COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION No. 82 -_'�
A RESOLUTION AMENDING AND READOPTING RESOLUTION No.
81 -33 - COUNTY SALES TAX
WHEREAS, the Board of County Commissioners of the
County of Eagle, Colorado, hereinafter referred to as the
"Board ", did on September 22, 1981, adopt Resolution
No. 81 -33 which imposed a one per -cent (1 %) Sales Tax
within the County of Eagle, Colorado; and
WHEREAS, Resolution No. 81 -33 required any person
engaging in the business of selling tangible personal
property at retail or furnishing certain services as
specified therein, to obtain a license therefor from the
County Clerk and Recorder; and
WHEREAS, pursuant to Section 17 of Resolution
No. 81 -33, the collection, administration and enforcement
of the Sales Tax imposed thereby shall be performed by
the Director of the Department of Revenue of the State
of Colorado in the same manner as the collection, adminis-
tration and enforcement of the Colorado State Sales Tax;
and
WHEREAS, by reason of the foregoing, the Board
finds, determines and declares that the issuance of County
Sales Tax Licenses, and the administration and enforcement
relative thereto by the County Clerk and Recorder, will
entail a lengthy and time consuming process with no
beneficial purpose to be served thereby; and

WHEREAS, pursuant to Section 19 of Resolution
No. 81 -33, the Board, by a majority vote, may amend,
alter or change the provisions of said Resolution,
except as to increasing the one per -cent (1 %) rate of
tax therein imposed as to the Sales Tax, or as to the
use of the County Sales Tax proceeds.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF
COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, COLORADO:
THAT, Resolution No. 81 -33 providing for the
imposition of a one per -cent (1 %) Sales Tax within the
County of Eagle, Colorado, is hereby amended by the deletion
of those certain provisions set forth therein which require
persons covered thereby to obtain a County Sales Tax License
from the County Clerk and Recorder.
THAT, the foregoing amendment shall not constitute
nor be construed as an annulment, abrogation or waiver of
any similiar requirement which may be imposed by the
Director of the Department of Revenue of the State of
Colorado in the collection, administration and enforcement
of the County Sales Tax.
THAT, the entirety of Resolution No. 81 -33, and as
herein amended, is hereby readopted.
THAT, the aforesaid amendment and readoption of
Resolution No. 81 -33 shall not constitute nor be construed
as a waiver of any violations existing at the time of
adoption of this Resolution.
THAT, should any section, clause, provision, sentence,
or word of this Resolution be declared by a Court of com-
petent jurisdiction to be invalid, such decision shall
not affect the validity of this Resolution as a whole, or
any parts thereof, other than the part so declared to be
invalid. For this purpose, this Resolution is declared
to be severable.

THAT, this Resolution is necessary for the health,
welfare and safety of the Citizens of Eagle County.
MOVED, READ AND UNANIMOUSLY ADOPTED by the Board
of County Commissioners, County of Eagle, Colorado, at
its regular meeting held the day of ' t(- L Cr�1 t
