HomeMy WebLinkAboutR82-077 Special Use Permit Rocky Mountain Natural GasRESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION No. 82- 77 - APPROVAL OF SPECIAL USE PERMIT - ROCKY MOUNTAIN NATURAL GAS FILE No. ZS- 159 -82 WHEREAS, ROCKY MOUNTAIN NATURAL GAS did file an application with the Eagle County Department of Community Development on or about July 1, 1982, within the Resource, Rural Residential, Residential Suburban Low, Residential Suburban Medium, and Planned Unit Development, Zone Districts; and WHEREAS, a public hearing was held by the Board of County Commissioners of the County of Eagle, State of Colorado, on August 25, 1982; and N=REAS, based on the evidence, testimony, exhibits, study of the Master Plan for the unincorporated areas of Eagle County, comments of the Eagle County Department of Community Development, comments of public officials and agencies, the recommendation of the Eagle County Planning Commission, and comments from all interested parties, the Board of County Commissioners of the County-of Eagle, State of Colorado, finds as follows: 1. That proper publication and public notice was pro- vided as required by law for the hearing before the Planning Commission and the Board of County Commissioners. 2. That the proposed special use conforms to the re- quirements of Section 2.09 of the Eagle County Land Use Regulations. 3. That the proposed land use will be compatible with existing uses in the area. 4. That for the above - stated and other reasons, the pro- posed zoning is in the best interest of the health, safety, t morals, convenience, order, prosperity and welfare of the citizens of Eagle County. NOSY, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners of the County of Eagle, State of Colorado: That the application of ROCKY MOUNTAIN NATURAL GAS, File No. ZS- 159 -82, for approval of a special use to con- struct a natural gas transmission line within the Resource, Rural Residential Residential Suburban Low, Residential Suburban Medium, and Planned Unit Development Zone Districts in the following described unincorporated area of Eagle County be approved: ROCKY 21f0UNTAIN NATURAL GAS COMPANY, INC. EDTARDS EXTENSION "LEGAL DESCRIPTION OF THE CORRIDOR" The Edwards Extension 35 foot wide pipeline right -of- way begins at a tie -in point on Rocky Mountain's ex- isting 32" high pressure transmission pipeline on the U.S. Highway right -of -way in the NE SE4, Section 6, TSS, R84W, West of Eagle, Colorado. TSS, R841Y The extension then proceeds in a southeasterly direction across the SWJ4 & Ski SEq, Section 5, TSS, R84W: thence southeasterly through the NE4, Section 8; thence southeasterly through the SW Ni94, SF ?3 & SV9 SE-.1, Section 9; thence southeasterly through the NE4, Section 16; thence southeasterly through the NW-,', Sj; NE-41 & the SE4, Section 15; thence easterly through the Sz S2, Section 14; thence east through the S2 SW: , Section 13, Crossing Brush Creek Road.rP -307, Brush Creek and within Rd. � -SA; thence south through the East2 N174, and northeasterly through the NE4, Section 24, using County Rd_ #S -8A and Trail Gulch Road; thence northeasterly through Section 13 using Trail Gulch Road; TSS, R83jY thence northeasterly through.the SWI.. Total length of extension is estimated to be 16 miles, all of which is. located in Eagle County, Colorado. That the following conditions shall be placed upon this approval and that violation of any condition shall be the, basis for revocation of the permit: 1. The permit will be reviewed by the County in May, 1983, to determine if the line has been constructed as proposed. 2. Applicant will submit to the County such drawings as required by the County Engineer. 3. Applicant must obtain the necessary road cut permits from the County. 4. THAT the Board of County Commissioners directs the Department of Community Development to provide a copy of this resolution to the applicant. MOVED, READ, AND ADOPTED by the Board of County Commissioners of the County of Eagle, State of Colorado, at its meeting held the 13th day of September, 1982, nunc pro tune to the 25th of August, 1952.
