APPROVING ENCROACHMENT INTO THE
PLATTED INUNDATION ZONE
BY LOT 3, TRACT A, BLOCK 1
BEAVER CREEK PUD #2
Oil / 3 , the Eagle County Board of County
(hereinafter "BOCCI') approved a plat entitled "Sixth
the First Filing, and the Seventh Amendment to the
Beaver Creek Subdivision." Said plat was recorded in
of the Eagle County Clerk and Recorder on April 4,
Book 481 at Page 618, Reception No. 377826; and
WHEREAS, as set forth in plat note 17 of said recorded plat,
no permanent structure or fixture may be constructed on those
portions of Sixth Amendment to the First Filing designated as_ "Area
Subject to Inundation, "except as otherwise permitted by the Beaver
Creek Resort Company and the Board of County Commissioners of Eagle
County, Colorado; and
WHEREAS, Oxford Court, Ltd. ( "applicant ") has applied to the
Eagle County Department of Community Development for a building
permit for a swimming pool ( "the proposed development ": a sketch of
which is attached herein as "Exhibit A which is still pending at
the date of this signing; and
WHEREAS, the proposed development as shown in Exhibit A
proposes to be built on Lot 3, Tract A, Block 1 and a portion of
Lot 5, Tract A, Block 4 and a portion of Lot 15, Tract A, Block 1
of the Beaver Creek PUD (the "subject property a map of which is
attached as Exhibit "B") which falls inundation and 100 - year
floodplain zones as originally platted on the above referenced
plat; and

WHEREAS, investigation and studies subsequent to the original
platting which have reviewed the areas of the subject property
outlining the proposed development relating to drainage and
floodplain, (including the study prepared by Inter - Mountain

Engineering, Ltd., entitled "Drainage Study for Oxford Court,
Beaver Creek, Eagle County, Colorado," dated April 1993 and a
review by the Eagle County Department of Community Development)
have determined that the area outlined for the proposed development
does not fall within inundation and 100 -year floodplain zones; and
WHEREAS, the information used I for the Inter - Mountain
Engineering, Ltd. study in April of 1993 is more detailed and
complete than the information upon which the original plat was
based.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE STATE OF COLORADO:
THAT the BOCC finds based on the information presented to it
that the proposed development, as outlined in Exhibit A, does not
encroach into the 100 -year f loodplain/ inundation zone as indicated
in Exhibit B.
THAT the Beaver Creek Resort Company, in reference to plat
note 17 of said recorded plat, shall indicate its approval of the
plans for the proposed development by affixing its signature to
this resolution as provided for herein below.
THAT the BOCC finds, determines and declares that this
resolution is necessary for the health, safety and welfare of the
inhabitants of the County of Eagle, State of Colorado.
MOVED, READ AND ADOPTED by the Board of County Commissioners
of the Countyof Eagle, State of Colorado, at its regular meeting
held the l� day of July, 1993.

CONSENT STATEMENT
The Beaver Creek Resort Company of Colorado, a Colorado non-
profit corporation, has approved the Grading and Drainage Plan
prepared by Inter - Mountain Engineering, Ltd. dated January 29, 1993
in connection with the proposed development referenced in this
Resolution to be constructed upon Lot 3, Block 1, Tract A and a
portion of Lot 5, Tract A, Block 4 and a portion of Lot 15, Tract
A, Block 1, Sixth Amendment to the First Filing, and the Seventh
Amendment to the Fifth Filing, Beaver Creek Subdivision.
