Fisher Eagle County Clerk & Recorder 0.00 Commissions a rlo / - of the follow' Resolution: BOARD OF COUNTY COMM STONERS COUNTY OF EAGLE, STATE OF COLORADO moved adoption RESOLUTION NO. 93 - ?*:� In Re COTTONWOOD FILING 1, FINAL PLAT Lake Creek Affordable Housinct PD 296 - 93 - F WHEREAS, Faith Partners, a Colorado general partnership ( "Faith "), has submitted a Final Plat entitled COTTONWOOD FILING No 1, a Resubdivision of a portion of Eagle Crest Fili No. Amended Map for review and approval by the Board of County Commissioners of Eagle County, Colorado ( "Board "), pursuant to Section 2.19 of the Eagle County Land Use Regulations; and WHEREAS, County Staff have recommended that certain restric- tions be adopted as conditions of Final Plat approval, in order to address certain issues relating to the Lake Creek Affordable Housing site; and WHEREAS, Faith and the Board have agreed to provide for said conditions by this Resolution to be referenced on the Final Plat, which will preclude other extensive plat notes being affixed to the Final Plat. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY EAGLE, STATE OF COLORADO: THAT, the following restrictions are made a condition of the approval of the Final Plat for Cottonwood Filing 1: 1. In the event that Tracts X -1 or X -2 are sold, trans- ferred or otherwise conveyed to any party other than the Lake Creek Affordable Housing Corporation, no building permit shall be issued by Eagle County for construction on Tracts X -1 or X -2 until one of the following provisions is satisfied: a) all public improvements are in place and approved by Eagle County, and sufficient collateral required by and Acceptable to the County has been provided to guarantee the warranty period; or b) public improvements are collateralized in the form as described in a Subdivision Improvements Agreement and acceptable to Eagle County to secure the performance of the obligation to install the public improvements as indicated on the Lake Creek Apartments Construction Plans, dated June 1993, by Alpine Engineering, Job #10270, and approved by the Eagle County Engineer. For the purposes of this plat, public improvements shall mean those improvements generally M., .J x^ s C� C� described in the Eagle County Land Use Regulations and as described in the Lake Creek Apartments Construction Plans, dated June 1993, by Alpine Engineering, Job #10270. 2. No building permit shall be issued by Eagle County on Tracts X -1 and X -2 until evidence is provided indicating payment of the School District cash in lieu of land dedication fee of $3,612.60. 3. No temporary certificate of occupancy shall be issued by Eagle County for buildings located on Tracts X -1 or X -2 until Tract Z is dedicated to a public entity or quasi- public /non- profit entity or land conservancy. 4. This Final Plat approval is based on the Lake Creek Apartments Construction Plans dated June 1993, by Alpine Engin- eering, Job #10270, and approved by the Eagle County Engineer. The issuance of building permits for the development of Tracts X -1 and X -2 shall be based on compliance with said construction plans. Significant deviations to the approved construction plans, as determined by the Board, shall require review and approval of an'amended construction plan by the Board. THAT, this Resolution shall be referenced in a plat note upon the face of the Final Plat for Cottonwood Filing 1, and these provisions shall be incorporated therein as if fully set forth upon said Plat. MOVED, READ AND ADOPTED by the Board of County Commissioners of the County of Eagle, State of Colorado, at its regular meeting held the 6y day of July, 1993.
