HomeMy WebLinkAboutR82-047 Mobile Home Park License for Eagle River Mobile Home ParkF RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION No. 82- RESOLUTION - GRANTING MOBILE HOME PARK LICENSE FOR EAGLE RIVER MOBILE HOME PARK WHEREAS, Section 2.08 of the Eagle County Land Use Regulations requires all mobile home parks to obtain an operating license; and WHEREAS, the operators of the above -named mobile home park have applied for a license; and WHEREAS, the Board of County Commissioners of Eagle County have determined the above -named mobile home park contains conditions of non - compliance with the Mobile Home Park Regulations of Section 2.08 of the Eagle County Land Use Regulations, to -wit: A. The mobile home lots within the park does not conform to County requirements as to lot size and /or setback regulations. B. The mobile home park does not conform to County regulations as to required landscaping. C. Additions or other structures are present on the mobile home lots which do not meet required setback requirements. AND, WHEREAS, the Board of County Commissioners has determined to prevent extreme hardship upon the park owner not of his own making, to allow certain variances from the � wr. regulations for the licensing period. IT IS HEREBY RESOLVED THAT A MOBILE HOME PARK LICENSE BE ISSUED FOR THE PERIOD ENDING MAY 30, 1983, FOR EAGLE RIVER MOBILE HOME PARK SUBJECT TO THE FOLLOWING CONDITIONS: 1. That prior to May 30, 1983, the licensee shall provide to Eagle County a site plan including each mobile home, mobile home lot, any building, and any non - conforming structures or additions. 2. A variance is permitted for any non- conforming additions or structures now existing but at the time of removal of any mobile home now present, any non - conforming structure or addition on the same lot shall also be removed. 3. A variance is granted as to the non - conforming lot size and setbacks, however no mobile home on a non - conforming lot shall be replaced with one of any greater surface coverage than that of the mobile home now existing on the lot. 4. That prior to May 30, 1983, the licensee shall present to Eagle County an acceptable landscaping plan to be completed within five years and providing a schedule of the implementation for "j the plan. 5. By July 12, 1982, a plan for adequate fire protection must be submitted. This plan should be commensurate with the water supply problem, and should describe an implementation schedule. 6. Within 90 days, by September 30, 1982, the repair of the damaged asphalt must be complete or a plan must be submitted for the asphalt to be complete, in any case, by May 30, 1983. 2 7. By September 30, 1982, a plan for adequate water supply must be submitted, and the plan must be implemented by May 30, 1983. 8. By September 30, 1982, a drainage plan to provide adequate drainage must be submitted, and the plan must be implemented by May 30, 1983. 9. The contractor's yard must be removed, as stipulated in the letter of June 29, 1982, signed by John Phillips, within 2 weeks. FAILURE TO COMPLY WITH THE ABOVE CONDITIONS WILL BE THE BASIS FOR SUSPENSION OR REVOCATION OF THE LICENSE. MOVED, READ, AND UNANIMOUSLY adopted by the Board of County Commissioners, County of Eagle, State of Colorado, at its regular meeting held the 28th day of July, 1982, nunc pro tunc to June 30, 1982.
