OF THE
BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION No. 82- %9
IN RE THE MATTER OF THE AMENDMENT AND READOPTION OF THE
BUILDING RESOLUTION OF THE COUNTY OF EAGLE, STATE OF
COLORADO, 1973, AS AMENDED, AND THE ADOPTION BY REFERENCE OF
THE UNIFORM BUILDING CODE OF THE INTERNATIONAL CONFERENCE OF
BUILDING OFFICIALS, 1982 EDITION, WITH APPENDICES.
WHEREAS, Section 30 -28 -201 et seq., C.R.S. 1973, as
amended, provides that the Board of County Commissioners,
County of Eagle, State of Colorado, hereinafter referred to
as the "Board ", may adopt codes and /or resolutions'regulating
the construction or alteration of dwellings, buildings, and
structures, together with plumbing and electrical instal-
lations therein or in connection therewith; and
WHEREAS, pursuant to Section 30 -28 -204, C.R.S. 1973, as
amended, the Board from time to time by resolution may alter
and amend any county building code after public hearing,
notice of which hearing shall be given by publication once
weekly for four consecutive weeks in a newspaper of general
circulation in the county. In no case shall the area covered
by the building code be extended or changed unless the same
has been proposed by or is first submitted for the approval,
disapproval, or suggestions of the county planning commis-
sion. Unless the county planning commission acts within
thirty days, approval shall be assumed. The opinion of the
county planning commission shall be advisory only and not
binding upon the Board; and

WHEREAS, on September 1, 1982, the Eagle County
Planning Commission did consider amendments to the Building
Resolution of the County of Eagle, Colorado, 1973, as
amended, as set forth in Exhibit "A ", attached hereto and
incorporated herein by this reference; and
WHEREAS, on September 13, 1982, a public hearing was
held before the Board to consider the adoption of the
amendments set forth in Exhibit "A"; and
WHEREAS, notice stating the time and place of the
public hearing was duly given by publication once weekly for
four consecutive weeks in the Eagle Valley Enterprise on
August 12, 1982, August 19, 1982, August 26, 1982, and
September 2,. 1982, respectively; and
WHEREAS, the Board hereby determines that this
Resolution is necessary and proper for the protection of the
public health, safety, welfare, morals, and best interests of
the citizens of Eagle County.
NOW, THEREFORE, be it resolved by the Board of County
Commissioners, County of Eagle, State of Colorado:
THAT, the Building Resolution of the County of Eagle,
State of Colorado, 1973, as amended, is hereby amended as set
forth in Exhibit "A ".
THAT, the entirety of the Building Resolution of the
County of Eagle, State of Colorado, 1973, as amended, and as
herein amended, is hereby readopted.
THAT, this amendment and readoption of the Building
Resolution of the County of Eagle, State of Colorado, 1973,
as amended, shall not constitute or be construed as a waiver
of any violations existing at the time of adoption of this
Resolution.

THAT, no person shall commence or continue any work in
respect to any building, structure, or mobile home, or any
sewage disposal system in violation of the provisions of this
Resolution. Any such violation shall be deemed a nuisance.
THAT, any person who violates the provisions of this
Resolution is liable upon conviction to a fine of not more
than one hundred dollars, or by imprisonment in the county
jail for not more than ten days, or by both such fine and
imprisonment. Each day during which such illegal erection,
construction, reconstruction, alteration, maintenance, or use
continues shall be deemed a separate offense.
In case any building or structure is or is proposed to
be erected, constructed, reconstructed, altered, remodeled,
used, or maintained in violation of the provisions of this
Resolution, the Board, the district attorney of.'the district,
or any owner of real estate within the area, in addition to
other remedies provided by law, may institute an appropriate
action for injunction, mandamus or abatement to prevent,
enjoin, abate, or remove such unlawful erection,
construction, reconstruction, alteration, remodeling,
maintenance or use.
THAT, should any section, clause, provision, sentence
or word of this Resolution, including the attached exhibit,
be declared by a court of the competent jurisdiction to be
invalid, such decision shall not affect the validity of this
Resolution as a whole, or any parts thereof, other than the
part so declared to be invalid. For this purpose, this
Resolution is declared to be severable.
THAT, this Resolution is necessary for the health,
welfare and safety of the citizens of Eagle County.
THAT, the provisions of this Resolution shall be deemed

