HomeMy WebLinkAboutR24-011 Approving of Comerford Minor Type B Subdivision File No. SMB 009393-2023 DocuSign Envelope ID:06395C69-530D-4AD9-8AF6-94DAEDFD16CB Commissioner McQueeney moved adoption of the following Resolution: BOARD OF EAGLE COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO.2024- 011 RESOLUTION FOR THE APPROVAL OF A MINOR TYPE B SUBDIVISION FOR STAG GULCH COURT NO. 1 -A RESUBDIVISION OF LOT 1,CORDILLERA SUBDIVISION,FILING NO.6 LOT 1 AND 2 AND BUILDING ENVELOPE REESTABLISHMENT IN LOT 2A Eagle County File No. SMB-009393-2023 WHEREAS,on or about September 26,2023,the County of Eagle, State of Colorado, accepted for filing an application for a Minor Type B Subdivision(the"SMB"or"Application")from Kristin Pinner(the"Applicant"); and WHEREAS,the Property is owned by James and Jane Comerford;and WHEREAS,the Applicant requests the division of a 2.727 acre parcel,located at 2 Stag Gulch Court in the Cordillera/Edwards area, identified as Parcel No. 2107-142-02-016 and legally described in Exhibit A(the"Property"); and WHEREAS,the SMB proposes the re-establishment of a previously existing lot line between Lot 1A and 2A and the re-establishment of a building envelope on Lot 2A as described in Exhibit B; and WHEREAS,pursuant to Section 5-290.B.2 and Section 5-290.G.2 of the Eagle County Land Use Regulations(the"ECLUR") and Section 1.05.3 of the Cordillera Subdivision Eleventh Amended and Restated Planned Unit Development Control Document(the"PUD Guide"),the SMB is the appropriate process for a subdivision and a building envelope amendment; and WHEREAS,in accordance with Eagle County Land Use Regulations(the"ECLURs"), Section 5-210.E-Notice of Public Hearings, notice of the proposed Minor B Subdivision was mailed to all owners of property adjacent to the Property concerning the subject matter of the Application and setting forth the dates and times of meetings for consideration of the applications by the Board of County Commissioners of the County of Eagle(the"Board"),and; WHEREAS,at a public hearing held on January 9, 2024,the Board considered the proposed SMB,associated materials and plans submitted by the Application,the statements and concerns of the Applicant,the Eagle County Community Development Department, Engineering staff,and other interested persons, and; WHEREAS,based on the evidence,testimony, exhibits,as well as the comments of the Eagle County Community Development Department, comments of public officials and agencies, and comments from all interested parties,the Board finds as follows: 1 Eagle County, CO 202401258 Regina O'Brien 02/07/2024 Pgs: 5 11:34:50 AM REC: $0.00 DOC: $0.00 DocuSign Envelope ID:06395C69-530D-4AD9-8AF6-94DAEDFD16CB THAT,the application for the SMB complies with the standards in ECLUR Section 5-290.G.2 - Standards for Type B Subdivision, as set forth below: 1. Access,Water,and Sewer.Pursuant to Section 5-290.G.2.a,the Property has access from Stag Gulch Court,water service is provided by the Upper Eagle Regional Water Authority, and sewer service is provided by the Eagle River Water and Sanitation District respectively. 2. Conformance with Final Plat Requirements. Pursuant to Section 5-290.G.2.b,the SMB conforms to the Final Plat parameters and applicable regulations,policies, and guidelines. Water Supply is provided by the Upper Eagle Regional Water Authority and sewer service is provided by the Eagle River Water& Sanitation District. Access is provided by Stag Gulch Court. The Eagle River Fire Protection District will continue to serve the Property which is not within an identified geologic hazard area. A Site Plan was not required for the Application and school land dedication fees were addressed at the time of the original Cordillera Planned Unit Development (the"PUD"). All technical requirements for the Plat have been met by the Application. 3. Improvements Agreements. Pursuant to Section 5-290.G.2.c,the Application proposes no new public improvements or infrastructure which would necessitate an improvement agreement. All required improvements were addressed/completed with the original PUD. THAT,the Application also complies with the standards in Section 1.05.03.vii of the PUD Guide as set forth below: 1. Wildlife Corridors and Ridgeline Analysis. Pursuant to Section 1.05.03.vii of the PUD Guide, the SMB does not adversely impact wildlife corridors or ridgelines. NOW,THEREFORE,BE IT RESOLVED by the Board of County Commissioners of the County of Eagle, State of Colorado: THAT,this application for a Minor Type B Subdivision is hereby approved. THAT,the Board directs the Department of Community Development to provide a copy of this Resolution to the Applicant. THAT,the Board hereby finds,determines and declares that this Resolution is necessary for the health, safety,and welfare of the citizens of Eagle County.
