Planning Commission, and further shall become a part of the Special Use Permit, if Permit shall be granted. (4) Site plans and interior building plans which shall indicate living spaces, recreation areas, off - street parking, and other special needs must be sub- mitted for approval by County and shall be incorporated as part of the Special Use Permit, if Permit shall be granted. (5) Group homes shall ordinarily be located within areas which have appropriate facilities, as deemed appropriate by county, to serve the needs of the occupants. " THAT the above and foregoing amendments to the Eagle County Zoning Resolution, 19 October 1974, as amended, are for the public health, welfare and safety of the citizens of the County of Eagle and State of Colorado; and THAT the above and foregoing amendments to said Zoning Resolution have been made in accordance with Section 4.07 of said Zoning Resolution; and THAT the Director of the Department of Planning and Development is hereby directed and ordered to publish the text of this Resolution and to make known the same to the general public in accordance with Section 4.07 of said Zoning Resolution.
