PD- 312 -93 -S co ~ o o o C1 N O .P G � p Co c+ w WHEREAS, on or about June 15, 1993, the County of Eagle, C o State of Colorado, accepted for filing an application submitted �`•'� by Andrew and Jennifer Lane (hereinafter "Applicant ") for approval of the Planned Unit Development Sketch Plan for Kodiak x"b Park, File No. PD- 312 -93 -S; and, 90 I*d m � WHEREAS, the Applicant requested the approval of a Planned o Unit Development (PUD) Sketch Plan which would allow for the a.c development as follows: n U 1. Private water skiing lake and related services (existing Special Use Permit); 2. Two 6,000 sq. ft. commercial structures; 3. 6,000 sq. ft. of indoor storage; 4. Five single family home sites in addition to the . existing home, guest house and barn (7 dwelling or units).; and, . c o 0 WHEREAS, notice of the Sketch Plan was given to all proper . agencies and departments as required by the Eagle County Land Use Regulations, Section 2.17.02(1); and, WHEREAS, at its public hearing /hearings held August 5, 1993, the Planning Commission, based upon its findings, recommended approval of the proposed PUD Sketch Plan, with certain conditions; and WHEREAS, at its regular hearing /hearings of August 10, 1993, the Eagle County Board of Commissioners (hereinafter "Board "), considered the PUD Sketch Plan, associated plans, and the statements and concerns of the Applicant, the Eagle County Community Development and Engineering staff, and other interested' persons. BASED ON THE EVIDENCE BEFORE IT, and with the modifications imposed by the conditions hereinafter described, THE BOARD FINDS AS FOLLOWS: 1. The proposed Sketch Plan is in conformance with the Master Plan; to the extent applicable, with the Mid Valley Community Plan; and with policies, guidelines, zoning and other applicable regulations. Furthermore, the resulting development will not be inconsistent with the Master Plan objectives. Specifically with regard to the Master Plan, the Board further finds the development of this project as proposed: a. to have a full range of public services available. b. to have a significant economic determinant to El Jebel area and to the County generally. C. to have minimized any negative effects on the social and natural environment. d. to be capable of being phased in order to address current and anticipated market conditions. 2. The land included in the proposed Sketch Plan is suitable for subdivision. 3. Comments and recommendations from the agencies listed in Eagle County Land Use Regulations, Section 2.17.02(1), have been considered. 4. The evidence shows that access which is capable of servicing the development from the state highway system to the parcel of land proposed for subdivision can be built by the Applicant. 5. The area around the development can be planned to be in substantial harmony with the proposed PUD. 6. No adjacent and nearby communities will be detrimentally affected by the proposed PUD 2 7. The PUD can be completed within a reasonable period of time, to be determined prior to final approval of the PUD. 8. The proposed commercial development within the proposed PUD is justified. 9. The streets, as proposed, are adequate to support the anticipated traffic, and the development will not overload the streets outside the planned area. 10. Proposed utility and drainage facilities, upon their conformance to the conditions set forth herein, are adequate for population densities and the type of development proposed. 11. The employee housing plan is acceptable. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, the application for approval of the Planned Unit Development Sketch Plan for Kodiak Park be and is hereby granted, subject to compliance with the following conditions: 1. The applicant should pursue a letter of commitment from Mid Valley for water service to the project; 2. The principals of Blue Ridge and Kodiak Park PUD projects and the County should determine a preliminary engineered alignment of the road that serves the community and the projects; 3. A traffic study to determine anticipated volumes and impacts on the entire new road. This can be performed in conjunction with the Blue Ridge PUD; 4. A drainage study and plan demonstrating that soak - aways are the only reasonable drainage alternative. Run -off shall not be channeled into existing irrigation ditches; 5. Accesses should intersect the new road at right angles. More distance is necessary between the commercial parking accesses and the private access road; 3 6. Proposed open space improvements and maintenance plan; 7. PUD Control Document modifications and additions pursuant to this document and Public Hearings including the water ski facility; 8. A concerted effort on the part of the applicant to include the excepted 6.81 acres parcel in the PUD; 9. A ditch easement agreement for the Robinson Ditch and suggested ditch easement language on the Final Plat; 10. Investigation by the applicant through the Pitkin County Open Space /Trails Board to determine a possible trails easement on the property; 11. The opinion of the Division of Wildlife will be included with the submittal of the Preliminary Plan; 12. A market study depicting support for this proposal; 13. Fire apparatus access to structures and fire hydrants as outlined by the Basalt and Rural Fire Protection District; 14. All material representations made by the Applicant in the application and public hearings shall be adhered to and considered conditions of approval, unless otherwise specifically addressed; 15. Conformance to all other Preliminary Plan requirements; 16. The EIS requirement is waived. THAT, the Sketch Plan submitted under this application and hereby approved, does not constitute a "site specific development plan" as that phrase is defined and used in C.R.S. Section 24 -68 -101, et seq. Sketch Plan approval is expressly conditioned on the County's authority to impose further restrictions or limitations on the PUD which are necessitated by impacts which are not yet recognized or which are more severe than realized under the review given at the hearings on the Sketch Plan. 4 THE BOARD further finds, determines and declares that this Resolution is necessary for the health, safety and welfare of the inhabitants of the County of Eagle, State of Colorado.
