RESOLUTION NO. 82- 2G s
DENIAL OF ZONE CHANGE AMENDMENT - COMMERCIAL GENERAL + 4.1 ACRES

WHEREAS, The Basalt Trade Associates did file a petition
with the Eagle County Department of Community Development on
or about June 1, 1982, to rezone the herein described property
in Eagle County from Resource Zone District to Industrial
and Commercial General Zone Districts: and
WHEREAS, a public hearing was held by the Board of
County Commissioners of the County of Eagle, State of Colorado,
on September 13, 1982; and
WHEREAS, based on the evidence, testimony, exhibits,
study of the Master Plan for the unincorporated areas of Eagle
County, comments of the Eagle County Department of Community
Development, comments of public officials and agencies, the
recommendation of the Eagle County Planning Commission, and
comments from all interested parties, the Board of County
Commissioners of the County of Eagle, State of Colorado, finds
as follows:
1. That proper publication and public notice was
provided as required by law for the hearing before the
Planning Commission and the Board of County Commissioners.
2. That the proposed zoning is not in compliance with
the recommendations set forth in the Master Plan for the
unincorporated area of the County. This zoning would tend to
create a new town center where one is not identified.
3. That the disadvantages of the use requested
outweighs the advantages.

4. That changing conditions clearly do not require
an amendment to the Zone District designation presently placed
on the subject property.
5. That the proposed rezoning is not necessary in order
to provide land for a demonstrated community need.
6. That for the above - stated and other reasons, the
proposed zoning is not in the best interest of the health,
safety, convenience, order, prosperity and welfare of the
citizens of Eagle County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of the County of Eagle, State of Colorado:
That the petition of Basalt Trade Associates, File Number
ZC- 169 -82, for a zoning amendment to change from Resource
Zone District to Commercial General Zone District be and is
hereby denied relative to the following described property
located in the unincorporated territory of Eagle County:
ZONING LEGAL II
COMMERCIAL GENERAL
A parcel of land located in Tract 52 of Section 11,
Township 8 South, Range 87 [Nest of the Sixth Principal Meridian,
County of Eagle, State of Colorado according to the Independent
Resurvey of said Township and Range as approved by the U. S.
Surveyor General in Denver, Colorado on August 25, 1927; said
parcel being more particularly described as follows, to wit:
Beginning at a point on the approximate Southerly Line
of a parcel of land as described in Book 246 at Page 424 of
the Eagle County Records from which an existing brass cap
monument properly marking a Witness Corner to Corner No. 3 of
Tract 52 bears S. 78° 00152 11W. 2287.61 feet distant; thence
along said Southerly Line 5.840 24101 "E. 84.24 feet; thence
along the approximate Westerly Line of a parcel of land as
described in Book 225 at Page 632 of the Eagle County Records

the following three (3) courses and distances:
1) S.04° 52'02 "E. 135.07 feet
2) S.060 20'54 "E. 212.35 feet
3) S.09° 39'05 "E. 250.45 feet
to a point on the approximate Northerly Right -of -Way Boundary
Line of Eagle County Road S -3C; thence along said Northerly
Line the following two (2) courses and distances:

1) N.46 13'29 "W, 34.49 feet
2) 484.10 feet along the arc of a curve to the
left with a radius of 646.35 feet, the chord
of which bears N.67° 40152 "W. 472.86 feet
thence departing said Northerly Line N.00° 51'45 "E. 358.08
feet; thence N.82° 26'45 "E. 298.77 feet to the point of beginning.
Said parcel contains 4.1195 acres, more or less.
MOVED, READ, AND ADOPTED by the Board of County Commissioners
of the County of Eagle, State of Colorado, at its meeting this
29 th day of September, 1982, nunc pro tune to 15 th day of
September, 1982.
