HomeMy WebLinkAboutR93-034 enactment of fee for Aircraft Rescue and firefighting and security1 Y Commission moved adoption of the follow9 9 Resolut' n: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 93 -3/-/_ AUTHORIZING THE ENACTMENT OF A FEE BY THE EAGLE COUNTY REGIONAL AIRPORT FOR AIRCRAFT RESCUE AND FIREFIGHTING AND SECURITY WHEREAS, C.R.S. 30 -11 -107 (1)(j), and C.R.S. 41 -4 -106, grant the power and jurisdiction to the Eagle County Board of Commissioners (hereinafter "the County ") to regulate the receipt, deposit, and removal and the embarkation of passengers or property to or from the Eagle County Regional Airport; and to exact and require charges, fees, and tolls; and to lease or assign for operation such space or area, appurtenances, appliances or other conveniences necessary or useful in connection therewith; and to provide rules and regulations governing the use of such airport and facilities and the use of other property and means of transportation within or over the Airport; and WHEREAS, the Eagle County Regional Airport ( "Airport ") is desirous of assessing a fee, for Aircraft Rescue and Firefighting and Security ("ARFF"), on all air carriers using the Airport; said air carriers being: Delta, United, American and Taesa Airlines. WHEREAS, said fee would be charged to each carrier using a "per operation" guide, i.e. the carrier will be charged for each landing it perfoms at the Airport. WHEREAS, an accurate fee cannot be set at this time as the total number of flights will not be known until after the season is over. WHEREAS, the Airport will bill each airline monthly based on anticipated flights. At the end of the season, an accurate accounting of airline operations per carrier will be obtained and the final billing will be adjusted accordingly. WHEREAS, the fee charged by the Airport to each airline will be effective from January 1, 1993. WHEREAS, the total fee for the Aircraft Rescue and Firefighting and Security to be charged for the for 1993, as reflected in the 1993 budget for the Airport, is $60,837.00. WHEREAS, at the completion of the season, the amount budgeted, $60,837.00, will be divided by the actual number of total operations, providing the cost of each operation. Each airline will in turn be billed for its total number of actual operations, said billing being adjusted accordingly. BASED UPON the oral and written recommendations of the Airport Manager, the Board finds that the fee to be charged by the Airport on all air carriers using the Airport for an Aircraft Rescue and Firefighting and Security ( "ARFF /Security ") is appropriate. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, the Board hereby authorize the fee to be charged by the Airport on all air carriers using the Airport for Aircraft Rescue and Firefighting and Security ( "ARFF /Security ").
