HomeMy WebLinkAboutR82-092 zone district amendment Floyd Crawford 166-82i RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS 1 l �J COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION No. 82- q"7 ZONE DISTRICT AMENDMENT - Floyd Crawford , File No. - ZC- 166 -82 WHEREAS, Floyd Crawford did file an application with the Eagle County Department of Community Development on or about May 1, 1982, to rezone the herein described property in Eagle County from Residential Suburban Medium Density Zone District Commercial General District; and WHEREAS, a public hearing was held by the Board of County Commissioners of the County of Eagle, State of Colorado, on September 29, 1982; and WHEREAS, based on the evidence, testimony, exhibits, study of the Master Plan for the unincorporated areas of Eagle County, comments of public officials and agencies, the re- commendation of the Eagle County Planning Commission, and comments from all interested parties, this Board of County Commissioners of the County of Eagle, State of Colorado, finds as follows: 1. That proper publication and public notice was pro- vided as required by law for the hearing before the Planning Commission and the Board of County Commissioners. 2. That the proposed zoning is consistent with the Master Plan. 3. That the area in question possesses the geological, physical and other environmental health conditions compatible with the characteristics of the use requested. 4. That the advantages of the use requested outweigh the disadvantages. 1 �1 5. That the area for which the rezoning is requested has changed or is changing to such a degree that it is in the public interest to encourage a new use or density in the area. 6. That for the above stated reasons, the proposed zoning is in the best interest of the health, safety, con- venience, order, prosperity and welfare of the citizens of Eagle County, Colorado. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of the County of Eagle, State of Colorado: THAT the petition of Floyd Crawford, file number ZC- 166 -82, for a zoning amendment to change from Residential Suburban Medium Density Zone District to Commercial General Zone District be and hereby approved for the following described property located in the unincorporated area of Eagle County: A parcel of land located in Lot 15, Section 34, Township 7 South, Range 87 West of the Sixth Principal Meridian, all in Eagle County, Colorado; said parcel being more particularly described as follows: Beginning at a point on the Northerly Right -of -Way Line of State Highway No. 82, from which the Southwest Corner of said Section 34 bears N.83 059'44 "t.i. 3607.10 feet distant; thence approximately 379.57 feet along said Northerly Right -of -Way Line and along the arc of a curve to the left with a radius of 5770.00 feet, the chord of which bears N. 64 °48112"W. 379.50 feet; thence N.00 015130 "E. 553.32 feet; thence N.90 °00'00 "E. 906.30 feet; thence S.04032152 "W. 224.86 feet; thence N.87 °34'11 "W. 527.99 feet; thence 5.02 °14'19 "W. 513.50 feet to the point of beginning. Said parcel contains 7.80 acres, more or less. THAT the Board of County Commissioners directs the Director of the Department of Community Development to enter this amendment on the appropriate page of the Official District Map and record the change in the office of the Eagle County Clerk and Recorder.
