COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION No. 82- /00
DENIAL OF SPECIAL USE PERMIT - Cliffside
File No. - ZS- 163 -82
WHEREAS, Cliffside Village, Ltd. did file an application
with the Eagle County Department of Community Development on
or
about
September 1,
1982,
for
approval of
a special use per-
mit
for
Timesharing
within
the
Residential
Multiple Family
Zone District; and;
WHEREAS, a public hearing was held by the Board of
County Commissioners of the County of Eagle, State of
Colorado, on October 12, 1982; and
WHEREAS, based on the evidence, testimony, exhibits,
study of the Master Plan for the unincorporated areas of
Eagle County, comments of the Eagle County Department of
Community Development, comments of public officials and
agencies, the recommendations of the Eagle County Planning
Commission, and comments from all interested parties, the
Board of County Commissioners of the County of Eagle, State
of Colorado, finds as follows:
1. That proper publication and public notice was
provided as required by law for the hearing before the
Planning Commission and the Board of County Commissioners.
2. That the proposed special use does not conform to
the requirements of Section 2.09 of the Eagle County Land Use
Regulation.
3. That the proposed permit would not be consistent
with the Master Plan in that it would not encourage the
basic industry of recreation.

4. That the proposed use of timesharing is in the wrong
location to be in the best public interest because of the
physical limitations such as the access onto Highway 6, the
location between Vail and Beaver Creek and the proximity to
the Eagle -Vail subdivision.
5. That for the above stated and other reasons, the
proposed zoning is not in the best interest of the health,
safety, convenience, order, prosperity and welfare of the
citizens of Eagle County.
NOW THEREFORE, BE IT RESOLVED, that the petition of
Cliffside,for approval of a special use for Timesharing
within the Residential Multiple Family Zone District in
w the following described unincorporated area of Eagle County
be disapproved.
LEGAL DESCRIPTION
A tract of land in the East Half of Section 16,
Township 5 South, Range 81 West of the 6th Principal
Meridian, Eagle County, Colorado, described as follows:
From the Southeast Corner of said Section 16; thence
N.54 000127 11W. 1282.26 feet to a point, said point being
on the Easterly Right -of -Way line of the Denver and Rio
Grande Western Railroad:
Thence on said Easterly Right -of -Way N.13 °15133 "W. 794.44
feet to the Point of a Curve, said curve to the left,
having a central angle of 1 033'44" and a radius of
4637.07 feet, 126.43 feet to the Point of a Compound
Curve; thence on said curve to the left, said curve
having a central angle of 11 °06'33" and a radius of
1495.71 feet, 290.00 feet to the POINT OF BEGINNING of
said Tract B;
Thence on said curve to the left, said curve having a
central angle of 24 006157" and a radius of 1495.71 feet,
629.55 feet to the Northerly property line of said
Tract A;

Thence 5.82 °32'46 "E. 150.39 feet;

Project No. F -292 (8), Sheet No. 4;
Thence N.19 °59'37 "E. 50.00 feet to the POINT OF BEGINNING,
said point being on the Northerly Right -of -Way line of said
Highway U.S. 6 & 24;