in full force and effect upon execution of this Resolution by
the Board.
MOVED, READ AND UNANIMOUSLY ADOPTED by the Board of
County Commissioners, County of Eagle, State of Colorado, at
its regular meeting held the day of September, 1982.

EXHIBIT "A"
TO RESOLUTION NO. 82-
(AMENDMENT TO THE BUILDING RESOLUTION OF THE COUNTY OF
EAGLE, STATE OF COLORADO, 1973, AS AMENDED)
I. Section 2 entitled "Application," Subsection (1),
is hereby amended to read as follows:
"(1) The Uniform Building Code of the Inter -
National Conference of Building Officials, 1982
Edition, with Appendices; the Uniform Mechanical
Code of the International Conference of Building
Officials, 1982 Edition, with Appendices; the
National Electrical Code of the National Fire
Protection Association, 1981 Edition, with ,
Appendices; the Uniform Plumbing Code of the
International Association of Plumbing and Mechanical
Officials, 1982 Edition; and the State of Colorado
Energy Conservation Standards, 1979 , and any and
all amendments to said codes and /or standards as
of the date of execution of this Resolution, are
hereby adopted by this reference and incorporated
herein as if set forth in full herein; and shall
apply to all dwellings, buildings and structures
located in--the area of the County of Eagle outside
of incorporated towns, hereinafter referred to as
the "regulated area," unless otherwise provided.
Said codes and /or standards set forth in this
subsection (1) shall be available from the Building
Official, Department of Community Development,
County of Eagle, McDonald Building, 550 Broadway,
Eagle, Colorado 81631."

II. The introductory sentence and subsection (4)
of Section 5 entitled "Definitions," are hereby
amended to read as follows:
"For the purpose of this Resolution all
words, terms and expressions contained herein
shall be interpreted in accordance with the
definitions set out in the 1982 Code, except
that:"
"(4) 1982 CODE shall mean the Uniform Building
Code of the International Conference of Building
Officials, 1982 Edition, with Appendices; Uniform
Mechanical Code of the International Conference
of Building Officials, 1982 Edition with Appendices;
Uniform Plumbing Code of the International
Association of Plumbing and Mechanical Officials,
1982 Edition; National Electrical Code of the
National Fire Protection Association, 1981 Edition,
with Appendices; the State of Colorado Energy
Conservation Standards, 1979, and all amendments
to said Codes and /or Standards as of the date of
execution of this Resolution and as set forth in
Section 6 of this Resolution."
III. Section 6, now entitled "Amendments to the 1982
,Code," is hereby amended to read as follows:
i "(1) Where the requirements or conditions
imposed by a provision of this Resolution differ
from the requirements or conditions imposed by
the 1982 Code, the provision of this Resolution
shall govern.
(2) Without restricting the generality of
the foregoing, the 1982 Code is amended as follows:

(a) Amendment of Section 303 (a)
entitled "Issuance," to add the following
paragraph thereto:
'A building permit will not be issued
in the Eagle County jurisdiction until
all construction drawings, applications,
and permit fees are submitted and
approved, including those for plumbing,
electrical, and mechanical portions of
the project. Notwithstanding the fore-
going, a footing and foundation permit
may be awarded prior to reception of other
permit information if adequate structural
and site plan information is provided.'
(b) Amendment of Section 303 (d)
entitled "Expiration," to add the following
paragraph thereto:
' Permittee must show evidence of con-
struction progress on the permitted
project every 180 days by requesting
a progress inspection if none other has
been requested in that period.'
(c) Amendment of Section 307 (c)

entitled "Inspection Record Card," to add
a? the following sentence thereto:
'Inspection Record Cards shall be posted
as described in Table #8 attached hereto
and incorporated herein by this
reference.'
(d) Amendment of Section 306 (a) (12.b)
entitled "Special Inspector," to add the
following sentence thereto:

