HomeMy WebLinkAboutMinutes 12/19/2023 PUBLIC HEARING December 19, 2023 Present: Kathy Chandler-Henry Chairman Matt Scherr Commissioner Jeanne McQueeney Commissioner Jeff Shroll County Manager Mike Nugent Chief Strategy Officer Kathy Scriver Deputy Clerk to the Board This being a scheduled Public Hearing,the following items were presented to the Board of County Commissioners for their consideration: Constituent Input Mike Meehan, CFA,MBA,part time resident of Eagle Vail spoke. He spoke about the increase in property values as a result of the assessed values going up for the upcoming tax year. His general view on government finance was that revenues should equal expenses. In Eagle County he believed this was not the case. The surplus for fiscal 2022 was$77.9 million dollars. The surplus for fiscal 2021 was $29.9 million dollars. The surplus for 2020 was $19.1 million. The revenues had far out paced expenses. For contingent and emergency expenses the county should reserve about 25%,or$32.4 million. He examined the last 6 years of capital spending in Eagle County and came up with an average capital spend of$18.2 million. Total recommended reserves he came up with was $87 million. He believed the county was very over capitalized and had too much money on the balance sheet. Eagle County could run off its reserves for two years without collecting a dollar. The current issue in question was reducing the mill levy to keep the tax rate the same as the prior years. To keep the property taxes level with what they were the previous year would mean the mills would have to drop from 8.499 to 6 mills. Alternatively the county could offer a variable tax credit. The county also had a big windfall come their way because it had$280 million dollars in cash and would now be making 5%a year on interest. Kate Sheldon, Eagle Ranch resident, spoke. She requested the board's support for hiring an enforcement officer to deal with the current off-leash dog problem. She believed the need for animal services was on the rise in Eagle County. She believed that 78%of the dogs caught on trail cams were off leash on the Haymaker Trail and the Eagle Ranch golf course. She believed the problem had been growing with the increased population. There were three reasons she was requesting the boards support: 1. to protect the dogs on leash, 2.protect people and children, and 3. to protect what's left of the E16 elk herd. Elk was Colorado's biggest asset as$3.2 billion is what hunting, fishing,and watchable wildlife tourism brought to Colorado. Colorado had the largest herd in the US but in recent years, that had changed. She believed that the community surveys all showed that wildlife protection was a top priority. She encouraged the support of a local enforcement officer. Commissioner Updates Commissioner McQueeney wished everyone a happy holiday season. There would be no meetings for the next couple weeks due to the Christmas and New Years holidays,and she wished everyone the best of the remainder of the year. The board would see everyone in 2024. Commissioner Scherr stated that this was the last day that Chairman Chandler-Henry would be chair of this board. He thanked Chairman Chandler-Henry for her leadership and hard work. 1 10/24/2023 Chairman Chandler-Henry stated that today was a historic day on the Western Slope. A purchase and sale agreement would be signed between Westslope Partners and Excel Energy for the rights to the water that flows through the Glenwood Canyon at the Shoshone Power Plant. The impact of that would be to keep water on the western slope whether or not the plant was operating. It benefited the fish,the environment,those who recreated, and all those who like to drive through the canyon and see the Colorado River flowing. County Manager Updates There were no updates from the county manager's office. Consent Agenda 1. Final Payment for Frontier Paving Inc. for the 2023 Overlay Project Nicole Trujillo,Road&Bridge 2. Resolution 2023-076 Approving the Consolidated Special Use Permit for English in Action Headquarters File No. ZS-009341-2023 Troy Hangen, Community Development 3.November 2023 Payment Report Christina Andrews,Finance Commissioner McQueeney moved to approve the Consent Agenda for December 19, 2023 as presented. Commissioner Scherr seconded the motion. The vote was declared unanimous. Business Item 1. Client