COUNTY OF EAGLES STATE OF COLORADO
RESOLUTION NO. 93 - L_3__
RESOLUTION AUTHORIZING THE CLERIC AND RECORDER'S OFFICE TO
CONDUCT COURTESY INSPECTION VISITS OF LIQUOR LICENSE HOLDERS
UNDER THE JURISDICTION OF THE LOCAL LIQUOR LICENSING BOARD OF
EAGLE COUNTY.
WHEREAS, Colorado Revised Statute 12 -47- 137(4) states: No
license shall be issued by any local authority after approval of an
application until the building in which the business is to be
conducted is ready for occupancy with such furniture, fixtures, and
equipment in place as is necessary to comply with the provisions of
this article, and then only after inspection of the premisses has
been made by the licensing authority to determine that the
applicant has complied with the architect's drawing and the plot
plan and detailed sketch for the interior of the building submitted
with the application.
WHEREAS, a concern has been expressed by existing liquor
license holders that a closer monitoring of license issuance and
renewal is needed throughout Eagle County due to the continued
growth of the County .
WHEREAS, the Board of County Commissioners acting as the Local
Liquor Licensing Board recognizes that closer monitoring of license
issuance and renewal is for the safety and welfare of the general
public.
WHEREAS, the Local Liquor Licensing Board desires to improve
communications with the liquor license holders of Eagle County
thereby enhancing the Authority's understanding of the demographics
of the existing licensed premises and the potential for additional
licensed premises.
WHEREAS, the Local Liquor Board authorizes the Clerk and
Recorder to direct and supervise personnel from said department and
insure said personnel are adequately trained by a certified
Colorado State Liquor Inspector to perform minor courtesy
inspections of the licensed premises. Said training shall contain
a minimum of three training sessions, including review of the
Colorado Liquor Code and field training.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the Eagle County Clerk and Recorder, with the authority
of the Local Liquor Licensing Board, shall monitor the courtesy
inspection visits made by members of said department and
communicate any concerns to the Eagle County Attorney's office and
the Colorado State Liquor Inspector.
THAT, the enactment of this Resolution will allow for positive
communication between the license holder, the Local Liquor
Licensing Board and members of the general public of Eagle County.
THAT, this resolution is necessary for the public health,
safety and welfare of the citizens of Eagle County, Colorado.
MOVED, READ AND ADOPTED by the Board of County Commissioners
of the County of Eagle, }te of Colorado, at its regular meeting