'Special inspectors shall be utilized
for special projects, plan checking,
and /or inspections on unique, complex,
or hazardous projects.'
(e) Amendment of Section 307 (d) entitled
"Temporary Certificate," to add the following
paragraph thereto:
'A Temporary Certificate of Occupancy may
be awarded only if the following components
of a project are complete.
(a) Kitchen complete and operative.
(b) One bathroom complete and operative.
(c) All smoke detectors operative.
(d) All handrails and other safety
devices in place and operative.
(e) The County right -of -way is graded
with driveway and culvert (where
necessary) in place and constructed
to plans and /or County specifica-
tions.
(g) The exterior of the building shall
be complete with house numbers in
plain sight and the parking area
defined as per plans and ready for
use.'
(f) Amendment of Section 503 (d)
entitled "Fire Ratings for Occupancy Separa-
tions," to add the following paragraph thereto:
6. A one hour fire resistive wall shall
be required for separation of
dwelling units in the duplex houses
and in single family residences
having major and minor units within.

Interior doors connecting units
shall be solid core 1 3 /8" wood
doors or the equivalent and shall
be fitted with a self closing
tier
mechanism.'
(g) Amendment of Section 1706 entitled
"Shaft Enclosures," to add the following
subsection (e) thereto:
'Factory built metal chimneys shall
be enclosed with materials suitable
for construction of a one hour fire
resistive wall. Firestops can be
omitted in chases which are protected
t..
on all sides. Eagle County Requirements
t f for enclosure of metal chimneys shall
be as set forth in Table 6 attached
hereto in the Appendices and incorporated
herein by this reference, and any other
proven method as authorized by the Chief
Building Official.'
(h) Amendment of Section 1707 (d)
entitled "Daimpproofing Foundation Walls,"
to add the following sentence thereto:
'In those locations where the foundation
is subjected to a high water table, or
where surface or ground water drainage
will present a problem, additional
precautions may be required.'
(i) Amendment of Section 2305 (d)
entitled "Snow Loads," to read as follows:
'Snow load requirements for Eagle
County shall be as set forth in Table 2

entitled "Eagle County Snow Load
Requirements," attached hereto in
the Appendices and incorporated
herein by this reference.'
(j) Amendment of Section 2905 (f)
entitled "Drainage," to add the following
paragraphs thereto:
'Foundation Drains. Foundation or
footing drains connected to a positive
outfall shall be provided around foun-
dations and footings. Perforated tile
shall be installed below the area to
be protected. Clay or concrete drain
the shall comply with ASTM C -4 or
ASTM C -412, or tile may be asbestos
cement or bituminized fiber pipe.
Drain tile shall be installed having
a minimum slope to outfall of one -half
(2) percent (approximately one (1)
inch in twenty (20) feet). Tops of
joints in drain tile shall be covered
with six (6) to eight (8) inches of
coarse gravel or crushed rock.
Foundation drains may be omitted at
the discretion of the Buiding Official
where well- drained soil exists or where
ground or surface water will not
present a problem.'
(k) Amendment of Section 2907 (a)
entitled "General," to add the following
sentence thereto:

