HomeMy WebLinkAboutR82-008 Emergency Services Hospital DistrictCommissioner cpti��� moved adoption of the following Resolution: BEFORE THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION N0. - % WHEREAS, a Service Plan, Supplement, supporting documents and a processing fee in the amount of $200.00 have been filed relating to the proposed Eagle County Emergency Services Hospital District in Eagle County, Colorado; and WHEREAS, the provisions of Part 2 of the Special Dis- trict Act require that a public hearing be called and held within thirty (30) days concerning the adequacy of the Ser- vice Plan with Supplement; NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Eagle County, Colorado: Section 1. That a public hearing on the Service Plan with Supplement, for the proposed Eagle County Emergency Services Hospital District be and the same is hereby set for 1 :30 o'clock p.m., at the Commissioners' Hearing Room, County Courthouse Annex, Eagle, Colorado, the regular meeting place of the Board of County Commissioners, on Wednesday, the 24th day of February, 1982. Section 2. That the Clerk of this Board is hereby directed to cause the Notice of Hearing to be published in the Eagle Valley Enterprise, a newspaper of general circu- lation within the County, once each week for a period of three (3) successive weeks by three (3) publications, the first of which shall be at least twenty (20) days prior to the date of the public hearing. Section 3. That the Clerk is hereby further directed to provide written Notice of Hearing to the petitioner and to the governing body of any existing municipality or special district which has levied an ad valorem tax within the next preceding tax year and which has boundaries within a radius of three (3) miles of the proposed District. Section 4. That said Notice of Hearing shall be in substantially the following form: STATE OF COLORADO ss. COUNTY OF EAGLE NOTICE OF HEARING PUBLIC NOTICE IS HEREBY GIVEN that there were filed with the County Clerk and Recorder of Eagle County, Colorado, a Service Plan and a Supplement and related documents for the proposed Eagle County Emergency Services Hospital District. The Service Plan, Supplement, and related documents are now on file in the office of the Clerk and Recorder and are available for public inspection. NOTICE IS FURTHER GIVEN that by Order of the Board of County Commissioners of Eagle County, Colorado, a Public Hearing on said Service Plan with Supplement and related documents will be held at the Commissioners' Hearing Room, County Courthouse Annex, Eagle, Colorado, at 1 :30 o'clock p.m. on Wednesday, the 24th day of February, 1982. The purpose of the Public Hearing shall be to consider the adequacy of the Service Plan with Supplement, of the proposed Eagle County Emergency Services Hospital District and to form a basis for adopting a Resolution approving, conditionally approving, or disapproving the Service Plan with Supplement. The proposed Eagle County Emergency Services Hospital District is located entirely within Eagle County, Colorado and is described as follows: The statutory boundaries of Eagle County, State of Colorado, as more particularly described in 30 -5 -121, C.R.S. 1973, except the following: Beginning at a point on the County line between Eagle and Garfield Counties, which is also the Center of Section 33, Township 6 South, Range 87 West of the 6th P.M.; thence Easterly to the Center of Section 34, Town- ship 6 South, Range 87 West; thence South to the South Quarter corner of said Section 34; thence East along the Township line between Townships 6 and 7 South extended to the Southeast corner of Section 31, Township 6 South, Range 84 West of the Gth P.m.; thence South along the Section line extended approximately three (3) miles to a point in unsurveyed Township 7 South, Range 84 West of the 6th P.M.; thence East approximately fifteen (15) miles to a point in unsurveyed Township 7 South, Range 82 West, which is the approximate Center line of said Range 82 West; thence South approximately five and one - fourth (5 1/4) miles to a point on the County line be- tween Eagle and Pitkin Counties; thence West along the County line between Eagle and Pitkin Counties to the Southwest corner of Eagle County; thence North along the County line between Eagle and Garfield Counties to the point of beginning. The Service Plan with Supplement proposed the revised boundaries as follows: The legal description of the Eagle County Emergency Services Hospital District is as follows: Beginning at a point on the County line between Eagle and Routt Counties, which is also the Northwest corner of Section 6, Township 2 South, Range 83 West of the 6th P.M.; Thence South along the West line of Range 83 West to the Northwest corner of Section 6, Township 5 South, Range 83 West of the 6th P.M.; -2- Thence East along the North line of Township 5 South to the Northwest corner of Section 3, Township 5 South, Range 83 West of the 6th P.M.; Thence South along the Section lines to the Southwest corner of Section 34, Township 5 South, Range 83 West of the 6th P.M.; Thence East along the North line of Township 6 South to the Southwest corner of Section 35, Township 5 South, Range 82 West of the 6th P.M.; Thence South along the Section lines extended approx- imately fourteen (14) miles to a point on the County line between Eagle and Pitkin Counties; Thence Easterly, Northerly and Westerly along the County line of Eagle County, State of Colorado, as more particularly described in 30 -5 -121, C.R.S. 1973, to the point of