HomeMy WebLinkAboutR93-061 extension of SIA for McGrady Acres,x Commissioner moved adoption of e foil ing Resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLIITION NO. 93- AUTHORIZING THE EXTENSION OF THE SUBDIVISION IMPROVEMENTS AGREEMENT WHEREAS, on or about July 23, 1991, pursuant to Section 30 -28- 137, C.R.S., the Board of County Commissioners of the County of Eagle, State of Colorado ( "Board ") entered into a Subdivision Improvements Agreement ( "Agreement ") with Nottingham Ranch Company, a Limited Partnership and Susan Nottingham ( "Subdivider ") as a condition of final plat approval of McGrady Acres; and WHEREAS, in order to guarantee the faithful completion of certain public improvements required under the Agreement, the Board accepted as collateral Irrevocable Letter of Credit #144, dated July 23, 1991, in the amount of $348,000.00, with an expiration date of July 1, 1994; and WHEREAS, the Subdivision Improvements Agreement will expire on June 4, 1993; and WHEREAS, the Subdivider has by letter dated May 28, 1993, (Exhibit A) requested an extension on the Subdivision Improvements Agreement for a period of ten (10) months or until April 4, 1994, and the County agrees to said extension, (Exhibit B) for the mutual benefit to be derived by said extension; and NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, the Board hereby authorize the extension of the Subdivision Improvements Agreement to April 4, 1994. MEMORANDUM TO: Nancy Lewis, Attorney's Office �J FROM: Phill Scott, Engineering Department DATE: May 27, 1993 RE: McGrady Acres, Subdivision Improvements Agreement, First Partial Release of Collateral, Extension of SIA On Thursday, May 13, 1993, John Althoff and I inspected the public improvements constructed and collateralized as part of the above referenced subdivision. Please refer to the attached Exhibit A for a list of the work that was collateralized in this Subdivision Improvements Agreement. With the exception of Item no. 9, Bridge Improvements, the work appears to be in compliance with the terms and conditions of the Subdivision Improvements Agreement. We have received letters from various utility providers indicating their acceptance of the utilities for maintenance. With regard to Item no. 9, Bridge Improvements, attached Exhibit B specified suggested maintenance and repairs to the bridge. We observed that new bridge rail (Item no. 6) was installed, but we are unable to determine whether the rest of the items have been done. Reviewing the original bridge observation and inspection reports, it appears that additional deterioration or damage to the structure may have occurred. Therefore, we are recommending that the County not accept the bridge at this time, and that another inspection of the bridge by a qualified structural engineer to determine the extent of repairs that will be necessary to put the bridge into a safe and acceptable condition. We feel this bridge should be inspected by our bridge inspector. The developer has proposed extending the Subdivision Improvements Agreement for 10 months, while retaining $50,000.00 for bridge repairs. The public utility companies such as gas and electric. etc. will perform their own engineering and final cost estimates prior to construction.
