HomeMy WebLinkAboutR82-042 1041 for Blue Grouse Clubrr EAGLE COUNTY PERMIT AUTHORITY COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION No. 82 -9 - PERMIT ISSUED TO CONDUCT A DESIGNATED ACTIVITY OF STATE INTEREST No TO ENGAGE IN DEVELOPMENT IN A DESIGNATED AREA OF STATE INTEREST IN THE COUNTY OF EAGLE, STATE OF COLORADO Pursuant to the Guidelines and Regulations for Areas and Activities of State Interest of the County of Eagle, State of Colorado, 1980, as amended, heretofore adopted by the Board of County Commissioners of the County of Eagle, Colorado, the Eagle County Permit Authority has received an application from the Blue Grouse Club, hereinafter referred to as the "Applicant ", for a permit to engage in development in the following area of State interest: Site selection and construction of a major new domestic water and sewage treatment system, and the Eagle County Permit Authority hereby approves said application. This permit authorizes the Applicant: 1. To construct and develop the proposed major new domestic water and sewage treatment system as set forth in the Applicant's application submitted to the Eagle County Permit Authority on April 2, 1982, relative to the Blue Grouse Club planned unit development. 2. On the following described tract of land: TOWNSHIP 3 SOUTH, RANGE 84 WEST: The following described lands in said township, according to the Independent Resurvey of Township 3 South, Range 84 West of the 6th P.M., accepted June 6, 1923, (all references to "Book ", "Page ", and "Document" refer to records in the office of the Clerk and Recorder of Eagle County, Colorado): Tracts 37, 38, 39, 40, 42 Lots 5, 6, 7, 8, 9, 10, 11, 12, 13,_ 14, 15, 16, 17, and 18 and SW4 NE4, in Section 30. Lots 6, 7, 8, 9, 11, 13, 14, 16, 19, 20, 21, 22, 23, and 24 in Section 31. TOWNSHIP 4 SOUTH, RANGE 84 WEST: The following described lands in said township, according to the Independent Resurvey of Township 4 South, Range 84 West of the 6th P.M., accepted June 6, 1923: Tracts 39, 41, and 42. Lot 17 in Section 5. Lots 10, 12, 13, 14, 15, 16, 19, 20, 21, 22, 23, 24, and 25, and N2 and SW-,, in Section 6. N2 NE4 and SE-1, NE4 of Section 7. Lot 3 in Section 8. All that part of lot 2 and all that part of the South half of the Northwest quarter (SZ of NW4) of Section 8 lying West of the following described division line, to wit: Beginning at a point on the south boundary of Tract 38, whence Corner No. 4 of said,Tract 38, bears North 26 °13'40" West, 1440.22 feet distant; thence South 54 °22'West, 466.67 feet; thence South 33 °17'West, 320.7 feet; thence South 45° West, 653.4 feet; thence South 10 °51'West, 471.43 feet to a point on the south boundary of the Southwest quarter of the Northwest quarter (SW,'-, of NW,-) of said Section 8. TOWNSHIP 3 SOUTH, RANGE 85 WEST: The following described lands in said township, according to the Independent Resurvey of Township 3 South, Range 85 West of the 6th P.M., accepted June 6, 1923: Tracts 38 and 39. Lots 1, 6, 7, 8, 9, 10, 11, and 12, and SW4, in Section 24, with the exception of a parcel in Lots 8 and 9 called out by metes and bounds in the deed recorded at Book 114, Page 279. Lots 5 and 6, and W2, of Section 25. Sections 26, 34, and 35 and 36. K Section 27, excluding the W2 and NW4. E 4 SW 4, S 2 SE 4, and SE 4 NE 4 of Section 22. E2 SE4, SW4f and SW4 NW,-, of Section 23. SE 4 SE 4 of Section 33. TOWNSHIP 4 SOUTH, RANGE 85 WEST: The following described lands in said township, according to the Independent Resurvey of Township 4 South, Range 85 West of the 6th P.M., accepted June 6, 1923. Lots 5, 6, 7, and 8, and 9, and S2 NW-, and SW-', NE 4 , in Section 1. Lots 5, 6, 7, and 8 and S-1, NW-1- in Section 2. Lots 5, 6, 7, and 8, and S Z N 2f in Section 3. Lot 5 and SE 4 NE 4 in Section 4. EXCEPT, that parcel described as follows: A parcel of land located in Section 31 of Township 3 South, Range 84 West and in Section 6 and 1 of Township 4 South, Range's 84 and 85 West, respectively, 6th Principal Meridan, County of Eagle and State of Colorado, more particularly described as follows, to wit: Beginning at the Southwest Corner of said Section 31; thence N. 47 °00'00 "E. 1800.00 feet; thence East 3246.31 feet; thence South 3481.24 feet; thence S. 47° 00'00 "W. 1800.00 feet; thence N43 °00'00 "W. 4760.00 feet to the point of beginning. TOWNSHIP 5 SOUTH, RANGE 85 WEST: A tract of land situate in Tract 60 in Section 10, Township 5 South, Range 85 West of the Sixth Principal Meridian, being more particularly described as follows: Beginning at a point on the Easterly Line of said Tract 60, from which Angle Point 6 of said Tract 60 bears N.89 °50'20 "W. 1324.34 feet distant; thence along said Easterly Line of Tract 60, S.00 °13'20 "W. 871.00 feet; thence N.89 °50'20 "W. 500.00 feet; thence N.00 013'20 "E. 871.00 feet; thence 5.89 °50'20 "E. 500.00 feet to the point of beginning. 3 3. For the following period: to commence upon receipt by the Eagle County Permit Authority of written evidence that the State of Colorado Department of Health, Water Quality Control Division, has approved the Applicant's proposed project pursuant to the Colorado Primary Drinking Water Regulations and Regulations for Site Applications for Domestic Wastewater Treatment Works, respectively, promulgated by said Department; and to continue therefrom perpetually conditional upon an annual review by the Permit Authority pursuant to Section 1 -310 of the Guidelines and Regulations for Areas and Activities of State Interest of the County of Eagle, State of Colorado, 1980, as amended. 4. In accordance with the plans and /or specifications approved by the Permit Authority on the 30th day of June, 1982, as well as the Guidelines and Regulations for Areas and Activities of State Interest of the County of Eagle, State of Colorado, 1980, as amended, adopted by Eagle County for: site selection and construction of a major new domestic water and sewage treatment system. 5. On the condition that the Applicant proceeds in conformity with all applicable Federal and State Statutes and Regulations as well as all applicable local land use controls including, but not limited to, master plans, subdivision regulations, zoning resolution, and building code. In addition to the foregoing, the Applicant shall comply with all conditions imposed by the Board of County Commissioners of the County of Eagle, Colorado, relative to its approval of the preliminary plan for the Blue Grouse Club, File No. Su- 149 -82 -P. This permit shall not be effective until: the Applicant has submitted written evidence to the Eagle County 4 Permit Authority that the State of Colorado, Department of Health, Water Quality Control Division, has approved the Applicant's proposed project pursuant to the Colorado Primary Drinking Water Regulations and Regulations for Site Applicantions for Domestic Wastewater Treatment Works, respectively, promulgated by said Department. This permit is valid for use only by the Applicant and may not be transferred. In the event that the Applicant fails to take substantial steps to initiate the above development of activity within twelve (12) months from the date of this permit, or, if such steps are taken, in the event the Applicant fails to complete the development or activity with reasonable diligence, this permit may be revoked by the Permit Authority.
