HomeMy WebLinkAboutR93-098 creation of Mass Transportation CommitteeCommissione r�rn<< moved adoption of the follow' g Resol tion: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 93 -E_ MASS TRANSPORTATION COMMITTEE RESOLUTION WHEREAS, the Board of County Commissioners ( "the "Board ") recognizes that transportation and transportation planning are of vital importance to the County's economic, social and environmental well being; and WHEREAS, the Board desires to appoint a committee with representation for the County as a whole to develop, administer, and, recommend spending for the Comprehensive County -wide Transportation Plan (the "Plan "), which will include but not be limited to transportation identified in Resolution No. 93 -74. NOW, THEN, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: 1. The Eagle County Mass Transportation Committee (the "Transportation Committee ") is hereby established and shall consist of thirteen (13) members to be appointed as follows: (a) The Board of County Commissioners shall appoint one member from each of the incorporated towns or cities within the County. (b) The Board of County Commissioners shall appoint six (6) representatives of the community at large, two from each County Commissioner's districts. (c) Only the appointed Transportation Commission members shall be allowed to vote at a Transportation Committee meeting. All members of the Committee shall serve two year terms. Lots shall be drawn so that three (3) of the community at large (one from each Commissioner's District) and four (4) of the initial appointees shall serve one year terms, and the remainder shall serve two year terms. Any one appointed to a vacancy on the Committee shall serve the remainder of the term of the person being removed. All appointees shall serve at the pleasure of the Board of County Commissioners. (d) No Committee member may serve more than four (4) consecutive terms. Anyone who has served four (4) consecutive terms shall not be eligible to be reappointed to the Committee for at least two (2) years. 2. All meetings of the Transportation Committee shall be public meetings which comply with all open meeting laws which apply to Eagle County. All actions of the Transportation Committee shall require the affirmative vote of at least eight (8) voting members of the Transportation Committee. 3. The Transportation Committee shall have the following powers and duties: (a) To adopt such bylaws as it deems appropriate, which are consistent with this Resolution and approved by the Board of County Commissioners. (b) The Transportation Committee shall each year in the normal budget preparation process make recommendations as to the spending of the County Mass Transportation Fund for financing, constructing, operating or maintaining a mass transit system to include any means of transporting the general public, but not to be limited to bus, bike paths, bikeway, rail, air, fixed guideway, rapid transit, or other means'of conveyance within Eagle County. (c) To recommend to the Board of County Commissioners an operating plan on a seasonal basis, on or before December 1, 1993 and thereafter on or before September 1 for the succeeding winter season (November through April) and on or before February 1 of each year for the succeeding summer season (May through October). The operating plan will provide information on anticipated costs, ridership, routing, schedules, . personnel needs, and budget amendments that may be required. (d) To report at least once annually to the Board of County Commissioners, on or before December 1, 1993 and on or before September 1 of each succeeding year, regarding the efforts which have been made to meet such transportation plan or plans as may have been adopted by the County to meet the long -term goals of the Mass Transportation Plan. (e) To do any and all things necessary to accomplish its duties as described herein. (f) To provide for Transportation Committee subcommittees to review those issues assigned it by the Transportation Committee. However, the recommendations of any, subcommittee shall not be deemed a decision /recommendation of the Transportation Committee unless approved by vote of the Transportation Committee. 4. Eagle County Government (the "County ") shall continue to acquire, by purchase, lease, or Lease purchase agreements, buses, other vehicles, and such other facilities for use in the Mass Transportation System. The County in consultation with the Eagle County Mass Transportation Committee shall operate, finance and maintain the Mass Transportation System. The County shall hire, dismiss and pay the Mass Transportation System employees, including the Director of Transportation, in accordance with the County's personnel and employment policies. The Director of Transportation shall be supervised by the County Manager. The Transportation Committee shall be consulted on performance standards and assessments of the Director of Transportation. 5. The County Commissioners recognize that the Transportation Committee is an essential factor in the successful implementation of the Mass Transportation Plan. The County, in administering the County Mass Transportation System, will strive to insure optimum and cost effective performance. The County will consider the implementation of all reasonable recommendations that it receives from the Transportation Committee. 6. The County shall give the Transportation Committee and all parties represented on the Transportation Committee written notice of any Transportation Committee recommendation which the County does not intend to implement. Any such recommendations) which the County does not intend to implement shall be placed on the agenda of a regular or special meeting of the Board of County Commissioners for approval, disapproval, or approval with conditions within thirty (30) days of the Board's action on the recommendation. The County's written notice shall include the basis for the County's intention to not follow the Transportation Committee's recommendation(s) as well as the time, date and place of the Commissioners meeting. Notwithstanding the above, any such Commissioner meeting need not be held if prior to such meeting the Transportation Committee votes to approve of the County's intended action.. 7. The County shall maintain insurance coverages at least up to the judgment limitations contained in the Governmental Immunity Act, C.R.S. 24 -10- 114(1), to protect against third party claims and possible liability arising out of its operation of the Mass Transportation System. The County shall make monthly reports to the Transportation Committee on the County's compliance with, or variances from, the approved budget. c 8. The County shall credit and deposit all revenues generated form the.County sales tax authorized by House Bill 1081 (1990) and from the operation of the bus system whether from advertising, fares, or revenues generated in any other manner (e.g., the sales of property) including interest earned, to the County Mass Transportation Fund. No expenditure or transfers may be made from such fund except for the Mass Transportation System in accordance with its properly approved budgets. All property acquired for the Mass Transportation System may.be disposed of in such reasonable manner as the county, with the advice of the Transportation Committee, may determine; and proceeds of such disposals shall be credit to the County Mass Transportation Fund. 9. The County shall give the Transportation Committee and all parties represented on the Transportation Committee thirty (30) days written notice of any Board of County Commissioner meeting at which the County intends to consider a modification of this Resolution. 10. Each of the provisions herein are deemed severable. Should any provision of this Resolution be found to be illegal, unenforceable, or unconstitutional by a court of competent jurisdiction, such findings shall not impair the remaining portions of this Resolution.
