From the information you provided, I will release the Environmental Health hold on your building permit. However, you reported that the septic tank lids are 17 inches below the ground surface. As stated in section 4.07.03 of Chapter IV of the Eagle County Land Use Regulations, "The tank shall be installed with removable covers or manholes extended to within 8 inches of finished grade in order to provide access to the inlet and outlet devices of each compartment for cleaning and inspection." Therefore, please provide collars on the manholes to extend the covers to within 8 inches of finished grade, and notify our office of your action. Box 179 500 Broadway. Eagle, Colorado 81631-0179 You recently submitted a building permit application for your residence at 76 Deer Trail Ave., lot number 35, filing 1, Red Table Acres. The tax parcel that you listed for this address was 2391-271-03-001. The Environmental Health Division of Eagle County has not been able to locate any information on your existing septic system. The septic tank pumping receipt that you faxed to our office, indicates that your existing tank is at least 1200 gallons, and likely 1250 gallons. The size of the existing leach field is still in question. Generally, leach fields are sized to match the size of the septic tank. A 1250 gallon tank would accommodate a four bedroom home. There is no information on the design of the tank configuration or the material from which the tank is composed. Please send us a letter describing your septic tank, including the number of compartments, the material of construction, depth of tank lids below the ground surface, material of inlet and outlet lines, and length of the tees on the inlet and outlet lines in the tank. We cannot guarantee that your septic system will continue to function properly. A leach field failure could require that an entire new absorption field be installed at considerable expense and trouble. Adding on to the existing absorption field is a much less costly alterative. After we have received the above information, we will determine whether or not an alteration permit will be required in order to obtain your building permit If you have any questions, please call me at 328-8755. I gathered this by holding my breath while hanging upside down inside the septic tank with a friend holding nay feet to prevent a less than desirable septic bath, This was an experience I won't soon forget and will be the highlight of our construction project, The tank consists of a 1250 gallon, two -compartment concrete structure with 4" walls -The lid is 17 inches below the surface of the ground -The inlet line from the house is 3" Schedule 40 PVC pipe -inlet Tee is made of type of clay with 1/2" walls. The top section of the tee is 10" long measured from the inlet line. The bottom section extends 40-50" down. (This bottom length was more difficult to measure because of the liquids, but I did my best with the tape measure). The tee was in goad shape and free of organic matter, - The outlet 'Tee was as difficult to measure, From my perspective,.it matched the inlet Tee in material and length, -The outlet line was not inspected. Pettet _..a 5-0(:) Memo To: Cliff Simonton From: Laura Fawcett Date: October 22, 2001 Subject: Soil Profile Observation at 76 Deer Trail Ave., Lot 35, filing 1, Red Table Acres This morning I visited Brian Pettet's property, which is referenced above, to observe a soil profile hole and determine the suitability of this lot to support a conventional on -site wastewater treatment system for an auxiliary dwelling unit. Eagle County has no record of the system treating the effluent from the existing dwelling, because this system pre -dates our permitting program. I did not observe an evidence of failure for the existing system. The soil profile was dug to nine feet in depth, in a relatively flat area approximately mid -way between the existing house and the proposed location of the auxiliary dwelling unit. I requested the applicant locate the soil profile hole on his site plan. I saw no evidence of ground water or bedrock in the soil profile hole. The soil consisted of approximately two feet of top soil, then two feet of porous, silty, clay loam streaked with what appeared to be white calcareous material, then about five feet of silty, clay loam. I believe that the application rate of effluent in this type of soil should be .45 gallons per square foot per day. For an auxiliary dwelling unit with two bedrooms, 1000 square foot of leach field would be required at the application rate of .45 gallons per square foot per day. Section 4-690 of the Eagle County Land Use Regulations requires that subdivisions identify a primary and a secondary leach field site. Although the process the applicant is currently pursuing is not a subdivision, Environmental Health would recommend that both the primary and an alternate site be specified, in case the first site were to fail. Therefore, two 1000 square feet leach field sites should be identified by the applicant. Care should be taken when siting the ADU so that both leach field sites can be used without having to pump effluent' from the ADU uphill, if possible. Also, if the existing dwelling is a three bedroom house, (as I was told by the applicant) an alternate site of at least 1500 square feet must be available for a leach field replacement if the existing, leach field serving the house, were to fail. The leach field sizing for a replacement field for the existing house, is based upon the soil types observed in the profile for the ADU. If the existing leach field were to fail, another soil profile would need to be observed in the area where the new field would be installed. Prior to the installation or repair of any septic system, the Environmental Health Department will require additional soil work, including a percolation test, further review of site conditions and the issuance of an ISDS permit. The design of the proposed Special Use does minimize adverse impacts, including visual impact of the proposed use on adjacent lands; furthermore, the proposed Special Use does avoid significant adverse impact on surrounding lands regarding trash, traffic, service delivery, parking and loading, odors, noise, glare, and vibration, and does not create a nuisance. 5. Site development standards. The proposed Special Use does comply with the appropriate standards in Article 4, Site Development Standards. 8. Other provisions. The proposed Special Use does comply with all standards imposed on it by all other applicable provisions of these Land Use Regulations for use, layout, and general development characteristics. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of the County of Eagle, State of Colorado: THAT, the application of Brian Pettet and Patricia McFee, File No. ZS-00082, for a Special Use Permit for an Accessory Dwelling Unit on a non -conforming lot within the Rural Residential Zone District described herein, be and is hereby approved, subject to the conditions as set forth herein.
