Thompson on behalf of Arrowhead at Vail (hereinafter "Applicant ") for amendment of the Arrowhead at Vail Planned Unit Development, Edwards, Colorado (hereinafter the "PUD"), File No. PD- 139 -91 -A, for the parcel of land known as "Development Area H;" and WHEREAS, the Applicant to expand "Development Area of residential units within "Development Area J," adjac Exhibit "A" attached hereto reference; and requested the PUD Amendment in order H" to the south to allow construction the area historically known as ant to Filing 16, as depicted on and incorporated herein by this WHEREAS, notice of the proposed amendment was mailed to all owners of property located within and adjacent to the PUD, and was duly published in a newspaper of general circulation throughout the County setting forth the subject matter of the application, and the dates and times of hearings by the Planning Commission and by the Board of County Commissioners of Eagle County, Colorado (hereinafter the "Board "); and WHEREAS, at its public meeting held April 15, 1992, the Planning Commission, based upon its findings, recommended approval of the proposed PUD Amendment, with certain conditions; and WHEREAS, at its public meeting of April 28, 1992, the Board considered the PUD Amendment application, associated plans and the statements and concerns of the Applicant and the Eagle County staff. WHEREFORE, based on the evidence, testimony, exhibits, review of the Eagle County Master Plan, the recommendation of the Planning Commission and staff, and comments from all interested parties, the Board finds as follows: LL, 1. Proper publication and public notice was provided as required by law for the hearings before the Planning Commission and the Board of County Commissioners. 2. Pursuant to Section 2.18.02(3) of the Eagle County Land Use Regulations, the Board makes the following findings in its review of the proposed PUD Amendment: (a) The proposed Amendment is in general conformance with the Arrowhead at Vail Sketch Plan conditional approval of May 29, 1980. (b) The proposed subdivision conforms to all applicable regulations, policies and guidelines. (c) The reports on file pertaining to geologic, soils, wildfire, flood and airport hazards, mineral resource areas and significant wildlife areas, the recommenda- tions as prepared by the appropriate agency, have been considered. 3. Pursuant to Section 2.06.13(2) of the Land Use Regulations, the Board makes the following findings in its review of the proposed PUD Amendment: (a) The PUD Amendment is consistent with the intent of the Master Plan, and the policies therein. (b) The design of the PUD Amendment provides for adequate, safe, and convenient arrangements for pedestrian and vehicular circulation, off- street parking and loading space. (c) The Board of County Commissioners may require setbacks, lot widths, and space between buildings as necessary to provide adequate access and fire protection, to insure proper ventilation, light, air, and snowmelt between buildings, and to ensure that the PUD Amendment for "Development Area H" is compatible with other development in the area. As a general guide, 20 feet between buildings is considered minimum. (d) The PUD Amendment is planned to produce maximum usefulness to the residents of the development for purposes of recreation and scenery, and to produce a feeling of openness. Areas designated as common or public open space pursuant to the requirements of this section are accessible by proper physical and legal access ways. 0 (e) The developer has provided for central water and sewer facilities as required by the County Commissioners, the Colorado Department of Health, and the local health authorities. (f) The PUD Amendment provides for necessary commercial, recreational and educational facilities conveniently located to residential housing. (g) Clustered housing and other buildings shall be encouraged within the PUD Amendment to promote maximum open space and economy of development and variety in type, design and layout of buildings. (h) Maximum height of structures have been established by the approved PUD plan. 4. Pursuant to Section 2.06.13(3) criteria for evaluation of the PUD, the Board finds that the PUD Amendment is compatible with regard to the following: (a) Open space (25% Minimum) (b) Residential density (c) Density of Other Uses (commercial) (d) Architecture (e) Mixed Uses (f) Minimum Area (g) Maintenance of Open Space (h) Employee Housing 5. Pursuant to Section 2.06.13(7)(a) Preliminary Plan Review, the Board finds the PUD Amendment to be compatible with the following: (a) The Final Environmental Impact Report. (b) The information required by, and conditions of, the Sketch Plan approval. (c) The approved Zone Change. 3 (d) The PUD Control Document. The "Amended and Restated Guide - Planned Unit Development Plan" for the Arrowhead at Vail Planned Unit Development as it pertains to "Development Area H" has been submitted and reviewed by the Board. 