Authorization to Bind Coverage for the 2024 Casualty and Property Insurance Program Abby Dallmann, Finance Executive Summary: On an annual basis,Eagle County works with its broker,Arthur J. Gallagher,to place a comprehensive line of insurance coverage for its people and assets, at a reasonable cost. This includes a public entity liability program,property, cyber security liability,workers'compensation,volunteer accident, and airport liability. The total premium cost for coverage in 2024 is $1,597,138. See full costs in ECG Insurance 2022 -2024. Abby Dallmann,Eagle County Risk Manager, stated that annually the county worked with the risk - management consultant,Arthur J. Gallagher and company. They help place all the lines of coverage,primarily property and casualty. They try to find the best rates and coverages for the lowest premiums. This year there was a 14%increase in the overall program cost primarily driven by the property coverage. Chairman Chandler-Henry asked about the cost of cyber security. Ms. Dallmann stated that the cost for the coverage of cyber security was around$60,000. This covered the county if there was a breach or if county data were to be compromised. It was hard to predict what this cost would be. 2 10/24/2023 Commissioner Scherr moved to approve the Client Authorization to Bind Coverage for the 2024 Casualty and Property Insurance Program. Commissioner McQueeney seconded the motion. The vote was unanimous. Work Session - Eagle CountyRoom g 1. 2024 Legislative Policy Statement and Legislative Advocacy Playbook Abby Dallmann,Administration Executive Summary: The purpose of this discussion is to review the 2024 Legislative Policy Statement and the newly-created Legislative Advocacy Playbook. ZS-009377-2023 -Amended Final Plat(AFP)for Cordillera Subdivision Filing 26(Lot)line vacation between 628 Settlers Loop and 45 Hawley Court Troy Hangen, Community Development Executive Summary: Amended Final Plat(AFP) for the vacation of the boundary between 628 Settler's Loop and 45 Hawley Court Filing 26,Lot 9 and Filing 26, Lot 10 of the Cordillera Subdivision. Project Name: AFP for Cordillera Subdivision Filing 26(Lot)line vacation between 628 Settlers Loop and 45 Hawley Court File No.: AFP-009377-2023 Location: 628 Settler's Loop and 45 Hawley Court, Squaw Creek West area(Parcel#2107-103-08-001 and #2107-103-08-002) Applicant(s): Brilliance LLC Representative: Matthew K. Stovall,Esq. Staff Planner: Troy Hangen, Senior Planner Recommendation: Approval with Condition Mr. Stovall stated that his client wished to vacate the lot line between 628 Settler's Loop and 45 Hawley Court to preserve the view corridors at the back of their home and save a little on taxes and dues. There were no intentions of building on the lot. Mr. Hangen presented the zoning map and identified the surrounding land uses. The applicant went out to 24 agencies, and 5 agencies responded with no concerns. Staff determined that the combination of the two lots would reduce density and provide for a larger view corridor. There was no evidence of any adverse effects to adjacent property owners. Staff believed the application,based on the findings, met all applicable standards as outlined in the staff report. Chairman Chandler-Henry asked if by eliminating the lot line,would that remove the ability for an additional housing unit on the property. 3 10/24/2023 Mr. Hangen stated that by removing any water connections and building envelopes,no additional residences would be built. Commissioner Scherr asked if an ADU was permitted. Mr. Hangen stated that he'd have to check into the existing PUD guide. He did not have that information. Chairman Chandler-Henry opened and closed public comment, as there was none. Commissioner McQueeney believed that the application was straightforward and it was made clear by staff that the application met the standards. Commissioner Scherr stated that he had no questions or concerns. Chairman Chandler-Henry concurred with her colleagues. Commissioner Scherr moved to approve File No. AFP 009377-2023,AFP for Cordillera Subdivision Filing 26 (Lot)line vacation between 628 Settlers Loop and 45 Hawley Court and building envelope vacation on 45 Hawley Court, incorporating staff's findings and recommended condition,because this application, as conditioned, meets the standards for approval of an Amended Final Plat.