beginning. Except Tract 71, Section 27, Township 5 South, Range 83 West of the 6th P.M. In accordance with the procedures set forth in 32 -1- 305(3), C.R.S. 1973, as amended, the owner of any real prop- erty within the proposed Eagle County Emergency Services Hospital District may file a petition with the District Court in and for Eagle County stating reasons why such property should not be included within the proposed District and re- questing that such property be excluded therefrom. Such petition shall be duly verified, shall describe the property sought to be excluded, and shall be filed after the filing of the petition for the organization of the proposed District but no later than ten (10) days before the day fixed for the hearing thereon before the District Court. THIS NOTICE GIVEN BY ORDER of the Board of County Commissioners of Eagle County, Colorado, this 4th day of January, 1982 and revised the 1st day of February, 1982. That the Board of County Commissioners of Eagle County, Colorado, does hereby waive the requirement of the Special District Act providing that the Service Plan with Supplement be filed at least ten (10) days prior to the reg- ular meeting of the Board of County Commissioners. Section G. That all resolutions or parts thereof in conflict with the provisions hereof be and the same are here- by repealed. Section 7. That this Resolution, immediately upon its passage, shall be recorded in the Book of Resolutions of the County kept for that purpose and shall be authenticated by the signatures of the Chairman of the Board of County Commis- sioners and the County Clerk and Recorder. A hearing on the Service Plan, Supplement to Service Plan, and related documents for Eagle County Emergency Services Hospital District was held by the Board of County Commissioners pursuant to the provisions of Part 2 of Article 1, Title 32, C.R.S. 1973, as amended and in accordance with the resolution adopted by the Board on the 4th day of January, and then revised and adopted the 1st day of February, 1982. Thereupon, Commissioner �jv-c�� c�J introduced and moved the adoption of the following Resolution: RESOLUTION WHEREAS, pursuant to the provisions of Part 2 of Article 1 of Title 32, C.R.S. 1973, as amended, the Board of County Commissioners of Eagle County, Colorado, on Wednesday, the 24th day of February, 1982, held a public hearing on the Service Plan, Supplement to Service Plan, and related docu- ments for Eagle County Emergency Services Hospital District; and WHEREAS, notice of this hearing was duly published in The Eagle Valley Enterprise, Eagle, Colorado, a newspaper of general circulation within Eagle County, said publication occurring on February 4, 11 and 18, 1982, as required by law, forwarded to the Petitioners, and mailed to the govern- ing body of each municipality and special district which has levied an ad valorem tax within the next preceding tax year and which has boundaries within a radius of three miles of the proposed district, and to the Eagle County Planning Commission; and WHEREAS, the Board has considered the Service Plan, Supplement to Service Plan, and all other testimony and evidence presented at the hearing; and WHEREAS, it appears that the Service Plan and Supple- ment to Service Plan, which is incorporated into the Service Plan, should be approved without condition. THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF EAGLE COUNTY, COLORADO: 1. That the Board of County Commissioners of Eagle County, Colorado, does hereby determine that all of the requirements of Part 2 of Article 1 of Title 32, C.R.S. 1973, as amended, relating to the filing of the Service Plan for Eagle County Emergency Services Hospital District have been fulfilled and that notice of the hearing was duly given in the time and manner required by law. 2. That said publication of the Notice of Hearing on the Service Plan in The Eagle Valley Enterprise, a newspaper of general circulation within the County, is hereby approved. 2 3. That: There is sufficient, existing and projected need for organized service in the area to be serviced by the proposed District; the existing service in the area is inad- equate for present and projected needs; adequate service is not, and will not be, available to the area through existing municipal or quasi - municipal corporations within a reason- able time and on a comparable basis; the proposed District is capable of providing economical and sufficient service to the area within its proposed boundaries; the area to be included in the District has the financial capability to discharge the proposed indebtedness on a reasonable basis; the facility and service standards of the District are com- patible with facility and service standards of adjacent municipalities and districts; and the proposal with supple- ment is in substantial compliance with the County master plan. 4. That the Service Plan of Eagle County Emergency Services Hospital District and Supplement to the Service Plan, which shall be incorporated into the Service Plan, as amended by Exhibit( V4 I attached hereto and incorpor- ated herein, is hereby approved, without condition. 5. That all resolutions, or parts thereof, in conflict with the provisions hereof, are hereby repealed, except that this repealer shall not be construed so as to revive any resolution or part thereof heretofore repealed. G. That a certified copy of this Resolution be filed in the records of Eagle County and submitted to the Petition- ers for the purpose of filing in the District Court of Eagle County, Colorado.
