HomeMy WebLinkAboutR82-110 1982 mill levy for CMCRESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 82410 IN RE THE MATTER OF THE 1982 MILL LEVY FOR COLORADO MOUNTAIN COLLEGE. WHEREAS, the Board of County Commissioners of the County of Eagle, State of Colorado, hereinafter referred to as the "Board," is a political subdivision of the State of Colorado, which is authorized to act pursuant to the Constitution and Laws of the State of Colorado; and WHEREAS, Colorado Mountain College, hereinafter referred to as "CMC," is a taring authority created pursuant to the Statutes of the State of Colorado; and WHEREAS, pursuant to Article I of Title 39 of the Colorado Revised Statutes, 1973, as amended, the sole responsibility and right of the Board in reviewing the mill levy assessed by the Colorado Mountain College is to certify that levy to the Eagle County Assessor and, except for procedural matters, the Board does not have the authority to review or challenge a mill levy set by another taxing entity; and WHEREAS, the assessed value of property within that portion of the CMC taxing authority located in Eagle County for 1981, in regards to taxes due and payable in 1982, was One Hundred Seventy -Seven Million Eight Hundred Fifty -One Thousand Five Hundred Seventy Dollars and No /Cents ($177,851,570.00), and the assessed value of the aforesaid property in 1982, for tax year 1983, was Two Hundred Eleven Million One Hundred Forty -Seven Thousand Two Hundred Forty Dollars and No /Cents ($211,147,240.00), which constitutes an increase in such assessed value of approximately nineteen percent (19 %); and WHEREAS, the CMC mill levy for the year 1981 was 5.637 mills, and for the year 1982 will be 6.420 mills, as a result of the Department of Local Affairs' approval for Colorado Mountain College to exceed the 107% limitation, which is contained in Section 29 -1 -302, C.R.S. 1973, as amended, so that the CMC mill levy will generate Three Hundred Fifty -Three Thousand Fifteen Dollars and 98 Cents ($353,015.98) more money in 1982 than 1981, which is a 35.21 increase; and WHEREAS, for example, a taxpayer with property of a 1983 market value of One Hundred Thousand Dollars and No /Cents ($100,000.00) or an assessed value of Twelve Thousand Dollars and No /Cents ($12,000.00), utilizing a 1973 base year level of value, will pay the sum of Seventy -Seven Dollars and 4 Cents ($77.04) to CMC as the result of the above mill levy, of which amount Seven Dollars and 50 Cents ($7.50) is attributable to the decision of the Department of Local Affairs; and WHEREAS, between 1981 and 1982, the mill levy for Eagle County has not shown the same increase, and over a five year period, the increase in the CMC mill levy has greatly exceeded the percentage increase for Eagle County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of the County of Eagle, State of Colorado: THAT, the Board does not endorse the increased mill levy for Colorado Mountain College and the action of the Department of Local Affairs in approving said increase. 2 THAT, the Board is of the further opinion that the aforementioned increase in the mill levy for Colorado Mountain College belies the trust imposed upon public officials to conserve a tax base and not put undue burden on citizen property owners. MOVED, READ AND ADOPTED by the Board of County Commissioners of the County of Eagle, State of Colorado, at its regular meeting held the day of December, 1982.
