HomeMy WebLinkAboutR82-038 1041 for town of eagleEAGLE COUNTY PERMIT AUTHORITY COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION No. 82-2/ PERMIT ISSUED TO CONDUCT A DESIGNATED ACTIVITY OF STATE INTEREST XRO TO ENGAGE IN DEVELOPMENT IN A DESIGNATED AREA OF STATE INTEREST IN THE COUNTY OF EAGLE, STATE OF COLORADO Pursuant to the Guidelines and Regulations for Areas and Activities of State Interest of the County of Eagle, State of Colorado, 1980, as amended, heretofore adopted by the Board of County Commissioners of the County of Eagle, Colorado, the Eagle County Permit Authority has received an application from The Town of Eagle, State of Colorado, hereinafter referred to as the "Applicant ", for a permit involving the following activity of State interest: Major extensions of existing domestic water and sewage treatment system, and the Eagle County Permit Authority hereby approves said application. This permit authorizes the Applicant: 1. To construct and develop the proposed major extension of its existing domestic water treatment system as set forth in the Applicant's application submitted to the Eagle County Permit Authority on April 23, 1982, for the purpose of replacing 7 miles of raw water transmission line and increasing the line size from 8 ", f0" and 12" to 14 "; expanding treatment plant facilities to a capacity 2 MGD and improving the sediment removal filtration system; and extending potable water services to Mill Park, P.U.D., Brush Creek Stables Subdivision, Brush Creek Terrace Subdivision, Eby Creek Mesa Subdivision, and JHY Subdivision; 2. On the following described tract of land: the aforesaid replacement of the raw water transmission line and expansion of the water treatment plant facilities shall be generally located on, adjacent to or near the Town of Eagle's existing transmission line easements from the Town's present water intake on Brush Creek Road five miles to the Town's Water Treatment Plant located on a tract of land situate in Tract 60, Section 10, Township 5 South, Range 84 West of the 6th P.M., according to the Independent Resurvey of the said Township and Range approved by the Surveyor General June 20, 1922, and accepted by the General Land Office June 6, 1923; and more particularly described as follows: Beginning at a point on the East line of Tract 60, on the Southwestern right -of -way line of County Road No. 11 from whence Corner No. 1 of Tract 60, which is identical with Corner No. 4 of Tract 63, bears N. 0 °33' E. 78.7 feet; thence S. 0 °33' W. 350.0 feet; thence N. 89 °27' W. 175.0 feet; thence N. °0 33' E. 421 feet plus or minus to the southwesterly right -of -way line of County Road No. 11; thence Southeasterly along the said right -of -way line 189 feet more or less to the point of beginning containing 1.56 acres more or less`. The extension of services to the above - referenced subdivisions shall be located on, adjacent to or near the Town of Eagle's easements or rights -of -way for its present existing service lines. PA 3. For the following period: five (5) years from the date of issuance of the subject permit conditional upon an annual review by the Permit Authority pursuant to Section 1 -310 of the Guidelines and Regulations for Areas and Activities of State Interest of the County of Eagle, State of Colorado, 1980, as amended. 4. In accordance with the plans and /or specifications approved by the Permit Authority on the 14th day of June, 1982, as well as the Guidelines and Regulations for Areas and Activities of State Interest of the County of Eagle, State of Colorado, 1980, as amended, adopted by Eagle County for: major extensions of existing domestic water and sewage treatment system. 5. On the condition that the Applicant proceeds in conformity with all applicable Federal and State Statutes and Regulations as well as all applicable local land use controls including, but not limited to, master plans, subdivision regulations, zoning ordinance and building code. In addition to the foregoing, the Applicant shall attempt with all reasonable efforts and in good faith to mitigate any adverse impacts resulting from the proposed extension of the Applicant's water treatment system on those agricultural lands directly affected thereby. This permit is valid for use only by the Applicant and may not be transferred. In the event that the Applicant fails to take substantial steps to initiate the above development of activity within twelve (12) months from the date of this permit, or, if such steps are taken, in the event the Applicant fails to complete the development or -3- activity with reasonable diligence, this permit may be revoked by the Permit Authority.