'All heated spaces within a building
shall have foundation frost walls
having a depth of at least 48"
measured from the bottom of the footer
to the backfill gradeline unless
otherwise designed by a structural
engineer for a specific location.'
(1) Amendment of Section 3806 (a)
entitled "General," to add the following
sentence thereto:
'All buildings under construction in a
designated Fire District will be
required to have fire protection facili-
ties available to the site to the satis-
faction of the Fire Chief.'
(m) Amendment of Section 7015 (a)
entitled "Fund Reports," to add a new subsection
(4) to read as follows:
'Where culverts are required, they are
to be in place and ready for inspection
at the time of the Temporary Certificate
of Occupancy inspection when scheduled.
It will be the general contractor's
( responsibility to maintain positive
ti:,wu t'
drainage on the site during all phases
of construction, including protection of
any drainage along County right -of -ways
and not increasing flows leading from
the subject property onto any neighboring
properties.'"
IV. Section 8 entitled "Prohibitions," Subsection 7,
is hereby deleted.
V. Section 9 entitled "Permits and Fees," Subsection 1,
is hereby amended to read as follows:

"(1) The Building Department shall issue a permit
where:
(a) an application for a permit has been made

in accordance with the provisions of this
Section;
(b) the proposed work set out in the application
conforms to this Resolution and all other
laws, regulations, resolutions, or orders
having application in Eagle County; and
(c) all construction drawings, applications,
and permit fees have been submitted and
approved, including those for plumbing,
electrical, and mechanical portions of the
project. A footing and foundation permit
may be awarded prior to reception of other
permit information if adequate structural
and site plan information is provided."
VI. Section 9 entitled "Permits and Fees," subsection.
3 (a), is hereby amended to read as follows:
(3) (a) The schedule of fees to be charged for
the issuance of a permit under this
Resolution shall be as set forth in
Tables 3, 4, 5, and 6, as included in
the Appendices.
Table 3 entitled "Building Permit
Fees, Eagle County, Colorado" (from
Schedule 3A - Uniform Building Code,
1982 Edition) is attached hereto and
incorporated herein by this reference.
Table 4 entitled "Mechanical Permit
Fees, Eagle County, Colorado," (from
Section 304, Uniform Mechanical Code,

incorporated herein by this reference.
Table 5 entitled "Plumbing Permit
Fees, Eagle County, Colorado," (from
Schedule 3C - Uniform Plumbing Code,
1982 Edition) is attached hereto and
incorporated herein by this reference.
Additional permit fees shall be charged as
follows:
For moving or demolishing any
building or structure ....................$15.00
For placement and use of a mobile
home as a living unit elsewhere
than in an approved mobile home

VII. Section 9 entitled "Permits and Fees," subsection
(4) is hereby amended to read as follows:
(4) Every permit is issued upon the condition
that:
(a) construction is to be started within
six (6) months from the date of issuance
of the permit;
(b) construction is not to be discontinued
or suspended for a period of more than
six (6) months; and
(c) the exterior of any building shall be
finished in durable, weather resistant
materials prior to employment of.par-
ticular use for which the building is
intended."
VIII. Section 9 entitled "Permits and Fees," subsection
(5) is hereby amended to read as follows:
(5) An application for a permit shall:
(a) be made on the form prescribed by the
Building Department;
(b) be signed by the applicant;
(c) be accompanied by the fee prescribed
for work to be undertaken;
(d) state the intended use of the building
structure;
(e) include copies in duplicate of a plot
plan and scale drawings and specifica-
tions of the work to be carried out
as required by Section 301 of the
1982 Code."

The snow load formula used to calculate roof load re-
guirements is taken from a manual entitled, "Snow Load De-
sign Data for Colorado ", March 1978, written by The Struc-
tural Engineers Association of Colorado.
The following formula should be used to calculate the
load requirements in lbs. per sq. ft.
Snow Load =K +12 (A-
2)
Where K =4 for every location in Eagle County with the
exception of the area from Redcliff south to
Tennessee Pass along Highway 24. For this
limited area K =6.

Simplifying the above formula for application in the
majority of the County where K =4, results in the following:

The preceding Table represents Snow Load Requirements
obtained by the application of the above formula for vari-
ous locations within the County. If you have a site not
listed in this Table, you can determine the load require-
ment by the application of the formula by using the appro-
priate elevation and "K" factor. Assistance can be ob-
tained from the Building Department if necessary.
