RESOLUTION
OF
THE BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
Beaver Creek Subdivision
WHEREAS on April 11, 1975, Vail Associates, Inc. (VAI),
Benchmark at Beaver Creek (Benchmark), and the Board of
County Commissioners of Eagle County (the Board) entered
into an Agreement under which Benchmark, among other things,
agreed to set aside certain lands for a school site and for a
park, site, and VAI agreed to pay certain costs of constructing
recreational amenities on said park site; and
WHEREAS the Board agreed that the undertakings of Benchmark
and VAI in said Agreement satisfied any further obligations of
Benchmark and VAI to provide land and facilities for schools,
recreational amenities or any other public purposes or to provide
funds in lieu thereof in connection with the Benchmark at Beaver
Creek Subdivision of Benchmark and the Beaver Creek Subdivision
of VAI; and
WHEREAS Benchmark, VAI and Grouse Mountain at Vail, Ltd.
have previously agreed with the Board and other governmental
agencies that their respective Subdivisions will not exceed
certain specified densities and that they will cooperate in
making certain "employee housing" available; and
WHEREAS inhabitants of the Benchmark Subdivision now desire
that such Subdivision be included in a municipal corporation to
be known as the Town of Avon, Colorado, and have been held by the
Board under its statutory power to deny that an election be held
with respect to the formation of the Town of Avon; and
WHEREAS Benchmark has confirmed to the Board its willingness
(a) to limit densities, and has executed and delivered to the Board
for recording, a protective covenant intended to limit density in the Benchmark
Subdivision to previously agreed levels., and (b) its. willingness, to continue to
cooperate with all parties concerned to provide "euployee housinq" at the Benchmark
Subdivision in the spirit of the Environmental Analysis Report of the Beaver Creek
Winter Sports Site; and
WHEPEAS if the Town of Avon is forced, the Board will no longer control
densities or land uses within the Benchmark at Beaver Creek Subdivision; and
WHEREAS the Board desires (a) to permit the election regarding
the Town of Avon to be held, and (b) to confirm to VAI that VAI
shall not be required (x) to provide land and facilities for schools,
parks or any other public purpose or to provide
funds in lieu thereof or in addition thereto in connection with
VAI's Beaver Creek Subdivision except as previously agreed, or
(y) to limit densities in the Beaver Creek Subdivision below the
level heretofore agreed to by VAI, or (z) to provide more than
600 units of "employee housing" at the Beaver Creek Subdivision,
whether or not Benchmark,or Grouse Mountain at Vail, Ltd. perform
their obligations in the aforementioned Agreement or with respect
to the aforementioned limitations on density and the afore
expressed willingness regarding "employee housing ", if any;
NOW THEREFORE BE IT RESOLVED that the Board hereby stipulates
and agrees that VAI shall not in connection with its Beaver Creek
Subdivision be required (a) to provide land and facilities for
schools, parks or any other public purpose or
to provide funds in lieu thereof or in addition thereto, except
as previously agreed to by VAI in the contract of April 11, 1975,
referred to hereinabove, or (b) to limit densities in such Sub-
division to below the amount heretofore agreed to by VAI, or
(c) to provide more than 600 units of "employee housina."
Provided, this Resolution shall in no way affect
any right, duties or powers, the Board has or may have, with
respect to the planning and /or zoning of the B�.,ei Cree„ Sub-
division.
FURTHER resolved that this Resolution is for the public
health, welfare and safety of the County of Eagle, State of
Colorado.
MOVED, READ AND UNANIMOUSLY ADOPTED at a special meeting of
the Board of County Commissioners, County of Eagle, State of
Colorado, held on February 22, 1978.
