OF THE
BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION No. 82- j
IN RE THE MATTER OF THAT CERTAIN HOTEL AND RESTAURANT LICENSE
HELD BY WHISKEY HILL CORPORATION RELATIVE TO RUBY'S COWBOY
BAR AND GRILL LOCATED AT 41000 U.S. HIGHWAY No. 6, EAGLE -VAIL
BUSINESS CENTER - SUSPENSION OR REVOCATION HEARING
WHEREAS, pursuant to various complaints submitted
by the Eagle County Sheriff's Department with respect to
that certain hotel and restaurant liquor license held by
Whiskey Hill Corporation for Ruby's Cowboy Bar and Grill
located at 41000 U.S. Highway No. 6, Eagle -Vail Business
Center, hereinafter referred to as the "licensed premises ",
the Board of County Commissioners of the County of Eagle,
Colorado, in its capacity as the Eagle County Liquor
Licensing Authority, hereinafter referred to as the "Board ",
adopted Resolution No. 82 -31 on May 17, 1982, which ordered
that a show cause hearing be held to determine whether the
aforesaid liquor license should be revoked or suspended; and
WHEREAS, the show cause hearing was duly scheduled
before the Board on May 25, 1982, with written notice thereof
being mailed to the licensee by certified mail, return receipt
requested; and
WHEREAS, the Board received evidence in the form of
sworn testimony or statements by representatives of the
Eagle County Sheriff's Department, representatives of the
licensee and members of the general public, and the following
exhibits which were presented at the show cause hearing and
formally admitted into the record at the conclusion thereof:
Exhibit 1: Letter dated May 14, 1982, from Georges
M. Boyer to the Board; letter dated
September 5, 1981, from Georges M. Boyer
to Mary Ann Bolt, Liquor Licensing Deputy;
letter dated November 26, 1980, from Jack
Haynes, Eagle County Sheriff, to Georges
M. Boyer; letter dated November 22, 1980,
from Georges M. Boyer to Sheriff Jack
Haynes; and letter dated November 5, 1980,
from Larry Peterson to Jack Haynes, Eagle
County Sheriff's Department.
Exhibit 3: Police report dated May 1, 1982, prepared
by Officer Mack, Eagle County Sheriff's
Department, relative to an alleged
stabbing incident; supplemental police
reports dated May 2, 1982, and May 3, 1982,
prepared by Officer Foondle; and supplemental
police report dated May 1, 1982, prepared
by Officer Workman.
Exhibit 5: Police report dated April 23, 1982, prepared
by Officer Martinez, Eagle County Sheriff's
Department, relative to a harassment report.
Exhibit 6: Police report dated January 5, 1982, prepared
by Officer Ray, Eagle County Sheriff's
Department, relative to an alleged assault.
Exhibit 8: Police report dated November 5, 1981,
prepared by Officer Martinez, relative to
an alleged assault.
Exhibit 13: Letter dated September 14, 1981, from
Midwest Marketing Associates, Inc. to
Marianne Bolt, in response to letter dated
September 5, 1981, from Georges M. Boyer
to Marianne Bolt.

Exhibit 14: Green notebook setting forth a newspaper
article and signatures opposing the
revocation or suspension of the liquor
license for the licensed premises.
Exhibit 15: A voluminous packet of letters opposing
the revocation or suspension of the
liquor license for the licensed premises;
and
WHEREAS, the Board having reviewed and considered all
of the testimony, regulations, guidelines, exhibits and other
evidence presented at the show cause hearing, does hereby find,
determine and declare the following.
NOW, THEREFORE, be it resolved by the Board of County
Commissioners, County of Eagle, State of Colorado:
THAT, the evidence presented at the show cause hearing
relative to the licensed premises does not support the finding
that the licensee has violated any of the provisions of the
Colorado Liquor Code, or any provisions of the Colorado
Liquor Code Rules and Regulations, or any of the terms,
conditions or provisions of the subject liquor license
issued by the Board.
THAT, the charges filed against the licensee relative
to the licensed premises as set forth in Resolution No. 82 -31
be and are hereby dismissed without prejudice.
THAT, the record of proceedings of the show cause
hearing be and is hereby made a part of the liquor license
file for the licensed premises kept in the Eagle County
Clerk and Recorder's file, and may be the subject of further
review by the Board in its consideration of the licensee's
liquor license renewal application for the licensed premises.

MOVED, READ AND UNANIMOUSLY ADOPTED by the Board of
County Coiimissioners, County of Eagle, State of Colorado, at
its regular meeting held the day of June, 1982, non
pro tunc May 25, 1982.
