HomeMy WebLinkAboutR93-129 special use permit for sheriff office firearms training facilityRESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO: 93 - APPROVAL OF SPECIAL USE PERMIT Eagle County Sheriff's Office Firearms Training Facility FILE NO: ZS- 337 -93 WHEREAS, Eagle County Sheriff's Department, (Applicant) did file an application with the Eagle County Department of Community Development on or about August 24, 1993, for a firearms and training facility within the Resource zone district, in the unincorporated area of Eagle County described as follows: A parcel of land lying in the SW1 /4 of the NW1 /4 of the SW1 /4 of Section 3, T4S, R83W of the 6th P.M., Eagle County, Colorado and containing 10.2 acres more or less. WHEREAS, the special use permit request was considered at a public meeting by the Eagle and Colorado Valley Planning Commission on October 20, 1993 and by the Eagle County Board of County Commissioners on October 26, 1993; and WHEREAS, based on the evidence, testimony, exhibits, study of the Master Plan for the unincorporated areas of Eagle County, comments of the Eagle County Department of Community Development, comments of public officials and agencies, the recommendation of the Eagle and Colorado Valley Planning Commission, and comments from all interested parties, the Board of County Commissioners of the County of Eagle, State of Colorado, finds as follows: 1. 2. 91 4. That proper publication and public notice was provided as required by law for the hearings before the Planning Commission and the Board of County Commissioners. That the proposed special use conforms to the requirements of Section 2.09 of the Eagle County Land Use Regulations. That the proposed special use will be compatible with the existing uses in the area. Fisher Eagle County Clerk & Recorder 0.00 T effect of the use on the character of the neighborhood, adequacy of access to and from the area, appropriateness of the physical arrangement of the use on the proposed site, and consistency with the Master Plan. 5. That for the above - stated and other reasons, the proposed special use is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Eagle County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of the County of Eagle, State of Colorado: THAT the application of Eagle County Sheriff's Office, File No. ZS- 337 -93, for a Special Use Permit for a Firearms and Training Facility within the Resources Zone District and as described herein, be approved, subject to the conditions as set forth herein. THAT the following conditions shall be placed upon this approval and that violation of any condition shall be the basis for revocation of the Special Use Permit: 1. Acquisition of the appropriate permits (building, etc.) from Eagle County. 2. Revegetation shall take place within eight months of operation and shall be diligently pursued until all areas disturbed on site have returned to their natural condition or are progressing to that point. Irrigation from the existing cattle tank to the north of the site is acceptable provided the owner (BLM) grants permission for it's use. Otherwise, a temporary irrigation system must be maintained to insure plant establishment. 3. outdoor lighting on -site shall be restricted to lights that shine below the horizon, are mounted on poles less than 12' high or are at ground level. 4. Water supply and sanitary facilities shall be resolved to the satisfaction of the Environmental Health Division prior to initiation of any site development. 5. The use of the range is restricted to official law enforcement and military personnel and shall not be open to the general public. 6. Hours of operation may be limited if complaints from the nearby residents are received and cannot be resolved without limiting the amount of activity at this site. E 7. Improvements to Milk Creek Road may be necessary to accommodate the impact of traffic traveling to this site, as determined by the County Engineering Department and Road and Bridge Department. The applicant shall contribute to the cost of any associated Milk Creek Road improvements prior to commencing operations and /or on a regular maintenance basis, as determined by the previously mentioned County departments. 8. Acceptance of the information regarding environmental impacts, as provided by the applicant, as adequate for determining the environmental impact of this use, which is determined to be minimal. THAT this permit shall be subject to periodic review by the Planning Department, and shall be heard by the Board of County Commissioners only if complaints are received and not satisfactorily resolved by the staff. THAT the Board of County Commissioners directs the Director of the Department of Community Development to provide a copy of this Resolution to the applicant. THAT the Board of County Commissioners finds, determines and declares that this Resolution is necessary for the health, safety and welfare of the citizens of Eagle County.
