HomeMy WebLinkAboutR82-043 1041 for Denver and Rio Grande Western RR1 EAGLE COUNTY PERMIT AUTHORITY COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION No. 82- q 6 PERMIT ISSUED TO CONDUCT A DESIGNATED ACTIVITY OF STATE INTEREST No TO ENGAGE IN DEVELOPMENT IN A DESIGNATED AREA OF STATE INTEREST IN THE COUNTY OF EAGLE, STATE OF COLORADO Pursuant to the Guidelines and Regulations for Areas and Activities of State Interest of the County of Eagle, State of Colorado, 1980, as amended, heretofore adopted by the Board of County Commissioners of the County of Eagle, Colorado, the Eagle County Permit Authority has received an application from the Denver and Rio Grande Western Railroad Company , hereinafter referred to as the "Applicant ", for a permit to engage in development in the following area of State interest: Floodplain hazard areas, and the Eagle County Permit Authority hereby approves said application. This permit authorizes the Applicant: 1. To place approximately 26,593 C.Y. of fill material and rip rap adjacent to the Applicant's existing main track west of Dotsero, Colorado. Approximately 8860 C.Y. of this material will extend onto the floodplain of the Colorado River in the extreme western end of Eagle County 6 0 below ordinary high water line to provide road bed for construction of an additional track to be located parallel with and 15 feet northerly from the existing track. The foregoing activitiy which will affect an area of approximately 2.43 acres is more particularily described in the Applicant's application submitted to the Eagle County Permit Authority on May 7, 1982. 2. On the following described tracts of land: Encroachment Area A: An irregular tract of land lying northerly of the centerline of the main track of the Denver and Rio Grande Western Railroad Company at I.C.C. Station 2131 plus 62 feet and extending southwesterly 1400 feet, and having an average width of 13 feet, more or less, located near Dotsero, Eagle County, Colorado, all lying within the 200 foot wide right -of -way of said Railroad Company. Containing 0.79 acres, more or less. Enroachment Area B: An irregular tract of land lying northerly of the centerline of the main track of the Denver and Rio Grande Western Railroad Company at I.C.C. Station 2147 plus 86 feet and extending southwesterly 1600 feet, more or less, located near Dotsero, Eagle County, Colorado, all lying within the 200 foot wide right -of -way of said Railroad Company. Containing 1.20 acres, more or less. 4 4 0 Enroachment Area C: An irregular tract of land lying northerly of the centerline of the main track of the Denver and Rio Grande Western Railroad Company at I.C.C. Station 2166 plus 16 feet and extending southwesterly 730 feet, and having an average width of 6 feet, more or less, located near Dotsero, Eagle County, Colorado, all lying within the 200 foot wide right -of -way of said Railroad Company. Containting 0.44 acres, more or less. 3. For the following period: to commence upon receipt by the Eagle County Permit Authority of written evidence that a permit pursuant to Section 404 of the Federal Clean Water Act has been issued by the U.S. Corps of Engineers and that a certification pursuant to Section 401 of the Federal Clean Water Act has been obtained from the Water Quality Control Division, State of Colorado Department of Health, relative to the Applicant's proposed project; and to continue therefrom perpetually conditional upon an annual review by the Permit Authority pursuant to Section 1 -310 of the Guidelines and Regulations for Areas and Activities of State Interest of the County of Eagle, State of Colorado, 1980, as amended. 4. In accordance with the plans and /or specifications approved by the Permit Authority on the 30th day of June, 1982, as well as the Guidelines and Regulations for Areas and Activities of State Interest of the County of Eagle, State of Colorado, 1980, as amended, adopted by Eagle County for: floodplain hazard areas. 3 c ' 5. On the condition that the Applicant proceeds in conformity with all applicable Federal and State Statutes and Regulations as well as all applicable local land use controls including, but not limited to, master plans, subdivision regulations, zoning ordinance and building code. This permit shall not be effective until: the Applicant has submitted written evidence to the Eagle County Permit Authority that the U.S. Corps of Engineers has issued a permit pursuant to Section 404 of the Federal Clean Water Act and that the Water Quality Control Division, State of Colorado Department of Health, has issued a certification pursuant to Section 401 of the Federal Clean Water Act. This permit is valid for use only by the Applicant and may not be transferred. In the event that the Applicant fails to take substantial steps to initiate the above development of activity within twelve (12) months from the date of this permit, or, if such steps are taken, in the event the Applicant fails to complete the development or activity with reasonable diligence, this permit may be revoked by the Permit Authority.