6. Pursuant to Section 2.14.04, Review of Zone District Amendments, the Board finds as follows: (a) The PUD Amendment is consistent with the Master Plan; the area possesses the geologic, physical and other environmental conditions compatible with characteristics of the use requested; and the advantages of the use requested outweigh the disadvantages. (b) Conceptual evidence has been provided that the land has access and can be serviced with water and sewage disposal systems appropriate with the PUD Amendment being sought. (c) The area for which the PUD Amendment is requested has changed or is changing to such a degree that it is in the public interest to encourage a new use or density in the area. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of the County of Eagle, State of Colorado: 1. THAT, the application for approval of the PUD Amendment concerning "Development Area H" within the Arrowhead at Vail Planned Unit Development be and is hereby granted, subject to the following conditions: (a) No development shall occur along the slopes above the three upper bench building envelopes, Preliminary Plan Lots 6, 7, and 8. (b) Existing irrigation ditches shall be eliminated prior to plat approval for Preliminary Plan Lots 6, 7, and 8. (c) Temporary construction fencing shall be placed to protect existing vegetation outside the building envelopes, and access roads. 2. THAT, that part of the "Amended and Restated Guide - Planned Unit Development Plan" for the Arrowhead at Vail Planned Unit Development which pertains to "Development Area H" (attached hereto as Exhibit "B ") is hereby approved. 2 ,f f The Board finds, determines and declares that this Resolution is necessary for the health, safety and welfare of the inhabitants of the County of Eagle, State of Colorado. USES j 1) Multiple -two and single - family residential units. 2) Indoor recreation building and /or spa. 3) Outdoor recreation improvements, including but not limited to, tennis courts, swimming pools and golf courses. 4) Community building 5) Outdoor recreation activities, except equestrian use. B. DENSITY - Maximum of 117 units. C. BUILDING COVERAGE RATIO AND IMPERVIOUS AREA RATIO - The building coverage ratio shall not exceed a maximum of 30 percent, or a total of 50% coverage by impervious materials. D. PARKING - Off street vehicle parking shall be provided based upon the current Eagle County parking standards at time of issuance of the building permit by Eagle County, Colorado. E. MAXIMUM BUILDING HEIGHT - Thirty -five feet maximum for Eagle County review. More restrictive provisions apply - consult Design Guidelines for specific provisions. To permit the accurate measurement of height on Preliminary Plan lots 1, 2, 3, 4, 5, 6, 7, 8, the final plat for these lots shall show a measurement of average grade across each building site. F. MINIMUM BUILDING SETBACK - For Eagle County review, 20 feet from the edge of Arrowhead Drive road right -of- way, and sufficient to accommodate utilities, existing easements, drainage, access, fire code regulations and flood plain of live streams. More restrictions may apply - consult Design Guidelines for specific provisions. G. SPECIAL DEVELOPMENT REQUIREMENT FOR LOTS ABOVE ELEVATION 7360 - All lots win Development Area H above Elevation 7360 shall be required to meet the following special requirements: 1) Lighting. No exterior light whose direct source is visible from a neighboring property or which Arrowhead at Vail 1 produces excessive glare to pedestrian or vehicular traffic shall be installed. Indirect sources and horizontal cut -off fixtures are recommended to reduce glare and provide general ambient light. Use of other than white or pale yellow exterior lights will require specific approval of the Design Review committee. Final approval of the proposed illumination plan will be required by the Design Review Committee. Fixture colors, heights and placement shall be addressed in the illumination plan. 2) BUILDING MATERIALS - No reflective materials shall be used on any building in this area and mirror glass shall be prohibited. In general, natural or earthtones shall be the dominant exterior wall color for all units. A range of permitted colors for units shall be provided through the Design Guidelines developed specifically for Development Area H. 3) ROOF MATERIALS - Roof materials for any building constructed in Development Area H shall be carefully chosen to reduce off -site visibility. Any shake shingle roof shall be required to be stained immediately upon application to reduce visibility and glare. 4) %ERISCAPE LANDSCAPING - All lots above elevation 7360 shall be required to use xeriscape landscaping principles. The guidelines for this landscaping shall be addressed in the Design Guidelines for Development Area H. H. ADDITIONAL REVIEW AND SUBDIVISION PLATTING. Prior to the issuance of any building permits in Development Area H a final plat approval must be granted. Provided however, Development Area H may be subdivided through multiple plats filed in phases that do not necessarily include the entire Development Area H at one time. If in the opinion of the Planning Commission, a proposed subdivision plat is inconsistent with the approved Preliminary Plan for Arrowhead at Vail, The Eagle County Planning Commission and County Commissioners must formally approve development area plan changes prior to subdivision plat approval. This review shall be processed according to the schedule imposed by Section IV.2 of this Guide and shall be to ensure consistency with the intent and provisions of the approved Arrowhead at Vail Preliminary Plan, and the PUD Guide.
