ZS-009378-2023 - Schofield Residence Accessory Dwelling Unit Troy Hangen, Community Development Executive Summary: Special Use Permit application to add an Accessory Dwelling Unit(ADU)on a legal, nonconforming(less than 35 acres)Resource(R)zoned parcel. Project Name: Schofield Residence Accessory Dwelling Unit File No.: ZS-009378-2023 Location: 8340 Colorado River Road, Gypsum area, (Parcel 1935-034-01-001) Owner: Levi Schofield Trust Representative: Bobby Craig-Arapahoe Architects,PC Mr. Craig with Arapahoe Architects stated that his client Levi Schofield,owner of the property,wished to tear down the existing house and build a new house that includes an attached garage with an ADU above. They had a permit for the home and the application was just for the ADU. Mr. Hangen presented a brief overview of the request. The property was located approximately 6 miles northeast of Dotsero. The applicant was proposing a 613 square foot ADU Accessory Dwelling Unit. A special review was required for the ADU because it was on a non-conforming parcel. Staff recommended approval with conditions. Public notice was provided and no public comments had been received as of October 18,2023. Mr. Hangen reviewed the standards and indicated that the request met the standards with conditions. The Planning Commission considered the application and recommended an approval with conditions. Commissioner McQueeney commented about the water rights not being adjudicated and the risk the client was taking without having the water rights adjudicated. Mr. Craig stated that his client had already hired a water attorney and was told it could take 6-12 months to get it finalized. Chairman Chandler-Henry asked if there had been any comments from the neighbors. Mr. Craig indicated that they received no comments from the neighbors. Chairman Chandler-Henry asked about the well and if it had capacity to accommodate the ADU. Mr. Craig stated that there hadn't been any issues. Chairman Chandler-Henry opened and closed public comment, as there was none. Commissioner Scherr believed the file was straightforward and agreed with staff that the application met all the standards for special use permit. 1 10/24/2023 Commissioner McQueeney concurred with Commissioner Scherr. Chairman Chandler-Henry concurred with her colleagues and the Planning Commission that ADUs had progressed and this was something to be encouraged. Commissioner Scherr moved to approve with conditions File NO. ZS009378-2023,incorporating staff's findings and recommended conditions,because this application, as conditioned,meets the standards for approval for a Special Use Permit.
