COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION No. 82-9, 3
ZONE DISTRICT AMENDMENT - Clymer's Ranch 8. Livestock, Inc.
File No. - ZC- 161 -82
WHEREAS, Dudley M. Clymer, did file an application with
Eagle County Department of Community Development on or about
February 11, 1982, to rezone the herein described property
in Eagle County from Residential Suburban Low Density Zone
District to Commercial Limited Zone District; and
WHEREAS, based on the evidence, testimony, exhibits,
study of the Master Plan for the unincorporated areas of
Eagle County, comments of the Eagle County Department of
Community Development, comments of public officials and
agencies, the recommendation of the Eagle County Planning
Commission, and comments from all interested parties, this
Board of County Commissioners of the County of Eagle, State
of Colorado, finds as follows:
1': That proper publication and public notice was pro-
vided as required by law for the hearing before the Planning
Commission and the Board of County Commissioners.
2. That the proposed zoning is consistent with the
Master Plan.
3. That the area in question possesses the geological,
physical and other environmental conditions compatible with
the characteristics of the use requested.
4. That the advantages of the use requested outweigh
the disadvantages.
5. That the area for which the rezoning is requested
has changed or is changing to such a degree that it is in the
public interest to encourage a new use or denisty in the
MWIRim
6. That the proposed rezoning is necessary in order to
provide land for a demonstrated community need.
7. That for the above stated reasons, the proposed
zoning is in the best interest of the health, safety, con-
venience, order prosperity and welfare of the citizens of
Eagle County, Colorado.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of the County of Eagle, State of Colorado:
THAT the petition of Clymer's Ranch & Livestock, Inc.,
file number ZC- 161 -82, for a zoning amendment to change from
Residential Suburban Low Density Zone District to Commercial
Limited Zone District be and is hereby approved for the
following described property located in the unincorporated
area of Eagle County:
A tract of land situated in the NW4'SE4 of Section 5,
Township 5 South, Range 82 West of the Sixth Principal
Meridian lying Southerly of the Northerly boundary of
said NW4SE4 and Northerly of the Northerly right -of -way
boundary of U.S. Highway No. 6 and 24 described as follows:
Beginning at a point 'on the Northerly boundary of said
NW4SE4 whence the Southeast corner of said Section 5
bears 5.37 018'20 "E. 3336.25 feet (as established by
William H. Lee on November 17, 1948); thence S.01 °16'00 "IV.
181.00 feet to a point on the Northerly right -of -way
boundary of said Highway; thence along the arc of a curve
to the left having a radius of 2915.00 feet, the chord
of which bears N.73 058'10 "W. 563.40 feet to a State
Highway marker being a concrete post with brass cap
found in place and properly marked; thence N.77 001'00 "W.
98.00 feet along the Northerly right -of -way boundary of
said Highway to a point on the Northerly boundary of said
NW4SE4; thence N.89 °42'00 "E. 641.00 feet along the Northerly

boundary of said NWJ4SE4 to the point of beginning. The
above described tract of land contains 1.095 acres, more
or less. EXCEPTING, HOWEVER, that certain ditch from
the Old Bert Hyde Ranch and entering the above triangle
near the Northwest corner thereof and running due East
parallel to the Northern boundary of said tract to the
East boundary thereof, and the right of ingress and
egress to clean and repair said ditch.
THAT the Board of County Commissioners directs the
Director of the Department of Community Development to enter
this amendment on the appropriate page of the page of the
Official District Map and record the change in the office of
the Eagle County Clerk and Recorder.
MOVED, READ, AND ADOPTED by the Board of County
Commissioners of the County of Eagle, State of Colorado, at
its meeting held the 12th day of October, 1982, nunc, pro
tune to 14th day of June, 1982.
