HomeMy WebLinkAboutR82-019 Bend in the River Ranch CampgroundRESOLUTION OF THE EAGLE COUNTY PERMIT AUTHORITY STATE OF COLORADO RESOLUTION NO. 82- 1 "j IN RE THE MATTER OF THE APPLICATION OF MARJORIE ELLIOTT FOR A PERMIT TO CONSTRUCT A MAJOR NEW DOMESTIC AND SEWAGE TREATMENT SYSTEM RELATIVE TO THE BEND IN THE RIVER RANCH CAMPGROUND, PURSUANT TO THE GUIDELINES AND REGULATIONS FOR AREAS AND ACTIVITIES OF STATE INTEREST OF THE COUNTY OF EAGLE, COLORADO, 1980, AS AMENDED - REQUEST FOR WAIVER OF SUBMISSION REQUIREMENTS WHEREAS, Marjorie Elliott, hereinafter referred to as the "applicant ", did on March 2, 1982, file with the Eagle County Permit Authority an application for a permit to construct a major new domestic water and sewage treatment system on real property commonly referred to as the Bend in the River Ranch Campground located 2 -1/2 miles northwest of the Bond area along State Highway No. 131 and the Colorado River, in accordance with Chapter 3 of the Guidelines and Regulations for Areas and Activities of State Interest of the County of Eagle, State of Colorado, 1980, as amended; and WHEREAS, pursuant to Section 3 -305 of the Guidelines and Regulations for Areas and Activities of State Interest of the County of Eagle, State of Colorado, 1980, as amended, the applicant requested a waiver of certain submission requirements as set forth at length in the applicant's permit application; and WHEREAS, a public hearing was held before the Eagle County Permit Authority on March 31, 1982, relative to the applicant's request for waiver of certain submission requirements; and WHEREAS, notice of the public hearing was duly published in the Eagle Valley Enterprise on March 18, 1982, and March 25, 1982, respectively. 'z NOW, THEREFORE, be it resolved by the Eagle County Permit Authority, State of Colorado: THAT, based upon the evidence and testimony received at the public hearing referred to hereinabove, the Eagle County Permit Authority hereby finds, determines and declares that full compli- ance with the submission requirements by the applicant pursuant to Chapter 3 of the Guidelines and Regulations for Areas and Activities of the County of Eagle, State of Colorado, 1980, as amended, would be unreasonably burdensome for the applicant; that the proposed development will have an insubstantial impact on the surrounding area; and that the information submitted by the applicant is sufficient for the Eagle County Permit Authority to arrive at a permit decision in full compliance with the law and the Guidelines and Regulations for Areas and Activities of State Interest, County of Eagle, State of Colorado, 1980, as amended. THAT, based upon the foregoing, the Eagle County Permit Authority hereby waives those certain submission requirements requested by the applicant to be waived in her permit application, excepting therefrom the submission requirement detailing the source, rights and quality of existing water supply, i.e. Section 3 -304 (g), of which the Permit Authority hereby requires compliance therewith. THAT, this Resolution is necessary to preserve the public health, safety and welfare.
